We've been residents of Los Gatos since 2009 and have had the pleasure of enjoying
many of the town's dining choices, and all within walking distance for us, As frequent
customers of Cin Cin, we've grown to admire and enjoy the professionalism of Stephen
and Jimmy in the fantastic, culinary /mixology talent they showcase.
As a community, we'd be remiss not to give these two an opportunity to add to the
already great lineup of restaurants Los Gatos has to offer. We greatly enjoy the fact that
Los Gatos has become a destination spot for "foodies" and those seeking relaxed,
upscale entertainment in the form of artisanal libations. The trends have all been around
keeping it local and sourcing locally; this is yet another opportunity to keep it local and
allow a couple of budding entrepreneurs to do right by the downtown neighborhood they
know so well.
Together, we ask that you support Stephen and Jimmy in their Lexington House venture
and give them a chance to allow their dreams to prosper. Any town, anywhere would be
lucky to have these two wanting to invest their time and efforts in expanding the
community's options. Los Gatos lucked out and we hope to have another place to

community, we often frequent Los Gatos shops and restaurants. Living In Campbell, we have many
locations and venues to choose from, however, more often than not, we choose to go to Los Gatos and
frequent their establishments. We find the drive to be very easy, love that parking is available and truly
appreciate the quality of shops and restaurants that Los Gatos offers. We absolutely love the
atmosphere of downtown Los Gatos:
We became very excited when we heard of Stephen Shelton's Lexington House Project and jumped at
the chance to support him. We have come to know Stephen at his current place of work.
He not only makes a point to greet us every time, he goes out of his way to make us feel right at home
and endeavors to make our time with him enjoyable and a night to remember. We have been
impressed with his willingness to support the local schools, When we asked him to assist with a charity
event our school was putting on, he did not hesitate — he bent over backwards to be available and
volunteer his services — we have NEVER come across that level of service and dedication to the local
community anywhere. It truly took our breath awayl

downtown so nice is the shops and restaurants. Our shops and restaurant are so great because we've
been lucky to have some great folks running them.
I love Stephen Shelton and Jimmy Marino's Lexington House concept, these two guys are people that
represent the kind of people we should have running a business in town, We have the best of the best
here and the Lexington House would be in the same caliber.

We are writing in support of a proposed new establishment, Lexington House. I will
begin by "gushing" over Stephen Shelton! I was introduced to him through a very dear
friend, to whom I am so grateful. He is such a warm, charismatic, innovative, all over
fantastic guy! To say he is knowledgeable about food and cocktails is a drastic
understatement. He can literally take you on a history lesson of whatever your fancy. I
read his column in Inside LG and am consistently fascinated.
Our professional impression of him is stellar as well. He is extremely popular in town
and really has that "je ne sais quoi" with patrons. I believe his experience in San
Francisco gives him a "metro /hip" vision that is very exciting. Add to that his standards
for the freshest of fresh, sustainable produce, green business practices and we're sold!
We are parents at a private school downtown and we have partnered with the likes of
Palacio, Enoteca, Rootstock, etc. It would be an honor to collaborate with Lexington
House, and we hope we can realize that potential. He has donated his `services' many
times for school fundraisers and has offered his continued support in the future.
The location is perfect and will entice people to stay in town for their night out. We
wholeheartedly believe "Mom and Pops" should be promoted and supported in our fine
town.

I live here in Los Gatos and have for the past 8 years. My boyfriend and I
frequently patronize our local restaurants and wine bars. On a Thursday
night, two weeks ago, we were frying to pick a place to go for dinner and
after finding 3 of our favorite restaurants booked until 9:30pm; I
commented that Los Gatos really needs to step it up and add some more
dining options. I have my favorites (Cin Cin, James Randall, Nick's, La
Pastaria, Dio Deka, and Rootstock) and they are on rotation, but more
often we have found ourselves venturing to Saratoga or even heading to
Mountain View, Palo Alto or San Mateo because we are bored with the
same old choices and mediocre over - priced alternatives. I would much
rather stay local and support our local businesses and not risk driving.
Cin Cin ended up being our final destination that Thursday night and I was
thrilled to hear that Stephen and Jimmy, our two favorite
bartender /servers, are interested in opening a place of their own, right
here in town.
I feel like they really have their pulse on what is important to draw in
customers and to keep them coming back. And when those people
come back, our local shops get more exposure and opportunities to draw
in new customers of their own. I believe it is a win -win for everyone.
I have a hotel and restaurant background, I am extremely picky when it
comes to balancing good service, amazing food and an inviting
atmosphere and I have no doubt that these two gentlemen have what it
takes to be successful in what is sure to become #1 on my list of favorite
restaurants in Los Gatos.

