There were no further questions or discussion regarding the minutes and a vote was taken by the Parks Commission. VOTE: Motion carried unanimously.. IV. COMMUNICATIONS (Three minute time limit per speaker for subjects not agendized.) A. Verbal Commissioner Gordon announced to the Parks Commission that there will be a free training w �cs op regarding Communication for Pedestrian and Bicycle Safety Rsk, Response and Change on July 18, 2012 sponsored by the California Department of Public Health, California Office of Traffic Safety, Traffic, Safe,- oiImunities Network (TSCN), and the Santa Clara County Public - Health. Department. Commissioner Gordon also announced that she will be distributing the latest draft version of the Town of Uos h Gatos Bike and Trail Map and requested that this topic be adde ' to the agenda in October. Commssioner Gordon stated that staff a> id members of the Bicycle <�AdvisoryM' are planning to attend the meeting. Commissioner Gordon `stated that she will further discuss these two topics during: her r�eportfor file Bicycle Advisory Committee. Commissioner Deloumi °ased whose jurisdiction it would be` to have the key bike lanes: zthin the town painted bright green for safety purposes. Director Caprso'stated that it is not within the Parks Commission's jurisdiction and it wo ld need to be addressed with the Transportation and Parking Commission. Commissioner Scott asked the Parks Commission if there would be any interest to do an inventory of the facilities available to the community through the parks system for the Town of Los Gatos. Commissioner Scott proposed that a sub - committee or study group be formed to facilitate this project and requested that this topic be agendized at the Parks Commission meeting in October. Commissioner Corenson stated that a similar database of parks was created, but expressed his interest in participating in this project. Director Capurso informed the Parks Commission that a parks inventory was done back in 2009 and is currently being used for development of Master Plans of the parks in the Town of Los Gatos. Director Capurso stated that a copy of this inventory will be sent to the parks commissioners before the next meeting in August. Chair Rennie asked the parks commissioners if they had any objections to adding this topic to the October agenda. There were no objections. Commissioner Corenson requested that a follow -up from staff be provided at the next meeting regarding the trails at the Highlands of Los Gatos and Google View Map as Items foi-Information Chair Rennie asked the Parks X , ` ommi. , verbal communications. Student Commissioner Pater stated that he is currently a junior at Los Gatos High School, plays lacrosse and that Bachman is his favorite park. Co 'ssioner Rennie asked if anyone participated in the challenge that he o osed at the last Parks Commission meeting. Commissioner Scott stated that -he visited La Rinconada Park and Worcester Park. Director Capurso provided the history and an update of the most recent proposal for the dogs off -leash pilot program to the Parks Commission. Director Capurso also indicated that information consisting of the following was also reviewed and provided to the Parks Commission. 1. Dogs Off -Leash Pilot Program Evaluation and Staff Recommendations (including exhibits of the two proposed off - leash dog areas — Bachman Park and Live Oak Manor Park). 2. Parks and Public Works Memorandum/Desk Item. 3. Notes from the three Community Meetings held on April 25, 2012, May 9, 2012 and May 23, 2012 at Van Meter Elementary School. Director Capurso stated that the goal of staff is to bring forward a decision to the Town Council, whether the Parks Commission approves the dogs off -leash pilot program or not. Director Capurso also reaffirmed that Town Council has the final approval. Chair Rennie opened up the floor to theParks Commissioners to ask staff questions regarding this item. Commissioner Holden Commissioner Holden made reference t� page 3 of the staff recommendation. Commissioner Holden stated hat the report indicates that "Parks staff will monitor the off -leash hours, d ill begin enforcing the leash law outside of these hours and at all parks "�. Director Capurso stated that it will be part of the evaluation process that will be presented to not only to the Parks Commiss�oxi, but the Town Council as well. Director Capurso stated information will be disseminated as regular updates to the Parks Commissioner Gordon Commissioner Gordon asked that of the 52 in attendance at the Community Meeting, which of the two parks had the most representation. Director Capurso stated that staff did not poll for that information. Director Capurso stated that there was a fair amount of representation of both sides of the issues for all parks, not just Bachman Park and Live Oak Manor Park. Commissioner Lambert Commissioner Lambert asked Director Capurso that given the level and intensity of issues against this program, how does staff feel that is was reasonable to recommend a pilot program move forward. Director Capurso responded that based on the hours proposed, park utilization is low and there is very little activity at those times, particularly on weekdays and at Bachman Park. Commissioner Lambert asked based on Director Capurso's response if he doesn't think that this will encourage more off -leash dogs outside of the proposed hours. Commission 'Lambert stated that he disagrees that there isn't much activity. Co nm lion Lambert asked Director Capurso if he thought