MAIN STREET, LOS GATOS, CALIFORNIA. The meeting was called to order at 5:00 p.m. by John Bourgeois. ATTENDANCE: Members present: Barbara Spector, Joe Pirzynski, John Bourgeois, Marico Sayoc, Todd Jarvis, Matthew Hudes, Barbara Cardillo, Charles Erekson, Bob Beyer Members absent: None Staff rp esent: Sandy Baily, Assistant Community Development Director; Joel Paulson, Principal Planner; Suzanne Avila, Senior Planner; Erwin Ordofiez, Senior Planner VERBAL COMMUNICATIONS Dick Henning, an Oka Road resident, asked about the 1992 Americans with Disabilities Act (ADA) and noted traffic and road maintenance concerns that he reported to the Police Department and to Parks and Public Works staff. He noted there is no sidewalk along portions of Oka Road so pedestrians have to walk on the road. He also noted that members of his trailer park have found the need to do their own asphalt road repairs and graffiti removal. ITEM 1 INTRODUCTION OF NEW COMMITTEE MEMBERS John Bourgeois welcomed new Committee members Charles Erekson and Bob Beyer. ITEM 2 APPROVAL OF MINUTES FROM SEPTEMBER 12, 2012 Joe Piraynski moved approval of the minutes. Marico Sayoc seconded the motion. Barbara Spector recused herself. The motion passed 8 -0 -1. EXHIBIT 12 of Attachment 1 General Plan Committee Minutes February 27, 2013 Page 2 of 7 ITEM 3 REVIEW AIiOZ REFERRAL FROM TOWN COUNCIL Sandy Bally gave an overview of the Town Council actions from January 22, 2013, and request for the Committee to reconsider the original 41 potential AHOZ sites. Council asked for additional traffic and school enrollment impacts and additional outreach to surrounding neighborhoods once defined sites were identified by the Committee. Barbara Cardillo questioned how the AHOZ affects a property. Joe Pirzynski asked if the Town can designate fewer AHOZ sites and disperse units throughout the Town. Sandy Bally responded to the questions and introduced Erwin Ordonez who presented updated information about the Town's Regional Housing Needs Allocation (RHNA), updated housing production, and a matrix of the 41propeities previously considered for AHOZ sites. Erwin Ordonez noted a preliminary staff analysis of the building permit reports since the preparation of the Housing Element in 2009 could allow for the remaining RHNA goals to be reduced from the 452 units noted to approximately 370 units. He noted that staff would be able to verify the reduced number for the Committee by its March 27`b meeting, after review of the actual permit records is complete. He also noted potential for recently approved apartment 'units to be counted. Erwin Ordohez gave an overview of the revised matrix and noted four questions for the Committee to consider: • Of the five (5) AHOZ sites previously recommended to the Town Council, which sites, if any, should continue to be considered as a potential AHOZ site? • Of the four (4) remaining AHOZ sites that were analyzed in the 2010 General Plan E1R, should any be reconsidered as a potential AHOZ site? • Of the remaining additional 32 AHOZ sites originally considered by the General Plan Committee, should any be reconsidered as a potential AHOZ site? ® Are there any other alternate sites that should be considered as a potential AHOZ site? Joe Pirzynsld asked about the five sites that have been evaluated and the development capacity, and whether the 50% affordability is required. Erwin Ordoiiez said that the Committee essentially revicwed the affordability before when it discussed the design guidelines for the five sites. Of the 370 units, 350 would be moderate income and below. The design guidelines would need to take that into consideration. General Plan Committee Minutes February 27, 2013 Page 3 of 7 Joe Pirzynsld commented that his assumption was that some of the units would need to be made up elsewhere if the density is reduced on Oka Road. If it is decided that the five sites are still the most viable, the difference in number of units could be made up elsewhere. Marico Sayoc asked if the unit affordability analysis has been done. Erwin Ordonez said the work was done for the five sites when the Committee drafted the AHOZ Design Guidelines and this was included in the recommendation to Council. Marico Sayoc asked if the 82 unit reduction was a result of staff's farther study. Matthew Hudes clarified that the apartment units were in addition to the 82 unit reduction. Erwin Ordonez commented that one approved development includes 25 affordable units. In addition to obtaining these units, the initial rents will be evaluated to see if any fall into the moderate category. MatthewHudes commented that he did not think there were clear site selection criteria when the guidelines were drafted. The AHOZ's should be distributed throughout town and areas should be selected where the goals can be realized. Barbara Spector asked about the reference to the EIR deadlines that would apply if the Committee decides to evaluate new sites. Erwin Ordoitez said that HCD would like to see implementation within one year of adoption. As long as progress is being made, the deadline is the end of 2013. Barbara Spector commented that using the South Bay site as an example, under the current draft , 256 below market rate units or a 50150 split could be developed. Erwin Ordoriez said the guidelines would need to be revised to balance out the categories. Public Comment: Iddo Hadar, Knowles Drive, thanked staff for the analysis that has been done. He