PLANNING COMMISSION RECOMMENDATION
The Planning Commission recommended that the Town Council make the required findings
(Attachment 1) and approve Conditional Use Permit U -11 -018 (motion required).
ALTERNATIVES
Instead of the aforementioned actions, the Council may:
• Approve the application subject to modified or additional conditions of approval
(motion required); or
• Continue the project to a date certain with specific direction (motion required); or
• Remand the project to the Planning Commission with specific direction (Attachment
3) (motion required); or
• Deny the application (Attachment 4) (motion required).
BACKGROUND
The subject property was annexed to the Town in 1991 and the use, a bar known as The
Boulevard Tavern, was deemed nonconforming since it did not have a Town of Los Gatos
Conditional Use Permit (CUP). Pursuant to Town Code, the property owner had twenty years to
obtain a CUP. The Boulevard Tavern was given permission to continue operating slightly
beyond the 20 -year expiration date because the owner filed a CUP application prior to its
expiration date and is actively pursuing a CUP.

The Alcoholic Beverage Policy does not apply to the subject application since the application is
not for a new alcoholic beverage service establislunent or to change existing service, which is
consistent with past Town policy when reviewing nonconforming bar uses that were required to
obtain a Conditional Use Permit (CUP) to legalize the use.
DISCUSSION
A. Project Summary
The applicant is requesting approval of a Conditional Use Permit (CUP) to allow a bar,
known as The Boulevard Tavern, to continue to operate. The bar has 50 seats, a pool table,
and televisions. The Boulevard Tavern operates 10:00 a.m. to 2:00 a.rn. seven days a week.
The Boulevard Tavern has karaoke on Thursdays from 9:00 p.m. to 1:00 a.m. and,
occasionally, live bands on Fridays and Saturdays between 9:00 p.m. to 1:00 a.m.
The applicant is willing to accept a condition for periodic review to allow the Town to
determine whether the use remains appropriate for and compatible with the North Forty
Specific Plan area and its future development. A condition requiring periodic review is
included in the conditions of approval as modified by the Planning Commission. The
condition requires that staff review the CUP upon any change in circumstances such as
adopting of a specific plan or rezoning in irmmediate area to determine whether the use is
appropriate for and compatible with the area. Town staff would report their findings to the
Planning Commission. The Planning Commission may direct that a public hearing be held.
The condition allows the Planning Commission to recormnend revocation or modification to
the Town Council should the Planning Commission find that the use is not appropriate for or
compatible with the area. The Town Council would be the final deciding body.
B. Planning Commission
On January 25, 2012, the Planning Commission considered the subject application (see
Attachments 7 & 8). See Attachment 6 for the Commission's full discussion.
The Planning Commission recommended approval of the CUP. The Planning Commission
recommendation includes modified conditions as follows (deletions stricken, additions
underlined):

revocation or modification of the Conditional Use Permit to the Town Council with no less
than one year notification The Town Council shall be the final deciding body.
DELIVERIES: Deliveries shall be limited to the hours of 9:00 a.m. to -75:00 p.m.
TRASH AND RECYCLING DISPOSAL HOURS: Trash and recycling from the business's
interior receptacles shall only be emptied into the outside rece tp acles between 9:00 a.m. and
15:00 p.m. to limit the noise impacts.
PUBLIC COMMENTS
At this time, the Town has not received any written public comments.
CONCLUSION
The approval of the CUP would allow an existing bar to change its nonconforming status to
legally continue operating. The proposal meets parking requirements and the intent of the 2020
General Plan. The Planning Commission recommended approval of the subject application with
minor modifications as discussed above.
ENVIRONMENTAL ASSESSMENT
The project is Categorically Exempt according to Section 15301 of CEQA as adopted by the
Town, which exempts permitting an existing facility involving no expansion beyond the existing
use. No significant effect on the environment will occur since the project uses an existing
structure with no increase in floor area or seating.

