CONSTRUCTION PROJECT 411 - 831 -1201
AUTHORIZE THE TOWN MANAGER TO EXECUTE A CERTIFICATE OF
ACCEPTANCE AND NOTICE OF COMPLETION ACCEPTING THE WORK
OF CASEY CONSTRUCTION INC. AND AUTHORIZE RECORDING BY
THE CLERK ADMINISTRATOR.
RECOMMENDATION:
Authorize the Town Manager to execute a Certificate of Acceptance and Notice of Completion
accepting the work of Casey Construction Inc. and authorize recording by the Clerk
Administrator.
BACKGROUND:
As described in the June 18, 2012 staff report to the Town Council, it was discovered during
construction of the new ADA pathway to the Pageant Grounds that the embankment below
was failing in some locations. Had construction continued, it would have impacted the
pathway above the Pageant Grounds and the safety of the public using this facility. Further
assessment of the embankment confirmed the need for a retaining wall in order to secure and
stabilize the hillside.
At the regular Town Council meeting held June 18, 2012, the Town Council approved plans and
specifications for the Pageant Grounds Retaining Wall project and authorized staff to advertise
the project for bids.

DISCUSSION:
On July 18, 2012, two bids were received. Staff reviewed both bids and determined that Casey
Construction Inc. was the lowest responsible bidder and most responsive to the Town's formal
bid process. During the July Council recess, in an effort not to delay this project, the contract
was awarded to Casey Construction Inc. under the Town Manager's Authority, and subsequently
approved by the Town Council on August 6, 2012. The contracted work has been satisfactorily
completed by Casey Construction Inc. and is being recommended for acceptance by the Parks
and Public Works Department.
Ten percent of the faithful performance bond will remain in effect for a period of two years to
guarantee any needed repair and /or replacement caused by defective materials and workmanship.
The execution and recordation of the Certificate of Acceptance is now required to finalize the
Town's acceptance of the project.
CONCLUSION:
Staff recommends that the Town Council authorize the Town Manager to execute a Certificate of
Acceptance and Notice of Completion accepting the work of Casey Construction Inc. and
authorize recording by the Clerk Administrator.
ENVIRONMENTAL ASSESSMENT:
This is a project as defined under CEQA but is Categorically Exempt (Section 15301c). A Notice
of Exemption will not be filed.
FISCAL IMPACT:
This project was completed within the Council approved budget, as demonstrated by the fiscal
table below.
