AUTHORIZE THE TOWN MANAGER TO EXECUTE A CERTIFICATE OF
ACCEPTANCE AND NOTICE OF COMPLETION ACCEPTING THE WORK
OF JOSEPH J. ALBANESE INC. AND AUTHORIZE RECORDING BY THE
CLERK ADMINISTRATOR.
RECOMMENDATION
Authorize the Town Manager to execute a Certificate of Acceptance and Notice of Completion
accepting the work of Joseph J. Albanese Inc. and authorize recording by the Clerk
Administrator.
BACKGROUND
The adopted FY 2011/12 — 2015/16 Capital Improvement Program (CIP) Budget designates
funding for improvement projects in the community. This project is consistent with the Town's
goals to improve public safety and the Town's infrastructure. Providing functional and
accessible pathways and picnic areas at Oak Meadow Park has been identified as a key element
in the operation of this park facility.
DISCUSSION
At its regular meeting held February 6, 2012, the Town Council authorized a contract be
awarded to Joseph J. Albanese Inc. for the renovation to the Oak Meadow Park Picnic Areas #1
& #2.
The scope of this project included replacement of all railing and benches, reconstruction of all
concrete pads, reconstruction of BBQ grill areas, repairs to the retaining walls, and replacement
of fence around the airplane. The contracted work has been satisfactorily completed by Joseph J.
Albanese Inc. and is being recommended for acceptance by the Parks and Public Works
Department.

Ten percent of the faithful performance bond will remain in effect for a period of two years to
guarantee any needed repair and/or replacement caused by defective materials and workmanship.
The execution and recordation of the Certificate of Acceptance is now required to finalize the
Town's acceptance of the project.
CONCLUSION
Staff recommends that the Town Council authorize the Town Manager to execute a Certificate of
Acceptance and Notice of Completion accepting the work of Joseph J. Albanese Inc. and
authorize recording by the Clerk Administrator.
ENVIRONMENTAL ASSESSMENT
This is a project as defined under CEQA but is Categorically Exempt (Section 15301 c). A Notice
of Exemption will not be filed.
FISCAL IMPACT
The construction contract was awarded for $99,500 with a contingency budget of $15,000,
bringing the authorized project budget to $114,500. This project was completed within the
Council approved budget, as demonstrated by the fiscal table below.