WHEREAS, This matter came before the Town Council for public hearing February 21,
2012 and was regularly noticed in conformance with State and Town law.
WHEREAS, The applicant seeks approval for a Conditional Use Permit (CUP) to
legalize a nonconforming bar (The Boulevard Tavern) on property zoned CH. The applicant
requested 50 seats and hours of operation of 10:00 aan. to 2:00 a.m., seven days a week.
WHEREAS, On January 25, 2012, the Planning Commission considered a request for
approval of CUP U -11 -018 (The Boulevard Tavern) on property zoned CH. The Planning
Commission recormnended approval of the request with modified conditions of approval, finding
that the proposal was desirable to the public; it will not impair the integrity of the zone; will not
be detrimental to public health, safety, or welfare; and is in harmony with the elements and
objectives of the General Plan.
WHEREAS, The property was annexed to the Town in 1991 and the use, a bar known as
The Boulevard Tavern, was deemed nonconfonming since it did not have a Town of Los Gatos
CUP.
WHEREAS, Pursuant to Town Code, the property owner had twenty years to obtain a
CUP.
WHEREAS, Town Council received testimony and documentary evidence from the
applicant and all interested persons who wished to testify or submit documents. Town Council
considered all testimony and materials submitted, including the record of the Planning

Cornumission proceedings and the packet of material contained in the Council Agenda Report
dated February 1, 2012, along with any and all subsequent reports and materials prepared
concerning this application.
WHEREAS, Council finds as follows:
A. Pursuant to Town Code section 29.20.190, the request for a CUP is desirable to
the public convenience; will not impair the integrity and character of the zone; would not be
detrimental to public health, safety or general welfare; and is in harmony with the various
elements or objectives of the General Plan and the purposes of the Town Code. This finding is
based on the evidence presented in the Council Agenda Report dated February 1, 2012, and
incorporates the findings made by the Planning Commission on January 25, 2012, regarding this
application.
B. The project is categorically exempt from environmental review pursuant to
Section 15301 of the State Environmental Guidelines as adopted by the Town.
NOW, THEREFORE, BE IT RESOLVED:
1. The CUP application U -11 -018 to legalize a nonconforming bar (The Boulevard
Tavem) on property zoned CH is granted.
2. The Conditions of Approval attached hereto as Exhibit A are hereby adopted as
the Conditions of Approval for this permit.
3. The decision constitutes a final administrative decision pursuant to Code of Civil
Procedure section 1094.6 as adopted by section 1.10.085 of the Town Code of the Town of Los
Gatos. Any application for judicial relief from this decision must be sought within the time
limits and pursuant to the procedures established by Code of Civil Procedure section 1094.6, or
such shorter time as required by state and federal Law.

TO THE SATISFACTION OF THE DIRECTOR OF COMMUNITY DEVELOPMENT:
Planning Division
1. APPROVAL: This application shall be completed in accordance with all of the conditions
of approval listed below. Any changes or modifications to the approved plans shall be
approved by the Community Development Director, the Development Review Committee,
the Planning Commission, or the Town Council depending on the scope of the change(s).
2. LAPSE FOR DISCONTINUANCE: If the activity for which the Conditional Use Permit
has been granted is discontinued for a period of one (1) year, the approval lapses pursuant
to Section 29.20.340 of the Zoning Ordinance.
3. USE: This approval is for a bar. A change in ownership may require a new operational
agreement.
4. SUBSEQUENT REVIEW: Town staff shall review the Conditional Use Permit (CUP)
upon any change in circumstances such as adopting a specific plan or rezoning in the
immediate area to determine whether the use is appropriate for the area and compatible
with the change in circumstances. The Town shall provide not less than a one year
notification of CUP expiration and requirement of revocation or modification of the CUP.
Town staff shall report their findings to the Planning Commission who may direct that a
public hearing be held to review the permit as specified in Section 29.20.3 10 of the Town
Code. If the Planning Commission finds that the change in circumstances renders the use
incompatible, the Planning Commission may recommend revocation or modification of the
Conditional Use Permit to the Town Council with no less than one year notification. The
Town Council shall be the final deciding body.
5. OPERATIONAL AGREEMENT: Within 60 days of approval of the subject CUP, the
applicant shall enter into an operational agreement with the Town guaranteeing the
performance of the business per the representations of the application and the applicant at
the public hearings as well as the observance of the conditions of approval. Said agreement
shall be subject to approval of the Chief of Police, the Director of Community
Development, and the Town Attorney, and will be signed by the applicant. Operators who
are successors in interest to the business and CUP shall be required to meet with the
Director and Chief and agree to all the terms of the Operational Agreement by executing a
copy of the Agreement. The Operational Agreement shall be reviewed by the Director of
Community Development Department and the Town Attorney, biannually for the first five
years and annually thereafter, to ensure compliance with the Conditional Use Permit and
operating covenants, including police notification of any incident which results in, or is
thought to result in, an injury to any involved party.
6. OPERATION HOURS: Maximum hours of operation shall be 10:00 a.m. to 2:00 a.m.,
seven days a week.

