AUTHORIZE THE TOWN MANAGER TO EXECUTE A CERTIFICATE OF
ACCEPTANCE AND NOTICE OF COMPLETION ACCEPTING THE WORK
OF BEARDEN CONSTRUCTION COMPANY, INC. DBA CB CONCRETE
CONSTRUCTION, INC. AND AUTHORIZE RECORDING BY THE CLERK
ADMINISTRATOR.
RECOMMENDATION:
Authorize the Town Manager to execute a Certificate of Acceptance and Notice of Completion
accepting the work of Bearden Construction Inc. DBA CB Concrete Construction Inc. and
authorize recording by the Clerk Administrator.
BACKGROUND:
The Town's adopted FY 2012/13- 2016/17 Capital Improvement Program (CIP) Budget
designates funding for improving the condition of Town parks and facilities and is consistent
with the Town's goals to improve the quality of public infrastructure in Los Gatos.
During the Master Plan approval process, the Town Council recommended that staff explore a
way to ensure that pedestrians can safely access the Creekside Sports Park from Lark Avenue,
Access would currently be made difficult due to the fact that the sidewalk on University Avenue
existed only on the west side of the street. As a result of Council's recommendation, this
sidewalk project was incorporated into the sports park's' design process.
The new sidewalk, constructed along the east side of University Avenue, is similar in design to
the existing sidewalk on the west side of University Avenue.

DISCUSSION:
At the regular Town Council meeting held June 18, 2012, the Town Council approved plans and
specifications for the University Avenue Sidewalk project and authorized staff to advertise the
project for bids at the Town Council meeting.
On July 18, 2012, two bids were received. Staff reviewed the bids and determined that Bearden
Construction Inc. DBA CB Concrete Construction Inc. was the lowest responsible bidder, and
was most responsive to the Town's formal bid process.
The work was completed in advance of the grand opening of the Los Gatos Creekside Sports
Park in October 2012. All contracted work has been satisfactorily completed by Bearden
Construction Inc. DBA. CB Concrete Construction Inc. and is being recommended for
acceptance by the Parks and Public Works Department.
Ten percent of the faithful performance bond will remain in effect for a period of two years to
guarantee any needed repair and /or replacement caused by defective materials and workmanship.
The execution and recordation of the Certificate of Acceptance is now required to finalize the
Town's acceptance of the project.
CONCLUSION:
Staff recommends that the Town Council authorize the Town Manager to execute a Certificate of
Acceptance and Notice of Completion accepting the work of Bearden Construction Inc. DBA CB
Concrete Construction Inc. and authorize recording by the Clerk Administrator.
ENVIRONMENTAL ASSESSMENT:
This is a project as defined under CEQA but is Categorically Exempt (Section 15301c). A Notice
of Exemption will not be fled.