I am writing this letter on behalf of Stephan Shelton and in support of his new
project "The Lexington House ". I am keenly aware and respect the need for controls
concerning how the downtown area is developed. Given this I am offering my
support for the project. I have known Stephan as both as a client of our
establishment Enoteca La Storia and a customer of Cin Cin where he currently
employed. He has been a consummate professional and a gracious patron in every
one of my experiences. He is remarkably well liked in town. I am of the opinion that
if Los Gatos builds a. critical mass of quality food and beverage businesses there is
potential to create state wide and even national attention to the community as a

I am a small distillery /winery owner in the Silicon Valley. I have been in the industry for over 15
years. I came across Stephen Shelton a couple years ago as he was tending bar at Cin Cin
Restaurant in Los Gatos. I have dined at Cin Cin before yet never have I received such attentive
service and attention to detail as I did that night. Little did I know this would spawn into a
successful business relationship. I explained to Stephen my role in my company and what we
are attempting accomplish. Since that night Stephen has donated his time for special events as
"Guest Bartender" fundraisers —most notably the March of Dimes event, and assisted in
distillery tour and cocktail classes at my establishment. I can honestly say with no hesitation
that Stephen Shelton has single—handedly created brand awareness and local support for my
products and the entire restaurant industry in the south bay. He has a strong voice within the
industry and is well respected.
Stephen's dream of The Lexington House is nothing but a reality to all his fans and followers.
Stephen has the business mind, self- discipline and entrepreneurship skills to create a successful

Dear Los Gatos Planning Commission and Town Council Members:
I write to express my absolute support for Stephen Shelton's and Jimmy Marino's new Lexington
House venture, and to voice my desire for Los Gatos to make more top -notch food and drink establishments
available, From the standpoint of a frequent patron of Los Gatos food and drink establishments, more quality
choices such as the Lexington House are needed. Currently, Los Gatos has about two good locations where
the food and wine /cocktail pairings are first -rate, sensibly priced, and there is some availability. Two or three
other options are also good, but they are either always booked or far too pricey to sustain patrons who would
like to find a venue they can frequent. There are multiple venues that are average, but these do not satisfy
the preponderance of sophisticated palates that are part and parcel of a typical Los Gatos area patron, I
would appreciate newer and better options, and the Lexington House would perfectly fill that need,
I have known Stephen for some time now and find him to be a consummate professional in his work.
Taking into account that I lived for several years in the D.C. area and frequented scores of top -notch
restaurants, I must nevertheless point out that I consider Stephen one of the top three of the most talented
bartenders that can please even the most sophisticated and difficult palate, I am always disappointed when
Stephen is not behind the bar because his are my favorite drinks and he never misses a beat. I also have
tremendous respect for Jimmy Marino, who is likewise an excellent mixologist and highly committed to and
serious about his work. When either Jimmy or Stephen is at work, I always feel like I am the most important
patron, Their ability to make a patron feel that way and deliver such quality in their craft is actually quite
remarkable. We need more establishments that can deliver such high quality at all levels. Jimmy and
Stephen have the talent, skill, and commitment to be able to do so,
Additionally, beyond the high quality that the Lexington House would deliver, what makes it even
more attractive to Los Gatos is the fact that both Stephen and Jimmy are already committed to supporting
and giving time and money to other Los Gatos institutions. As owners of a business, they could have an
even greater impact on Los Gatos institutions, continuing to donate and support as they already do at a
personal level. Giving the Lexington House the opportunity to become a business can only benefit Los
Gatos because the Lexington House will give back to the community.

Dear Planning Commission and Town Council Members;
I am writing you today to express my support for Stephen Shelton and Jimmy
Marino's proposed Lexington House in downtown Los Gatos, I feel downtown Los
Gatos is really missing the type of establishment they hope to open,
I've known Stephen for quite some time and his attention to the customer is second
to none, This type of service is sorely missing in this day and age and I'm sure the
Lexington House would be a very successful business for downtown.
I know one of the concerns of the council is replacing retail with restaurant space
and losing the pedestrian traffic downtown. I would argue that Los Gatos needs
more of what Lexington House would be and that it would help attract more
pedestrian traffic than reduce it. Far too many shops don't last more than a year or
two and the sit vacant for far too long, Los Gatos has lost tremendous foot traffic to
Santana Row and one of the biggest attractions of Santana Row are the restaurants,
In order for Los Gatos to draw people in, it will need more modern and swanky
places like the Lexington House promises to be.