that it would ; exacerbate the problem that currently exists. Director Capurso stated that the duration of the pilot program is six months. Commissioner Lambert asked Director Capurso what is the objective of the pilot program. Director Capurso stated the pilot program's objective is to find out if off -leash hours can become permanent. Director Capurso also stated that the direction to evaluate a dog off -leash pilot program came from the Town Council. Director Capurso reaffirmed that the final decision will be made by Town Council on whether or not to implement the pilot program or if it becomes permanent. Commissioner Lambert stated he wanted to know from staff if they identified what the next phase would be if the pilot program is successful. Parks and Facilities Superintendent Wolter further stated that if the morning hours are successful and six months later it's deemed that those morning hours should continue on permanent basis, implementing another pilot program would be the next logical step. Commissioner Lambert asked if staff has identified what is success and what is failure for the pilot program. Director Capurso stated that the program will have to be evaluated M""If, fi entirety to prove failure or success. Commissioner Scott Commissioner Scott wanted to know if a fence was never part of the process and was it by specific direction of the Town Council. Director Capurso stated yes. Commissioner Scott asked if a temporary fence was discussed or investigated. Director Capurso stated it was not explicitly investigated. Parks and Facilities Superintendent Wolter continued to state that the City of San Carlos even asked volunteers groups to do it and it wasn't getting done. Director Capurso stated that temporary fences generally go up seasonally and not daily. Commissioner Scott stated that he's not sure that he agrees with that. Commissioner Scott asked staff what is the legal impact for implementing the pilot program Director Capurso stated that it's a relaxation of the Town Code andpul"d be captured in Town Council minutes. Director Capurso stated that there is a Town Code and the leash law is a municipal ordinli e�" " every city in the Santa Clara County has one. Director Cap; so stated that even the unincorporated areas have one. Director Capurso stated it's enforced at the town or city level, but not at a higher level Commissioner Scott asked - for confirmation of theregulation issue. Director Caput" stated the regulation is "on leash and ". Commissioner Scott asked if a permit -, system with a different colored tag for Los Gatos rep dents was feasible and if there was any further movement on this consideration Director Capurso stated that it could be and "there are several differenways of implementing a permit system. Director Capurso stayedt t dlscusso� was heard that if you really wanted to it the utita ion of an off -leash area in a park, then the burden,could essentially beput back on the dog owners to form something in equivalent to :a aneighborhood association, i.e. the organization then becomes a legal entity and would apply for a special use permit, much like a soccer league would. Director Capurso stated that by applying for a special use permit, the organization would then have to self - manage and keep non - members out. Director Capurso stated that this consideration is not something that needs to be moved on immediately. Director Capurso stated that, if anything, the first step would be to work with San Jose Animal Control to ensure that a) dogs are all licensed that would be in these areas and 2) the Los Gatos licenses could be made a different color or some other unique characteristic in order to identify that the licensee is a resident of Los Gatos. Director Capurso stated that licenses take a year or two to turn over and would not be feasible to implement on a couple month basis, but that is one of the solutions that the Town is continuing to look at. Commissioner Scott reiterated that he would be in favor of a permit system and thinks it would assist the Parks Service Officer with identifying dogs that are not from the area, if it becomes a problem. There were none. Chair Rennie moved on to the public portion of the Parks Commission meeting and stated that the floor will be opened up for questions and discussion after hearing from those in the audience. The following speakers addressed the Parks Commission in regards to dogs off - leash: LuAnn Flechsig Speaker Flechsig stated that she is a dog owner and rescuer. Speaker Flechsig stated that she really`admires the group that is pushing so hard to have off -leash hours Speaker Flechsig stated that there are a lot more dogs in Los Gatos that= could benefit from a fennced in dog park. Speaker Flechsig stated that her -- dog cannot go off -leash and she stated that she guaranteed that probably 90% =of the- . s in Los Gatos will not go off - leash. Speaker Flechsig continued;t"ate that having a'fence in a dog park would serve everybody because their dogs can still run around and now my dog can go to the park Speaker Flechsig stated that having a fenced in area keeps the children safe. "Speaker Flechsig stated that if you go -ta the parks and you can ask; a lot of _those little kids are afraid of getmg knocked down.. Speaker" Flechsig stated that maybe it's not this Vparticular group, but somebody is knocking these kids down. Speaker Fl chsig stated that the group that comes; she knows that they're really consci' ntlous they pick up the excrement and other dog's excrement, but