2003-077- Establishing The Fiscal Year 2003-2004 Voluntary Furlough Program And Authorizing Town Manager To Execute Side- Letters Of Agreement With The Town's Bargaining Units On Behalf Of The Town Of Los GatosRESOLUTION 2003 - 77 RESOLUTION ESTABLISHING THE FISCAL YEAR 2003 -2004 VOLUNTARY FURLOUGH PROGRAM AND AUTHORIZING TOWN MANAGER TO EXECUTE SIDE- LETTERS OF AGREEMENT WITH THE TOWN'S BARGAINING UNITS ON BEHALF OF THE TOWN OF LOS GATOS RESOLVED, by the Town Council of the Town of Los Gatos, County of Santa Clara, State of California, that the Fiscal Year 2003 -2004 Voluntary Furlough Program shall be established as set forth in the attached EXHIBIT A. BE IT FURTHER RESOLVED, that the Town Manager is authorized to execute side - letters of agreement with the Town's bargaining units regarding the Voluntary Furlough Program, consistent with the parameters set forth in the attached EXHIBIT A. NAYS: None ABSENT: None ABSTAIN: None SIGNED:�`°�� MAYO OF THETOWN OF LOS GATOS LOS GATOS, ALIFORNIA ATTEST: CLERK OF THE TOWN OF LOS &TOS LOS GATOS, CALIFORNIA Exhibit A Town of Los Gatos Fiscal Year 2003 -2004 Voluntary Furlough Program Effective: June 22, 2003 through June 19, 2004 Purpose: To provide eligible employees the ability to take up to 80 hours of leave - without -pay each fiscal year and thereby contribute toward the organizational efforts to reduce operating expenditures. Program Conditions The Request: Participants must submit a request to their Department Director to take between 1 -80 hours of leave- without -pay during the fiscal year. The decision to permit an employee to participate in the leave without pay program rests exclusively with the Department Director and the Town Manager. The leave must be taken between June 22, 2003 and June 19, 2004. Benefits: Health benefits for employees will be fully maintained during the pre - authorized leaves under the Program. The benefits that will be maintained include: medical, dental and life insurance; supplemental benefit cash allocation; and employee assistance program (EAP). Participating employees will not accrue vacation, sick leave and retirement benefits during their leave. Spreading Impact: Participants will have the option of spreading the reduced income associated with the leave- without -pay over twenty -six pay periods, or of having the leave- without -pay effective in the pay period in which it is taken. Any reconciliation of income will be made when the leave - without -pay is taken. Final reconciliation may be necessary based on any mid -year salary adjustments. Termination: If employment with the Town is terminated prior to June 19, 2004, any income due the employee or the Town associated with this program shall be reconciled in the employee's last paycheck. In the event the amount owed the Town exceeds the amount of the employee's last paycheck, a payment schedule shall be established.