commented that there are about 1800 units under the current proposal (the matrix). Looking at past history, about 30 units are being added annually. Other sites such as the North 40 can provide additional units. He would like to see a wider distribution of units around town. There is roughly a 50150 distribution north of Lark and south of Lark. Consider the entire range of sites. John Bourgeois clarified that the density was reduced to 12 outs /acre. JeffLockridge, Oka Road, commented that he is disappointed that this is the first time residents have had a chance to comment. Once you have an understanding of what affordable housing is and what the RHNA numbers are, there are important requirements including not clustering units, locating them close to transit and services, the Oka Road sites do not fit the standards. The General Plan Committee Minutes February 27, 2013 Page 4 of 7 majority of affordable housing in town is already located in this area. He suggested using the vacant site on the corner of Los Gatos Blvd. and Gateway. Units need to be spread out and not clustered. Lee Quintana asked for clarification on the 50% affordable /50% market rate distribution and if the density of the site would need to remain at 20 units /acre. Erwin Ordohez commented that HCD required a minimum density of 20 units per acre as a density that could support more affordable units from a planning stand point. The AHOZ program does allow 50% market and 50% affordable. Lower densities would likely result nn larger lot development and the affordability ranges would likely not be able to be achieved. Shawn Wood, resident of the Knowles Drive area, commented that it appears that we are sticking to the same program and not really addressing the problem. He thought that there would be residents included at the table. There are other solutions that should be considered. We should take a step back from this and look at other creative solutions. Marico Sayoc commented that if Mr. Wood has iunfennation that he has obtained from other sources, it should be shared with the Committee. John Bourgeois commmented that any information that has been gathered can be submitted and should be provided to the Committee members in advance of the next meeting. Barbara Spector commented that neighbors are encouraged to submit information to staff and that the materials can then be reviewed and provided to the Committee with staff comments. Lee Peterson, 1156 Audrey Avenue, Campbell, commented that he lives a few blocks from affordable housing projects on Parr Avenue including Open Doors and Villa Vasona. He lives about four blocks from the Knowles and Capri site. This would be the third affordable housing site on the same area. That is a real concentration of affordable emits. Although the Open Doors development is well maintained, the streets are not kept clean. He is concerned about a concentration of low income units. Padraig Omathuna, Mojonera Court, commented that the RHNA numbers are wrong as ABAG is inflating its forecasts. The 2007 -2014 numbers were found to be incorrect. The Department of Finance numbers are to be used to establish the RHNA numbers. He asked if the Town contested the RHNA numbers for the next housing cycle. If they are overstated the Town will over allocate. Erwin Ordonez commented that the RHNA numbers for the next housing cycle have been appealed by the Town. The Town is working with other west valley cities on this issue. Joe Pirzynski commented that the appeal letter to ABAG can be provided to residents. Chris Cowan, Oka Road neighborhood, commented that it makes sense to eliminate the sites that are currently zoned R -1:8. It is too big a jump to go from low density to 20 units /acre. The Oka sites should be removed from the list of potential AHOZ sites. He agreed with the criteria cited General Plan Committee Minutes February 27, 2013 Page 5 of 7 by Matthew Hudes. It makes sense to consider the other 32 sites and all other possible sites that have come up. Marico Sayoc asked Mr. Cowan if he had any sites to add to the list. Mr. Cowan responded that the convent site (Prospect Road) and the site on Gateway were the two that he is aware of Carol Anne Bilinkas, Villa Vasona, cormented that as a senior low income renter, she is thankful that the Town of Los Gatos put into motion low income units. She is able to five independently thanks to the Town planning efforts. It is an ideal location close to two local bus lines and the hospital. She appreciates all of the concerns from the homeowners, but there are also senior needs, Many seniors are not able to keep their homes. Having a safe, decent place to live is important. Mario Blasnn, Oka Road area resident, commented that he does not oppose low income housing. These sites do not have any transportation or services in close proximity. Sandeep Tiwari, Mojonera Court commented that one of the things he Ioves about Los Gatos is that it is a well - planned town. It is beautiful and has been well managed and well planned. It is a mature town and there is not a lot of available space left for development. Residents would like to retain a good quality of life. He would like to maintain the character of the town. Residents would like to continue to provide input to the GPC. Sites on Oka Road would generate too much traffic. Residents do not like having decisions forced on them. The whole town should carry the weight. John Bourgeois asked Matthew Hudes