I have been a frequent patron of Los Gatos food and beverage establishments since the early 80's,
when Randy and Steve held court at the old California Cafe, and Steamer's re- opened nearby with
some of the best mixologists in town.
We didn't go to either of these places for the food, although both served cutting -edge "California"
cuisine,
We didn't spend our week and /or weekend nights there because of the wine list.
Rather, we knew they would treat us with respect and warm camaraderie, along with the knowledge
of how to cultivate and maintain that special social ambience we thirsted for,
They were ultimate craftsmen in their trade, of course, but together with their understanding of
fundamental social mechanisms, they orchestrated and played the room like masters of ceremonies.
It wasn't until three years ago did I find those same qualities in Stephen Shelton and Jimmy Marino --
which is why I frequented their establishment once or twice every week, Their excruciating attention
to detail, in- depth knowledge of their craft, quality of service, and warm personalities raised the "bar"
to astronomical heights of desirability,
I firmly believe that their new concept, Lexington House, will carry with it every bit of that magic we
haven't had in town these many years.

and I feel strongly that this establishment will be great for Los Gatos, We feel that Los Gatos is in need for more
hip /cool places for young professionals to meet with friends, family, and colleagues. Cheri and I are both physicians
living in Los Gatos- I am on staff at El Camino Los Gatos and Cheri works at Kaiser Santa Clara. I only write to
express my opinion because I have very deep roots in the Los Gatos area, going back four generations, and I want
our town to always be the best town there is. I grew up in Saratoga- my father went to Los Gatos High, and I (for
obvious reasons!) have always loved this part of the world, My journey through life has brought me full circle- fi'om
Foothill Elementary, to Saratoga High, UC Davis, then medical school at UC Irvine, residency in New York City,
and then of course, when finished with all of my education and training, there was no question I would come home.
From New York City I brought my fiancee Cheri, whom I met in NYC during our residency training, She is from
Houston, but after she spent some time in this area it didn't take much convincing to get her to move here with me,
She fell in love with Los Gatos, so we chose to buy our home here, Now we find ourselves rarely leaving town for
anything. Pretty much all of our shopping and dining is done in Los Gatos, primarily down town.
The only thing that attracts us out of town is the need for a more lively and upscale bar /restaurant scene. Although I
really enjoyed the bar scene here in my 20s, now as a young professional I am more attracted to places that
emphasize atmosphere AND quality and are both bar and restaurant rolled into one. Social places where people can
meet up with friends, family, or coworkers for food or drink. We do love many spots here in town and we are
regulars at a few of them. Some newer places are popping up in town and are hitting pretty close to the mark, doing
a great job of capturing the "vibe" of our town. Cheri and I feel that these establishments draw the community
together downtown, where we also do our shopping,
We feel strongly that Stephen and Jimmy's place will help to breathe life into the social scene here in Los Gatos and
that they will help fill a needed niche for young professionals. They will help Los Gatos to continue to define cool,
as it always has!

My name is Susanna Schreiner and I have been a long time resident of Los Gatos. My husband
is an author and schoolteacher and my twin girls will be attending Fisher Middle School in the
fall. For years, my local friends and I have agreed that there is an important niche that has gone
unmet in the local restaurant community. While there are some good restaurants in town, none
of them fulfill all three sides of what my friends and I like to call the "Triangle of Success." The
three sides of the triangle are: (1) fair price, (2) locally grown, healthy, delicious food, and (3)
community involvement, I truly believe that Stephen Shelton's locally owned Lexington House
could be the first in Los Gatos to cover all three sides of the triangle.
Many residents are focused on pursuing a healthy lifestyle, even when they eat out. Yet, in the
midst of these tough economic times, high - priced local restaurants do not provide many
affordable options. Stephen's Certified Green Business will provide clean, organic ingredients at
a reasonable price. In addition, the central location and hip, New York -style sophistication will
bring a larger customer base to the existing businesses in the area.
Stephen's generosity and support for local causes, such as education, is well known. Lexington
House would be a fantastic platform from which to generate even more of a positive impact on
our Los Gatos community.
I strongly urge the Planning Commission and Town Council to move forward with this exciting
new endeavor and allow the establishment of Lexington House in our community.

