SUBJECT: PPW_JOB NO. 10 -19 — UNIVERSITY AVENUE RESURFACING PROJECT
(SHELBURNE WAY TO VASONA DAM) 811 -0006
AUTHORIZE THE TOWN MANAGER TO EXECUTE A CERTIFICATE OF
ACCEPTANCE AND NOTICE OF COMPLETION ACCEPTING THE WORK
OF DURAN & VENABLES, INC. AND AUTHORIZE RECORDING BY THE
CLERK ADMINISTRATOR.
RECOMMENDATION:
Authorize the Town Manager to execute a Certificate of Acceptance and Notice of Completion
accepting the work of Duran & Venables, Inc. and authorize recording by the Clerk
Administrator.
BACKGROUND:
The Town's adopted FY 2011/12 — 2015/16 Capital Improvement Program (CIP) Budget
designates grant funds for roadway improvements on University Avenue through the Caltrans
Surface Transportation. Improvement Program (STIP) and the project consistent with the Town's
goals to improve quality of roadway infrastructure in Los Gatos.
This project on University Avenue, from Shelburne Way to the Vasona Dam, was designed to
repair failed roadway base sections, replacing non - standard storm drain catch basins, installing
storm drain pipes, constructing new curb, gutter, retaining wall, and sidewalk near Pepper Tree
Lane and widening the roadway at this location.
DISCUSSION:
On July 18, 2012, during the Town Council summer recess, the Town Manager awarded the
contract to Duran & Venables, Inc. to perform the improvements on University Avenue. The
contracted work has been satisfactorily completed by Duran & Venables, Inc. and is being
recommended for acceptance by the Parks and Public Works Department.

DISCUSSION (cont' :
Ten percent of the faithful performance bond will remain in effect for a period of two years to
guarantee any needed repair and /or replacement caused by defective materials and workmanship.
The execution and recordation of the Certificate of Acceptance is now required to finalize the
Town's acceptance of the project.
CONCLUSION:
Staff recommends that the Town Council authorize the Town Manager to execute a Certificate of
Acceptance and Notice of Completion accepting the work of Duran & Venables, Inc. and
authorize recording by the Clerk Administrator.
ENVIRONMENTAL ASSESSMENT:
This is a project as defined under CEQA but is Categorically Exempt (Section 153010). A Notice
of Exemption will not be filed.
FISCAL IMPACT:
This project was completed within the Council approved budget, as demonstrated in the fiscal
table below.