7. ENTERTAINMENT: One pool table is permitted. Karaoke is allowed on Thursdays fi
9:00 p.m. to 1:00 a.m. Live music is allowed Fridays and Saturdays from 9:00 p.m. to 1:00
a.m. Live music may be amplified. This Conditional Use Permit shall be subject to the
live entertainment policy when the policy is adopted by the Town.
8. NUMBER OF SEATS: The maximum number of seats, including up to 15 stools at the bar
top, is 50. Outdoor seating is not allowed.
9. DELIVERIES: Deliveries shall be limited to the hours of 9:00 a.m. to 5:00 p.m.
10. TRASH AND RECYCLING DISPOSAL HOURS: Trash and recycling from the
business's interior receptacles shall only be emptied into the outside receptacles between
9:00 a.m. and 5:00 p.m. to limit the noise impacts.
11. ENVIRONMENTAL HEALTH APPROVAL: The applicant shall submit plans to the
County of Santa Clara Department of Environmental Health for review prior to
commencement of use. The applicant shall provide a copy of the approval from the County
of Santa Clara Department of Environmental Health prior to commencement of use and /or
issuance of building permits.
12. TOWN INDEMNITY: Applicants are notified that Town Code Section 1.10.115 requires
that any applicant who receives a permit or entitlement from the Town shall defend,
indemnify, and hold harmless the Town and its officials in any action brought by a third
party to overturn, set aside, or void the permit or entitlement. This requirement is a
condition of approval of all such permits and entitlements whether or not expressly set
forth in the approval, and may be secured to the satisfaction of the Town Attorney.
TO THE SATISFACTION OF THE CHIEF OF POLICE:
13. VIDEO SURVEILLANCE: The business shall maintain a video surveillance system in
working order with a minimum 14 day recording/replay capacity. Video shall be made
available to representatives of the Police Department upon request to support criminal, civil
or administrative investigations or monitoring. Camera location, recording quality and
lighting shall be to the satisfaction of the Chief of Police, and installed within 30 days of
approval of the Conditional Use Permit.
14. POLICE NOTIFICATION: Staff/management are required to notify police immediately
upon learning of any incident which results in, or is thought to result in, an injury to any
involved party.
15. SECURITY MANUAL: The owners shall create a security manual to be reviewed and
approved by the Chief of Policy prior to the approval of the Operational Agreement.
16. UNIFORMED SECURITY: Uniformed privately provided security guards may be required
in or around the premises by the Chief of Police if alcohol related problems recur that are
not resolved by the licensed owner.
17. CONSULTATION AND TRAINING: At the discretion of the Chief of Police, periodic
meetings will be conducted with representatives from the Police Department for on -going
employee training on alcoholic beverage service to the general public.
18. TRAINING MANUAL: The restaurant operator shall use an employee training manual that
addresses alcoholic beverage service consistent with the standards of the California
Restaurant Association.
19. DESIGNATED DRIVER PROGRAM: The restaurant operator shall actively promote a
designated driver program such as complimentary non - alcoholic beverages for designated
drivers.
20. POSTING OF TAXICAB TELEPHONE NUMBERS: Taxicab telephone numbers shall be
posted in a visible location.