CUP application U -12 -007 : Another restaurant.
This location is highly prized. Its visibility is perfect for retail. It would most likely
be rented by now if not being reserved for restaurant use. Conditional use permits
increase property values and rents. The building owners understand this as they
have numerous CUPS along Santa Cruz Ave. and Main Street. CUP uses are better
for the bottom line, and more stable. They are also part of a bigger problem in
keeping small retail tenants due to high rent. Commercial property values have
risen dramatically in part due to so many high paying CUP tenants with a clear
nexus to high rents and vacancies. We as a town created this gold mine for property
owners in our delusional fantasy of having a "vibrant" downtown. Vibrancy is not
how many people we can attract through CUP permits. We lost Domus, at this
location because of this false "vibrancy ", the code word for creating high rents,
property values and tax revenues... Domus was in essence forced out due to
standard business practice of increasing rents to justify a high purchase price. This
was partially due to town policy allowing so many CUP applications. A well
executed, and disastrous policy that took an already vibrant street and turn it to a
problematic cash cow. Allowing another CUP will only compound the problem.
Approval of this application would create an attractive nuisance at one of the best
retail locations in town hindering circulation and parking even further. There are
95 businesses between Main and Bean. 15 of these have restaurant permits. 11 are
Nationals or chain stores, 35 are office spaces, mostly upstairs. 22 require a CUP.
There are 30 non -CUP retailers. On top of this incredible intensification there is a
movie house and 3 businesses offering classes. A low -key retail store is more
appropriate. Adding a 23rd CUP (another restaurant) to the block is unconscionable.
The most powerful tool. we have, (land use laws), are being ignored. We have the
ordinances in place. We just don't apply them adequately. The case by case decision
making policy that town council so proudly proclaims has allowed for biased
decisions in favor of landowners, realtors, cronies and the moneyed elites.
Common sense, like our general plan says the CBD should be primarily retail but in
the past 10 years 2 town managers have allowed the subversion of our regulations.
As in the past I hope you attempt to correct this no matter the dichotomy of the
voting block on council. You will be doing the right thing.
I do not mean to lecture you on small town politics and un- intended consequences.
Nor do I wish to cause a financial burden on a neighboring property owner whose
family are both venerable and community oriented. They have been led to believe
thru the vibrancy doctrine that they only need ask and they shall receive by a
council led astray by it's staff. This building owner, and the community have more
to gain thru denial of this application and support for existing small retailers.

My name is Shelli Baker and I went to kindergarten in this very unique
town called Los Gatos. As a child, our family frequented the drive -up A &W
on Los Gatos Boulevard, The Burger Pit on Hwy. 9 as well as The Grog &
Sirloin previously located where Double D's now exists. Sure, those were
the `good ole days' but quite honestly, my dining expectations have changed
drastically,
For personal and professional purposes, I desire an intimate in town dining
experience that consists of a welcoming and upbeat ambiance coupled with
healthy eclectic foods and beverages. Okay, so where do I dine then? Good
question. Although I frequently dine out for pleasure and business, there
currently is not a local restaurant that checks even most of my boxes. Some
of our restaurants have tasty food and drinks (although not green by any
means) but there's no rapport with the owners and staff. Then there are
other restaurants where rapport exists but the food and drinks leave much to
be desired. A void exists in this town, and I believe Stephen Shelton's
dining concept will provide the specialized dining experience that so many
of us want.
With Stephen's high energy, positive outlook, bright mind, compassionate
soul and culinary expertise, The Lexington House would simply rock this
town, What better place is there for cornrnunity members and others to
connect and dine while supporting a local small business that is so
committed to the community and to green business practices?

Dear Mr. Larson:
Being well aware of having used the phrase first popularized in the United States by Mark Twain "lies, damned
lies, and statistics" to describe the persuasive power of statistical analysis to bolster an otherwise weak
argument, I am, nevertheless, putting forth the following statistical argument against approval of Conditional
Use Application No. U -12 -007.
Based upon information, there are currently 95 commercial tenants (excluding the theater) located within the
Central Business District on Santa Cruz Ave., between Main St. and Bean Ave., 27 of whom occupy upstairs or
rear office space, leaving 68 tenants who occupy space at street - level.
All 27 tenants who occupy either upstairs or rear office space maintain regular daytime business hours during
the workweek, so that the owners and employees of these businesses take up the limited existing area parking
for a fixed 8 hours each day, on average, which would otherwise be available to business patrons and
Iestination visitors.
Of the 68 tenants who occupy street -level space, 15 are engaged in some form of food - service (or roughly 22%
of street -level tenants), and while this number does not signify a dominance of food - service business located
within a very small area of the Central Business District, it is, nevertheless, a significant number for the
following reason.
A key traffic impact difference between a food- service tenant and some other type of commercial tenant (e.g., a
clothing retailer) is that patrons of a food - service business all tend to head towards the Central Business District
at about the same period of time (i.e., around mealtimes).
The lunch -hour traffic impact is of greatest concern, given that the owners and employees of the 27 businesses
aforementioned will eliminate, though their own parking needs, a significant number of parking spaces
otherwise available to visitors heading towards the Central Business District, for a fixed 8 hours each day.
Simply put, there just isn't sufficient parking space available in the Central Business District to support the
requirements of yet another food - service business.

