ROLL CALL Present: Mayor Steve Rice, Vice Mayor Barbara Spector, Council Member Steven Leonardis, Council Member Diane McNutt, and Council Member Joe Pirzynski. Absent: None PLEDGE OF ALLEGIANCE Katie McEnroe, Van Meter Elementary School, led the Pledge of Allegiance. The audience was invited to participate. PRESENTATIONS Mayor Steve Rice presented the following: Proclamation for National Public Works Week to Todd Capurso, Director of Parks and Public Works Distinguished Budget Presentation Award Fiscal Year 2011/2012 to Steve Conway, Finance Director Page 1 CLOSED SESSION REPORT Judith Propp, Town Attorney - Commented that Council met in closed session and took no reportable action. COUNCIL /TOWN MANAGER REPORTS Council Matters - Commented that Los Gatos now has four electric vehicle charging stations. - Commented that there was a beautification at the southwest corner or Highway 9 and Santa Cruz, due to the hard work of many people, especially Barbara Holden and property owners, Larry and Steve Rugani. - Commented that the next Meet the Mayor event will occur on the fourth Saturday in June. Manager Matters Greg Larson, Town Manager - Congratulated the Town Budget Team for another outstanding budget. - Recognized a Town Manager from Austria in the audience. - Commented on three successful recent events: • Teen Dating Violence Resources Event • The Friends of the Library hosted author Eric Larson • The Town and the Chamber of Commerce hosted the Wine Walk Did You Know ?? Todd Capurso, Director of Parks and Public Works - Described the street maintenance work of the Parks and Public Works Department - Invited the public to an Open House on Wednesday, May 23, 2012 from 9 a.m. to noon at 41 Miles Avenue, Los Gatos. CONSENT ITEMS (TO BE ACTED UPON BY A SINGLE MOTION) 1. Approve Council Minutes of May 7, 2012 2. Accept Third Quarter Investment Report for FY 2011/12 (January through March 2012) 3. Donation of a Flag Pole at Oak Meadow Park from the Los Gatos Kiwanis Club 4. Adopt resolution making determinations and approving the reorganization of territory designated La Rinconada No. 5, approximately .73 acre parcel prezoned R -1:12. APN 409 -32 -001. Annexation Application AN12 -001. Property Location: 14795 La Rinconada. Property Owner /Applicant: Sargiz Isaac Page 2 Consent Items - continued 5. Police Department Partnership with Next Door Solutions to Domestic Violence for grant from the California Emergency Management Agency a. Accept a portion of grant proceeds from Next Door Solutions to domestic violence for Police Department partnership with Next Door Solutions to provide maximum assistance to victims of domestic violence b. Authorize a General Fund budget adjustment recognizing an increase in FY 2011/12 Police Operating Grant revenue in the amount of $62,500 and authorize a $62,500 expenditure appropriation increase to Police Operating Grant Program Account 4809 6. Landscaping and Lighting Assessment Districts 1 & 2 a. Adopt resolution preliminarily approving the Engineer's Report for Fiscal Year 2012/13 b. Adopt resolution of intention to order the levy and collection of assessments for Landscape and Lighting No. 1 Blackwell Drive Benefit Zone c. Adopt Resolution of Intention to order the levy and collection of assessments for Landscape and Lighting District No. 1 - Kennedy Meadows Benefit Zone d. Adopt Resolution of Intention to order the levy and collection of assessments for Landscape and Lighting District No. 1 - Santa Rosa Heights Benefit Zone e. Adopt Resolution of Intention to order the levy and collection of assessments for Landscape and Lighting District No. 1 - Vasona Heights Benefit Zone f. Adopt a resolution authorizing the Town Manager or Director of Parks and Public Works to execute the Program Supplement Agreement under the Master Agreement with the State of California Department of Transportation MOTION: Motion by Council Member Joe Pirzynski to approve Consent Item #1 -7. Seconded by Council Member Steven Leonardis. VOTE: Motion passed unanimously. Council Member Leonardis abstained from the vote on Consent Item #3 because he is a member of the Kiwanis Club. Page 3 VERBAL COMMUNICATIONS There were no verbal communications for this meeting. PUBLIC HEARINGS 8. Operating and Capital Budgets a. Consider the Town of Los Gatos Proposed Operating and Capital Budget for Fiscal Year 2012/2013 b. Consider the Town of Los Gatos Proposed Capital Improvement Program for Fiscal Year 2012/2017 c. Provide direction regarding inclusion of the following in the Fiscal Year 2012/2013 Operating and Capital Budget: 1. Planning and Development Fee 2. Funding for addition of library weekend hours 3. Funding for Live Oak Adult Day Services and Case Management 4. Allocation of funding for arts organizations 5. Additional revenue recognition Steve Conway, Finance Director, Jenny Haruyama, Budget Manager, and Mr. Larson presented staff reports on various aspects of the budget. Council Questions - Questioned how soon the Town would realize the RDA dissolution funds and whether receipt of those funds is a certainty or a possibility. - Questioned where the fund balance would be allocated if not used to balance the budget. Mr. Larson - Commented that timing of the receipt of the RDA funds are dependent on various factors such as the state budget, audits and possible litigation; however, there is a reasonable likelihood that the Town would receive some funds next fiscal year. - Commented that the fund balance would roll forward to fund capital projects. Opened the Public Hearing Ms, Hudgeon - Commented on the work of the Live Oak Adult Day Services. Closed the Public Hearing Linda Dydo, Library Director - Responded to Council questions on library weekend operating hours, Page 4 Council Discussion - Commented that fund balance should be used for capital improvements, but RDA money or Villa Vasona money may replace that. - Commented that extended weekend library hours are important. - Commented that any community survey needs to be done well to be accurate and worth the investment. Commented that donation opportunities are appropriate, but to be more successful, items should be specified. Commented that other jurisdictions have saved money by electronic distribution of agenda materials. Commented that funding for the arts organizations is important. Questioned how often the Town has relied on reserves and designated uses of reserves. Mr. Conway - Commented that although this is the first year to use fund balance carry over for operating budget, it is a modest use. Mr. Larson - Summarized the consensus action items to be returned to Council at the June 4, 2012 meeting: • Add $20,000 for Live Oak and Senior Case Management • Add extended library operating hours on Saturday and Sunday for $65,000 • Follow staff's recommendation regarding allocation of funds to arts organizations - Commented that after these modifications, there is a $550,000 unfunded gap. - Commented that there is a $500,000 undesignated fund balance. OTHER BUSINESS 9. Approve an amendment to contract between the Board of Administration California Public Employees? Retirement System and the Town Council of the Town of Los Gatos to add a second retirement tier for Non -sworn ( "Miscellaneous ") Employees Rumi Portillo, Human Resources Director, presented the staff report Open and Closed the Public Hearing MOTION: Motion by Council Member Steven Leonardis to adopt a resolution of intention to add a second retirement tier for Non - Sworn ( "Miscellaneous ") Employees. Seconded by Vice Mayor Barbara Spector. VOTE: Motion passed unanimously. Page 5 Item #9 - Continued Mazarin Vakharia, Clerk Administrator, read the title of the proposed ordinance. MOTION: Motion by Council Member Steven Leonardis to introduce an ordinance to amend the contract with CalPERS to institute a two - tier retirement plan for Non -Sworn ( "Miscellaneous ") employees.
