2�pW N Oa i s COUNCIL AGENDA REPORT g FASO DATE: MAY 7, 2013 TO: MAYOR AND TOWN COUNCIL FROM: GREG LARSON, TOWN MANAGER MEETING DATE: 05/20/13 ITEM NO: SUBJECT: TRACT NO. 10156 — LOCATED SOUTH OF PLACER OAKS ROAD AT FRANK AVENUE ADOPT A RESOLUTION APPROVING THE FINAL MAP FOR TRACT NO. 10156 LOCATED SOUTH OF PLACER OAKS ROAD AT FRANK AVENUE AND ACCEPTING THE DEDICATIONS OF PUBLIC EASEMENTS. RECOMMENDATION: Adopt a resolution approving the Final Map for Tract No. 10156 located south of Placer Oaks Road at Frank Avenue and accepting the dedications of public easements. BACKGROUND: The Town Council adopted Ordinance 2190 on May 17, 2010, approving planned development application PD -07 -142. Ordinance 2190 rescinded Planned Development Ordinances 2081 and 2122 for construction of 49 apartment units, changed the site zoning designation from RM:5- 12:PD to R- 1:8:PD, and approved construction of 10 new single - family homes, inclusive of a Below Market Price (BMP) unit. The Development Review Committee approved Tentative Map application M -12 -003 on May 8, 2012. Architecture and Site Applications S -12 -006 through S- 12 -015 were approved by Planning Commission on July 11, 2012. DISCUSSION: Tract No. 10156 subdivides the existing 3.06 -acre parcel into 10 single - family lots and 4 common area parcels and one private street parcel. The developer, Canyon Oaks Los Gatos, LLC, has provided all the necessary maps and drawings. The Town has reviewed the maps and drawings and found them to be in compliance with Town code and the approved conditions of approval. The developer has paid the required fees, as listed on page 2 of this report. Off -site improvements include signing and re- striping of existing traffic calming improvements, and tie -in utilities and paving at the new project entrance. No contract or bonds are required for this project. The developer has dedicated certain easements for public service facilities, storm drainage, sanitary sewers, and emergency vehicle access. The Town assumes no new maintenance responsibilities for facilities within these easements. The sanitary sewers within the public easements will be maintained by West Valley Sanitation District, and the public service facilities are owned and maintained by the dry utility providers, such as PG &E and Verizon. While facilities within the public storm drainage easements will be maintained by the Town, these are old facilities that have existed historically without the formal rights of easements. The public storm facilities do not serve the new development. CONCLUSION The map and associated improvement plans comply with Town approvals and all required fees have been paid. Staff recommends that Town Council adopt the attached Resolution approving the Final Map for Tract 10156 located south of Placer Oaks Road at Frank Avenue and accept the public easement dedications. ENVIRONMENTAL ASSESSMENT: This activity is a project as defined under the California Environmental Quality Act (CEQA), but is ministerial; therefore no further action is required under CEQA. Distribution: Canyon Oaks Los Gatos, LLC, 21060 Homestead Rd 4120, Cupertino, CA 9501 RESOLUTION 2013- RESOLUTION OF THE TOWN COUNCIL OF THE TOWN OF LOS GATOS APPROVING FINAL MAP OF TRACT NO. 10156 AND ACCEPTING DEDICATIONS WHEREAS, on May 8, 2012, the Development Review Committee of the Town of Los Gatos approved Tentative Map Application M -12 -003, with conditions; and WHEREAS, the Owner or Subdivider has complied with the conditions of Tentative Map Application M -12 -003; NOW, THEREFORE, IT IS RESOLVED that the certain Final Map of Tract No. 10156 in the Town of Los Gatos, dated April 2013, and prepared by Civil Engineering Associates for approval by the Town Engineer of the Town of Los Gatos, is hereby approved; the Town Manager is hereby authorized and all offers of easements for public use therein made on said Map are hereby accepted.