the Town Council in 1978. We cleaned things up and encouraged resident- serving businesses. However, the
council majorities that were elected in the 90s began to reverse things and since then have really done a

frequent visitors to "all things Los Gatos." You'll find us at city hall meetings, cheering the high school

through crisis, recreating, shopping and dining within our city limits.
Variety, it is said, is the spice of life. As a mother, I can think of so many business opportunities for our
downtown but another restaurant is not one of them. Los Gatos has a delightful variety of restaurants, with and
without a liquor license. With such limited space on Santa Cruz Ave., it would be nice to see more retail
businesses take the place of those that have languished in the past two years instead of adding another

Unfortunately, due to a sister flying in Wednesday evening, I cannot be there to speak on this subject, but do want
to express my opinion that a restaurant should not be allowed to take over retail space.
The following problems seem to be happening again .............
(1) Too many restaurants pushing out the retail;
(2) It will be another restaurant serving alcohol. We need to avoid heading back to the days when we had a
"whiskey gulch" reputation.
(3) It would be inconsistent with Policy LU 9.3 which is looking for a mix of businesses. This project will be
converting retail to a restaurant. The town already seems to have an adequate supply of restaurants and
bars with unique menu selection. More does not necessarily equate to better.
(4) It does not comply with Ordinance 2021......... another exception and another CUP ?? Don't we already have
problems with Hillbrook School and other projects (don't forget the Toll House issue) trying to circumvent
the town ordinances and zoning? The town does not have a good track record when it comes to enforcing
CUP's. Adding more will continue to overburden a system that cannot enforce the current CUP's.
(5) It is unlikely there would be an issue with the restaurant moving into an existing space, but this is an issue
with them taking over a former very successful retail space.
(6) Let's quit bending the rules and stick with the plans, ordinances and policies in place.

again. The thrust of commerce in this town is aimed at tourists. Why must locals drive to San Jose or Campbell to shop?

Why don't the town officials lend support to those kinds of businesses instead of businesses that draw in out of town people for a
night on the town?
No wonder we have so much graffiti to clean up with drunken outsiders prowling Victory Lane at 2am.

feel that we already have a wide assortment of existing restaurants in the downtown area. Living on

existing restaurants which also contributes to parking issues.

MOST RESTAURANTS ARE OFF AT LEAST 30% AS QUOTED
BY STEAMERS RESTAURANT OWNERS. THE PIE DOES NOT
GET ANY BIGGER BUT THE SLICES GET THINNER. PARKING
GETS THINNER BUT CIRCULATION: GETS BIGGER. WALK IN
TRAFFIC FOR RETAIL GETS THINNER BUT THE RENTS GET
BIGGER. MOST SMALLRETAIL IS AS-WELL OFF BY 30 %.
WE HAVE TURNED THE C.B.D INTO AN ENTERTAINMENT
DISTRICT WITHOUT REGARD TO SUBSTAINABILITY OR
CONCERN, FOR EXISTING ESTABLISHMENTS. WE ARE NOW
IN AN UNCOMFORTABLE POSSITION OF HAVING TO
PROTECT RESTAURANTS AND EVEN NATIONAL CHAIN
STORES IF WE WANT THEM TO STAY AND NOT MIGRATE
TO THE N.40 BY EASING. CIRCULATION AND PARKING.
ALAS THIS WILL NOT BE DONE.
KEEP IN MIND THAT ON THIS BLOCK ALONE THIS WOULD
MAKE 16 FOOD SERVING OPERATIONS, ORABOUT 22% OF
EXISTING STREET FRONT RETAIL. WE ONLY ALLOW 20 %,
FOR NATIONAL CHAIN STORES. OF ALL BUSINESS'S ON
THE BLOCK THERE ARE 30% OFFICE USES, 30% MOM AND
POP RETAIL, 30 %.C.UP HOLDERS (NATIONALS AND
RESTAURANTS AND OFFICE) AND 10% SUCH "AS MOVIE
HOUSE, CLASSES, ETC. THESE FIGURES IN TOTAL
REPRESENT INCREDIBLE INTENSIFICATION.
RESTAURANTS, NATIONALS AND OFFICE SPACE OCCUPY
60 %. BY ALLOWING THIS TO HAPPEN YOU HAVE
INCREASED ENCREASED RENTS AND PROPERTY VALUES,
AS C.U.P TENANTS PAY MORE. YOU HAVE LEFT IT
DIFFICULT FOR=NON- C.U.P. PROPERTY OWNERS TO FIND
LONG TERM, SMALL PROFITABLE TENANTS.
