ON CERTAIN STREETS
RECOMMENDATION:
1. Accept the 2013 Town -wide Vehicle Speed Survey (motion required);
2. Direct Clerk Administrator to read the title of the Ordinance;
3. Move to waive the reading of the Ordinance (motion required);
4. Move to introduce the Ordinance amending section 15.30.235 of the Town Code
establishing speed limits on certain streets.
BACKGROUND:
The California Vehicle Code (CVC) requires engineering and traffic surveys to be
completed at least once every ten years to support radar enforcement by the Police
Department of prima facie speed limits, e.g., speed limits that are not statutory such as
local streets (25 mph) and the maximum speeds on highways and freeways (55, 65 and 70
mph.)
The previous Town -wide engineering and traffic survey was completed in September
2003, and was approved at the September 19, 2003 Town Council meeting. The current
radar speed survey report was completed in August 2013, and is on file in the Parks and
Public Works department. A summary table of the report is attached.
An engineering and traffic survey includes measuring the prevailing speeds and
evaluating the existing roadway and traffic conditions, accident history, and pedestrian
and bicyclist safety. The speed limit is normally established at the first five mile per hour
increment nearest the 85 percentile speed.

In matching existing conditions with the traffic safety needs, engineering judgment may
indicate the need for reduction of five miles per hour, if the 85 percentile speed is
rounded up to the nearest five mile per hour increment.
DISCUSSION:
Only three changes are being recommended as a result of this most recent speed survey
• Los Gatos Boulevard is currently posted at 25 mph from Alpine Avenue to
Spencer Avenue, and 35 mph from Spencer Avenue north. The proposed changes
would extend the 25 mph posted speed limit north to Roberts Road, providing for
slower speeds in the vicinity of Van Meter Elementary and Fisher Middle School.
Posted speed limits would remain 35 mph north of Roberts Road.
• Knowles Drive from Winchester Boulevard to Dell Avenue is currently without a
posted speed limit. Based on the speed survey results, the recommended posted
speed limit would be 30 mph, consistent with the posted speed limits on Dell
Avenue in the City of Campbell.
• Marchmont Drive is currently signed with an advisory speed limit of 15 mph from
Hilow Road to Marchmont Court, and a posted 15 mph speed limit from
Marchmont Court east to Hillbrook School. Based on the speed survey, staff is
recommending replacing the 15 mph advisory section with a posted speed limit of
15 mph, thereby establishing a continuous posted 15 mph speed limit from Hilow
Road to the easterly terminus of Marchmont Drive.
In addition to the three changes described above, staff is also recommending minor edits
to correct some of the street names listed in the Town Code. Section 15.30.235 of the
Town Code needs to be amended to reflect both the amendment of the street names as
well as the three minor adjustments described above.
Town Council approval of this survey is required prior to the document being sent to the
Municipal and Juvenile Courts for "judicial notice." Judicial Notice is where the court
recognizes the engineering and traffic survey as containing facts that are self - evident and
no additional speed limit evidence is necessary in a particular speed violation case.
Approval of the survey will allow the Police Department to legally enforce speed limits
on all Town streets by using radar.
CONCLUSION:
Staff recommends that the Town Council consider and accept the 2013 Town -wide
vehicle speed survey and introduce an ordinance of the Town of Los Gatos amending
section 15.30.235 of the Los Gatos Town Code for establishing speed limits on certain
streets.

ORDINANCE OF THE TOWN OF LOS GATOS
AMENDING SECTION 15.30.235 OF THE LOS GATOS
TOWN CODE FOR ESTABLISHING SPEED LIMITS
ON CERTAIN STREETS
THE TOWN COUNCIL OF THE TOWN OF LOS GATOS DOES ORDAIN AS
FOLLOWS:
SECTION I
Section 15.30.235, of the Town Code is hereby repealed in its entirety.
SECTION II
Based on an engineering and traffic survey, Section 15.30.235 of the Los Gatos Town Code is
hereby enacted to read as follows:
Sec. 15.30.235. Establishing speed limits on certain streets.
It is hereby determined upon the basis of an engineering and traffic survey that the
following speed limits will facilitate the orderly movement of vehicular traffic and are
reasonable and safe and are declared the prima facie speed limits and shall be effective when
appropriate signs giving notice thereof are erected upon the street.

In the event that any part of this ordinance is held to be invalid, the invalid part or parts
shall be severed from the remaining portions which shall remain in full force and effect.
SECTION IV
Pursuant to Section 15096 of the CEQA Guidelines, the Town of Los Gatos acts as a
responsible agency for adoption of this ordinance within the Town of Los Gatos. The Town
Council makes the following findings: The amendment to the Town Code is not a project under
CEQA and therefore, does not require any action under CEQA.
SECTION V
This ordinance was introduced at a regular meeting of the Town Council of the Town of
Los Gatos on November 4, 2013 and adopted by the following vote as an ordinance of the Town
of Los Gatos at a regular meeting of the Town Council of the Town of Los Gatos on November
4, 2013. This ordinance takes effect 30 days after it is adopted