immediate area to determine whether the use is appropriate for the area and compatible
with the change in circumstances. The Town shall provide not less than a one year
notification of CUP expiration and requirement of revocation or modification of the CUP.
Town staff shall report their findings to the Planning Commission who may direct that a
public hearing be held to review the permit as specified in Section 29.20.3 10 of the Town
Code. If the Planning Commission finds that the change in circumstances renders the use
incompatible, the Planning Commission may recommend revocation or modification of the
Conditional Use Permit to the Town Council with no less than one year notification. The
Town Council shall be the final deciding body.
5. OPERATIONAL AGREEMENT: Within 60 days of approval of the subject CUP, the
applicant shall enter into an operational agreement with the Town guaranteeing the
performance of the business per the representations of the application and the applicant at
the public hearings as well as the observance of the conditions of approval. Said agreement
shall be subject to approval of the Chief of Police, the Director of Community
Development, and the Town Attorney, and will be signed by the applicant. Operators who
are successors in interest to the business and CUP shall be required to meet with the
Director and Chief and agree to all the terms of the Operational Agreement by executing a
copy of the Agreement. The Operational Agreement shall be reviewed by the Director of
Community Development Department and the Town Attorney, biannually for the first five
years and annually thereafter, to ensure compliance with the Conditional Use Permit and
operating covenants, including police notification of any incident which results in, or is
thought to result in, an injury to any involved party.
6. OPERATION HOURS: Maximum hours of operation shall be 10:00 a.m. to 2:00 a.m.,
seven days a week.

7. ENTERTAINMENT: One pool table is permitted. Karaoke is allowed on Thursdays from
9:00 p.m. to 1:00 a.m. Live music is allowed Fridays and Saturdays from 9:00 p.m. to 1:00
a.m. Live music may be amplified. This Conditional Use Permit shall be subject to the
live entertainment policy when the policy is adopted by the Town.
S. NUMBER OF SEATS: The maximum number of seats, including up to 15 stools at the bar
top, is 50. Outdoor seating is not allowed.
9. DELIVERIES: Deliveries shall be limited to the hours of 9:00 a.m. to 5:00 p.m.
10. TRASH AND RECYCLING DISPOSAL HOURS: Trash and recycling from the
business's interior receptacles shall only be emptied into the outside receptacles between
9:00 a.m. and 5:00 p.m. to limit the noise impacts.
11. ENVIRONMENTAL HEALTH APPROVAL: The applicant shall submit plans to the
County of Santa Clara Department of Environmental Health for review prior to
commencement of use. The applicant shall provide a copy of the approval from the County
of Santa Clara Department of Environmental Health prior to commencement of use and /or
issuance of building permits.
12. TOWN INDEMNITY: Applicants are notified that Town Code Section 1.10.115 requires
that any applicant who receives a permit or entitlement from the Town shall defend,
indemnify, and hold harmless the Town and its officials in any action brought by a third
party to overturn, set aside, or void the permit or entitlement. This requirement is a
condition of approval of all such permits and entitlements whether or not expressly set
forth in the approval, and may be secured to the satisfaction of the Town Attorney.
TO THE SATISFACTION OF THE CHIEF OF POLICE:
13. VIDEO SURVEILLANCE: The business shall maintain a video surveillance system in
working order with a minimum 14 day recording /replay capacity. Video shall be made
available to representatives of the Police Department upon request to support criminal, civil
or administrative investigations or monitoring. Camera location, recording quality and
lighting shall be to the satisfaction of the Chief of Police, and installed within 30 days of
approval of the Conditional Use Permit.
14. POLICE NOTIFICATION: Staff /management are required to notify police immediately
upon learning of any incident which results in, or is thought to result in, an injury to any
involved party.
15. SECURITY MANUAL: The owners shall create a security manual to be reviewed and
approved by the Chief of Policy prior to the approval of the Operational Agreement.
16. UNIFORMED SECURITY: Uniformed privately provided security guards may be required
in or around the premises by the Chief of Police if alcohol related problems recur that are
not resolved by the licensed owner.
17. CONSULTATION AND TRAINING: At the discretion of the Chief of Police, periodic
meetings will be conducted with representatives fiom the Police Department for on -going
employee training on alcoholic beverage service to the general public.
18. TRAINING MANUAL: The restaurant operator shall use an employee training manual that
addresses alcoholic beverage service consistent with the standards of the California
Restaurant Association.
19. DESIGNATED DRIVER PROGRAM: The restaurant operator shall actively promote a
designated driver program such as complimentary non - alcoholic beverages for designated
drivers.
20. POSTING OF TAXICAB TELEPHONE NUMBERS: Taxicab telephone numbers shall be
posted in a visible location.