still fyau�o to these meeting, you hear from the people that live right there tha'it's dirty, aric� there's still excrement there. Speaker Flechsig stated thatei wing a fenced -r area, there's ways to do it and it she thinks it , fi can benanced ,Speaker Flechsig stated that if there really are 9,000 dogs in the Town, she's willing, just like the library, to pay a $100 or $200 to try to get some feces up at the dog parks. Speaker Flechsig stated that she knows the Town doesn't have a lot of room, but maybe Live Oak Manor would be for the big dogs; you'd have a fence and it doesn't have to be as big an area as what they proposed for an off -leash one. Speaker Flechsig stated that maybe Bachman Park would be for the small dogs, because small dogs and big dogs don't always mix. Speaker Flechsig stated that she could get community support to do that and then these groups, they can have kind of like adopt -a -park; one week they can clean up excrement. Speaker Flechsig stated that if you want to take it another step further they have dog excrement DNA; people can join a one -time $30 fee and send in the DNA excrement for analysis and find out who is responsible, fine them and that would take care of the mess and help the people who live there. Speaker Flechsig stated that there is a much greater population of people who would like to have all their dogs play somewhere with no restricted hours for the people. Speaker Flechsig stated that she doesn't think that children and people and other's people's dogs should be exposed to that. Speaker Flechsig stated that putting up a fence area would solve the problem and it would benefits more people, a bigger group. Commissioner Corenson asked what park that Speaker Flechsig brings her dog to. Speaker Flechsig stated that she doesn't bring her dog to the park, but if she did, it would be Bachman Park. Speaker Flechsig stated that she's been to Bachman Park and she`krows that it's a popular park for kids. Speaker Flechsig stated that A `yvo I'd be a good dog park for small dogs that don't need a big fenced area Chair Rennie asked if there' any additional questions for Speaker Flechsig. There were none. Speaker Tim Takeuchi Speaker Takeuchi stated that.he is a new resident totho Town of Los Gatos. Speaker Takeuchi stated that he picked up other people's dog excrement lastie kend Speaker Takeuchi stated that being new residents, he doesn't knd y where all the parks are, but do know where Belgatos Park is. Spea er Takchi stated that he is aware that Belgatos was taken off the liso consideration due to infrequent use of the park in general : Speaker TA know what it would take for } Belgatos Park to be baMon the list. Speaker Takeuchi stated that he thinks there" is lot of oppo pity given that it is a protected park because it's fenced in on both sides of entrances and there really isn't a house that ripens up onto it, so 4herA even more separation there. Speaker Takeuchi stated that there is a lawn area that is completely separate from %M the picnic areas and children's areas. Speaker Takeuchi continued to state that it is low impact and there are not a lot of people there, but thinks that wolr&" be a benefit. Speaker Takeuchi stated that as the pilot programs are started, the Town could implement something thing would be t11 to that upper lot and have the opportunity to really test it out. aker Takeuchi stated that if it's popular, it would be evident through increased traffic. Chair Rennie stated that Speaker Takeuchi's request for Belgatos Park to be possibly reinstated as a consideration for the off -leash pilot program will be noted. Director Capurso stated to Speaker Takeuchi that he is right that the Town didn't see the same level of utilization as the other parks. Director Capurso stated that doesn't necessarily eliminate Belgatos Park, but that would be factor that would need to be considered before implementing something there, even on a pilot basis. Chair Rennie asked if there any additional questions for Speaker Takeuchi. There were none. Speaker Terry McBriarty Speaker McBriarty stated that she lives Within walking distance of Live Oak Manor Park, but has spent years atBachman Park when her children where younger (toddler age) and has experience with the people running their dogs off - leash there. r N It Speaker McBriarty stated that she would liketo, be able to use Live Oak Manor Park in the afternoon hours with her dog and her children. Speaker McBriarty stated that she never had any-problems at Bachman with her toddlers running around in the play area *,, the dogs are in off -leash area Ong their own thing: Speaker Mc Br ty stated that never once did � s f the dogs venture over into the area where the children are; novy sandbox that's closer to the dog area. Speaker McBriarty stated . t1i�ey ould be there at least one day a week for two or three years and none of them�ever had a problem. Speaker McBriarty stated that sX� ould tell her children that dogs would be over thre and then she would take them to play elsewhere, because the are shanr�gagark with other members of the community. Speaker McBriarty tated that stie has children and those people have dogs and we're snaring the space. Speaker McBjr a stated that the people that are showing up to the community meetings and are like, "I need to be able to go the park 24 hours a day and should expect no dogs to ever be there off leash because I'm afraid of dogs and I don't like them. Speaker McBriarty stated she finds that absurd. Speaker McBriarty