to reiterate fhe goals that he mentioned earlier. Matthew Hudes presented the following goals: 1. Fulfill state requirements 2. Reasonably distribute the AHOZ units throughout town 3. Minimize impacts on traffic, parking and community 4. Create attractive sites that are viable for development In response to a question from Marico Sayoc, Erwin Ordoilez commented that the town developed formula for the ratios for the different affordability levels. HCD will look at the sites analysis, how the numbers are distributed, how the affordability levels can be distributed. The Town agreed to have an expedited review process so a developer wishing to develop under the AHOZ could move forward with a project with only Architecture and Site approval. Marico Sayoc commented that using the framework, looking at the five sites, an effort was made to not to deviate widely from Town requirements. She asked if the design criteria need to be redone. Erwin Ordonez commented that sites should be identified and then tiered in order of priority. The intent would be to use as much of the Committee's past work as possible but criteria would need to be developed for new sites. General PIan Conunittee Minutes February 27, 2013 Page 6 of 7 Barbara Spector commented that with respect to the four levels of analysis, the one that causes her concern is the state requirements. She would like to review additional information that is gathered and submitted by residents. Barbara Cardillo asked if sites are designated during this housing cycle, can sites that are not used be redesignated in the next cycle. Erwin Ordohez said the intent was exactly that, and that was part of the impetus in developing this program. There is nothing requiring the units to be clustered. The State will be looking at what the Town has implemented prior to the start of the next cycle. The bottom line is to show that the Town planned for the RHNA noted for the current Housing Element cycle. Barbara Cardillo asked if the additional environmental analysis was provided. Sandy Baily said that the Addendum was provided to the Planning Commission and Town Council, but was not distributed to the Commnittee. New sites may likely require additional environmental analysis. Barbara Spector asked if it is feasible to meet state requirements. Erwin Ordohez commented that there are nine months remaining to complete this process. Barbara Spector commented that it was her understanding that the numbers might be reduced. There might be more options to explore. Joe Pirzynski conuuented it has been agreed that affordable housing is a good thing for our community. The Town is not a gated community. He would like to see, as a community, development of affordable housing, deciding where to place that affordability, regardless of what the numbers are. Clustering affordability all in one place is a mistake. The goal is to establish affordable units that are in conformance with the community. He would like to see staff come back with analysis on realistic opportunities in where to establish affordability. What is possible, what is realistic and what can be achieved. He does not want to cluster units in one location, and does not want to eliminate any sites at this time. Charles Erekson commented that he would echo Mr. Pirzynski's coimnents. We should pursue the goal of providing affordable housing in Town. He wondered if the missing partner at the table is developers. He would like to test the feasibility of providing affordable housing that will meet the state goal. Is the goal to provide affordable housing in town or to meet the state requirements? John Bourgeois commented that he would like to provide more direction to staff on the potential sites, and he does not want to go back to ground zero. The sites on Oka Road should be reduced to a single site. Todd Jarvis conunented that it would be helpful if staff could provide information on the sites that are most appropriate using the guidelines. He could use some help in ranking the sites based on the desirability. Erwin Ordon"ez said that there may be sites that can be removed. For example, some of the sites on Oak Rim Way contain single - family homes. These sites could potentially be removed since the increase in density would be negligible. General Plan Connuittee Minutes February 27, 2013 Page 7 of 7 Joe Pirzynski commented that staff can make recommendations on the sites that should be removed. John Bourgeois made a motion to have staff return with the revised number of needed units, any alternatives to consider, and using the new numbers, reprioritize the sites using the criteria from Mr. Hudes. The motion was seconded by Todd Jarvis. Barbara Spector commented that the 10 Oka Road sites be carefully considered and potentially reduced to one site. Marico Sayoc commented that information could be provided on additional sites that have been suggested, to include staff recommendation on whether to add any sites. John Bourgeois commented that information on the North 40 and Los Gatos Lodge sites should be provided. The motion passed unanimously. The next meeting is tentatively scheduled for March 27, 2013. ITEM 4 ELECTION OF CHAIR AND VICE CHAIR Marico Sayoc nominated John Bourgeois to continue as chair for 2013. The motion was seconded by Charles Brekson /Joe Pirzynsld and passed unanimously. John Bourgeois nominated Marcio Sayoc as Vice - Chair. The motion was second by Joe Piraynski and passed u nani nously.
