RESOLUTION OF THE TOWN COUNCIL
OF THE TOWN OF LOS GATOS
ACCEPTING WORK OF
MCCARTHY LAND COMPANY, LLC.
AND AUTHORIZING THE TOWN MANAGER TO EXECUTE
CERTIFICATE OF ACCEPTANCE AND
NOTICE OF COMPLETION
FOR RECORDING BY THE CLERK ADMINISTRATOR
WHEREAS:
The Town Council approved the final map for Tract No. 9368 - 17975 Foster
Road on the 6th day of January, 2003 as Resolution 2003 -003.
2. McCarthy Land Company, LLC has satisfactorily completed the public
improvements consisting of construction and installation of curbs, gutters, sidewalks, paving,
catch basins, pipes, culverts, storm drains, sanitary sewers, street lighting, street trees, street
signs, a water system and fire hydrants, as required by the final map, and the development is now
ready for final approval and acceptance by the Town.
RESOLVED:
A. The work on Tract No. 9368 by McCarthy Land Company, LLC is hereby
accepted as complete.
B. The Town Manager is authorized and directed to execute the Certificate of
Acceptance and Notice of Completion attached as Exhibit A hereto.
C. The Clerk Administrator is directed to transmit this Certificate of Acceptance and
Notice of Completion to the Recorder of Santa Clara County for recording.
PASSED AND ADOPTED at a regular meeting of the Town Council of the Town of
Los Gatos, California, held on the 20" day of December, 2004 by the following vote.

We do hereby certify that McCarthy Land Company, LLC completed the work in November
2004. The work generally consists of construction and installation of curbs, gutters, sidewalks,
paving, catch basins, pipes, culverts, storm drains, sanitary sewers, street lighting, street trees,
street signs, a water system and fire hydrants.
The work was completed in November 2004, and is commonly known as Tract No. 9368 -
17975 Foster Road.
The Surety on the bond accompanying the contract /agreement is American Motorists Insurance
Company.
