SUBJECT: PPW JOB NO. 11 -12 — LIVE OAK MANOR PARK ADA UPGRADES

AUTHORIZE THE TOWN MANAGER TO EXECUTE A CERTIFICATE OF
ACCEPTANCE AND NOTICE OF COMPLETION ACCEPTING THE WORK
OF JOS, J. ALBANESE, INC. AND AUTHORIZE RECORDING BY THE
CLERK ADMINISTRATOR.
RECOMMENDATION:
Authorize the Town Manager to execute a Certificate of Acceptance and Notice of Completion
accepting the work of Jos. J. Albanese, Inc. and authorize recording by the Clerk Administrator.
BACKGROUND:
The Town's adopted FY 2011/12 - 2015/16 Capital Improvement Program (CIP) Budget
designates funds for park infrastructure and replacement projects, and is consistent with the
Town's goals to improve public safety and to improve the quality of Town parks and facilities.
This project was designed to improve Live Oak Manor Park by grading and paving a gravel
pathway with asphalt to comply with ADA requirements. New electrical conduits were to be
installed to accommodate a future project to replace the old and non - functional pathway lights.
In addition, the basketball court was to be reconstructed with new asphalt surface, new basketball
hoop and striping.
DISCUSSION:
On August 6, 2012, the Town Council awarded the contract to Jos. J. Albanese, Inc. to perform
the improvements to Live Oak Manor Park. The contracted work has been satisfactorily
completed by Jos. J. Albanese, Inc. and is being recommended for acceptance by the Parks and
Public Works Department,

DISCUSSION (cont'd):
Ten percent of the faithful performance bond will remain in effect for a period of two years to
guarantee any needed repair and /or replacement caused by defective materials and workmanship.
The execution and recordation of the Certificate of Acceptance is now required to finalize the
Town's acceptance of the project.
CONCLUSION:
Staff recommends that the Town Council authorize the Town Manager to execute a Certificate of
Acceptance and Notice of Completion accepting the work of Jos. J. Albanese Inc. and authorize
recording by the Clerk Administrator.
ENVIRONMENTAL ASSESSMENT:
This is a project as defined under CEQA but is Categorically Exempt (Section 15301c). A Notice
of Exemption will not be filed.
FISCAL IMPACT:
This project was completed within the Council approved budget, as demonstrated in the fiscal
table below.