stated that the people at the community meetings who have never even been to these parks and are like, "how big is this park, where is it; well, I don't want any dogs to be ever off leash there." Speaker McBriarty stated this whole thing that these people who don't go to parks, want to be setting up rules who do go to these parks on a daily basis and are there every single day picking up other people's dog excrement. Speaker McBriarty stated that yes there are irresponsible dog owners, but having off -leash dog hours, having rules or not rules is going to change whether some people are irresponsible and some people aren't. Speaker McBriarty stated that the people who are responsible dog owners deserve this pilot program and the people at Bachman Park deserve to have some afternoon hours. Chair Rennie asked Speaker McBriarty when she said she was at Bachman Park and the dogs were not going to the play area, was she coming at the time when the organization group was there. Speaker McBriarty stated yes. Speaker McBriarty stated that she and her family would be there at 3:30 p.m. and the off -leash people would start showing up at 4:30 p.m. to 5:00 p.m. Speaker McBriarty stated the dogs would run up and down the hill and other areas, but never once did she see a single dog on the tan bark area, the owner's would come with them and never saw a single child bothered, knocked over or barked at or anything. Speaker McBriarty stated that she's heard stories of mother's saying their children were knocked over or scared. Speaker McBriarty stated that she has children who J#c q dogs and have been scared by of a dog before, but that's not a reason to end a program because your child is scared by a dog once ,Spi aker McBriarty stated that a lady came and had some horrible story a child at Live Oak Manor Park who was attacked by a doberman on a scoc come none of us read about Gatos by a doberman pincer, wY McBriarty stated that it meant a do if Boyd stated how Yet; a little girl was attacked in Los wasn't it in the paper. Speaker B es ot Mated that =she is a professional dog trainer that trained for Campbell's Parks, and Recreation Department, but no longer trains professionally. ,Speaker Boyd stated that it is a tough situation because there is no compromise Speaker Boyd spoke of the other pilot programs — Santa Cruz has an approved program and has about seven off -leash parks and beaches that people can take their animals to, but because Santa Cruz has become so free about dogs off - leash, they are pretty much running the town; there are dogs off -leash everywhere and they cannot be stopped. Speaker Boyd stated that a couple of weeks ago there was a quadriplegic whose service dog was attacked on the wharf in Santa Cruz by a dog who was laying on the sidewalk while the owner was in restaurant. Speaker Boyd stated that the quadriplegic took her dog rolling around in the street and could've been drawn into the street. Speaker Boyd stated that the police won't do anything and animal control won't do anything because the individual wasn't bitten. Speaker Boyd stated that there is a temporary fence there and is made of pvc and netting, but believes it is for the athletic field. Speaker Boyd stated that there are two parks that are approximately nine acres and they are athletic fields and not parks; there are no play structures close to where dogs are allowed off leash. Speaker Boyd stated that worked beautifully because she saw the dogs and no concerns about that. Speaker Boyd stated the pilot program in San Carlos ends June 1 or June 15 Speaker Boyd also mentioned that she teaches bike prevention to children. Speaker Boyd stated thataccording to the American Veterinarian Medical, the three trigge s"that will cause a dog to bite a child are 1) a dog that is left unattended`with -a child, 2) children running in the park, and 3) a human running wth'ad`ogin Speaker Boyd stated these are the tree triggers for ari animal to be provoked to do something that they normally wouldn°'t do. Speaker Boyd stated that she'd like to share something anecdotal because she normally doesn't do this and don't like to talk abouther own dog or personal situation Speaker Boyd sa1d that,, in 2010' when she was teaching a class in a Campbell park whe e t�ie.dogs were on a leash, she was setting up cones and there was a fader and a san with a Boxer off - leash. Commissioner Deloumi continued to state that some of what is going on is that we have some responsible dog owners, some not responsible dog owners and those in between where people potentially would love to know what the rules are for the Town, but we don't have any. Parks Volunteerism June 5, 2012 Attachment 1 a. Parks and Facilities Superintendent Wolter reported on the following regarding Parks Volunteerism: • Continuing with the pilot program for Adopt -a -Park program. • Live Oak Manor Park was the first park adopted; the group has done two weekends worth of work - cleaning and planting on Carlton area and miscellaneous plantings. • The volunteers continue to maintain it and also pick up litter and dog waste. • Maintaining it and also doing litter pick -up and dog waste • The group is planning" a larger event at the end of summer in conjunction with a,.neighborhood block party. • Staff will continue to monitor its progress. • The group has rats d almost $lk for improvements in the park ca and waiting fob the Town to complete the irrigation process. • Staff will talk about expansion of the program at the next parks commission. k VII.
