SUBJECT: PPW JOB NO. 11 -02 — HICKS ROAD AND PHILLIPS AVENUE STORM
DRAIN CULVERT IMPROVEMENTS 461 - 816 -0411
AUTHORIZE THE TOWN MANAGER TO EXECUTE A CERTIFICATE OF
ACCEPTANCE AND NOTICE OF COMPLETION ACCEPTING THE WORK
OF SAK CONSTRUCTION INC. AND AUTHORIZE RECORDING BY THE
CLERK ADMINISTRATOR.
RECOMMENDATION:
Authorize the Town Manager to execute a Certificate of Acceptance and Notice of Completion
accepting the work of SAK Construction Inc. and authorize recording by the Clerk
Administrator.
BACKGROUND:
The Town's adopted FY 2011/12- 2015/16 Capital Improvement Program (CIP) Budget
designates funding for infrastructure repair and replacement projects and is consistent with the
Town's goals to improve public safety and to improve the quality of Town streets.
Much of the existing public infrastructure in the hillsides of Los Gatos was not built to current
standards. Additionally,-the aging and deterioration of these facilities require repair and
replacement on a regular basis The-storm. drain system in the hillside area is generally
comprised of culverts that run underneath the roadways to transfer storm run -off to larger
drainage channels along the edges of the roadways. Almost all of the culverts are made of
corrugated metal pipes that rust over time, which require replacement.
DISCUSSION:
On June 18, 2012, the Town Council awarded the contract to SAK Construction Inc. to repair the
rusted corrugated metal storm drain culverts by installation of a smooth joint less pipe lining.

The contracted work has been satisfactorily completed by SAK Construction Inc. and is being
recommended for acceptance by the Parks and Public Works Department.
Ten percent of the faithful performance bond will remain in effect for a period of two years to
guarantee any needed repair and/or replacement caused by defective materials and workmanship.
The execution and recordation of the Certificate of Acceptance is now required to finalize the
Town's acceptance of the project.
CONCLUSION:
Staff recommends that the Town Council authorize the Town Manager to execute a Certificate of
Acceptance and Notice of Completion accepting the work of SAK Construction Inc. and
authorize recording by the Clerk Administrator.
ENVIRONMENTAL ASSESSMENT:
This is a project as defined under CEQA but is Categorically Exempt (Section 15301c). A Notice
of Exemption will not be filed.
FISCAL IMPACT:
This project was completed within the Council approved budget, as demonstrated by the fiscal
table below.