REMARKS
In response to questions received from Planning Commissioners, staff is providing corrections
and supplemental information that pertains to the subject application.
Alcoholic Beverage Policy
The Alcoholic Beverage Policy does not apply to the subject application since the application is
not for a new alcoholic beverage service establishment or to change existing service, which is
consistent with past Town policy when reviewing nonconforming bar uses that were required to
obtain a Conditional Use Permit (CUP) to legalize the use. Moreover, pursuant to the 1994
Town Council report regarding an hour of operation amendment of the Alcoholic Beverage
Policy, existing establishments are not to be required to modify their hours of operation nor their
ABC license as a result of the policy amendment (Exhibit 7, bolded portion of Section 4). The
policy can be applicable to the use if it is determined that the use is a public nuisance.

Historical Background of Nonconforming Uses
In 1977, the Town Code was amended to require a CUP for numerous types of uses including
restaurants and bars. These businesses became nonconforming as to use and had 20 years to
obtain a CUP to legalize the use.
The Alcoholic Beverage Policy was first adopted in 1990. Several of the nonconforming
establishments obtained a CUP to remove their nonconforming status after the Alcoholic
Beverage Policy was adopted. These nonconforming uses were not required to comply with the
hours of operation of the policy.
Finding Correction
Staff erroneously included in the recommendation section of the report findings required by the
Town's Alcoholic Beverage Policy to approve a Conditional Use Permit to serve alcoholic
beverages after 10:00 p.m. The Alcoholic Beverage Policy does not apply to the subject
application and the deciding body does not need to make the required findings for service
beyond 10:00 p.m. The findings on page 2 of the report and in Exhibit 2 are correct.

Town Code allows those restaurants and bars that are nonconforming due to lack of a conddItional
use permit, to continue operating without a conditional use permit until August 31, 11197. Until that
date, the Town cannot impose a conditional use perk upon those establishments unless flndings
are made under Section 29.10.225 of the Zoning ordinance that the nonconforming use is
determined to be a public nuisance (The same process used for O'Shea's).
To apply the provisions of the Alcoholic Beverage Policy to nonconforming restaurants and bars,
it is recommended that Section 29.10.225(2) be amended to state that non - compliance with the
Alcoholic Beverage Policy is a public nuisance and grourds for determining a nonconforming
restaurant or bar unlawful.

BACKGROUND
The subject property was annexed to the Town in 1991 and the use, a bar known as The
Boulevard Tavern, was deemed nonconforming since it did not have a Town of Los Gatos
Conditional Use Permit (CUP). Pursuant to Town Code, the property owner had twenty years to
obtain a CUP. The Boulevard Tavern was given permission to continue operating slightly
beyond the 20 -year expiration date because the owner filed a CUP application prior to its
expiration date and they are actively pursuing a CUP.
The 0.64 acre site currently contains a 2,103 square foot bar (The Boulevard Tavern) located on
the eastern half and 22 parking spaces to the west of and adjacent to the bar. The site also
contains two -320 square foot storage structures located on the northwestern side of the site. The
site is accessed by two driveways off Los Gatos Boulevard — an enter -only driveway to the south
and an exit -only driveway to the north.
The site is located in the area of Town known as the North Forty. The North Forty is currently
going through a Specific Plan process to determine the vision for future development. It is not
known at this time whether the use would be compatible with the future North Forty Specific
Plan, which is currently in the process.

PROJECT DESCRIPTION
A. Location and Surrounding Neighborhood
The project site is located on northwest side of Los Gatos Boulevard, approximately 800
feet northeast of Lark Avenue (Exhibit 1). Commercial uses are located to the north and
south; a residential use is located to the east; agriculture is located to the west.
B. Project Summary
The applicant is requesting approval of a Conditional Use Permit (CUP) to allow a bar,
known as The Boulevard Tavern, to continue to operate. The bar has 50 seats, a pool table,
and televisions. The Boulevard Tavern operates 10:00 a.m. to 2:00 a.m. seven days a
week. The Boulevard Tavern has karaoke on Thursdays from 9:00 p.m. to 1:00 a.m. and,
occasionally, live bands on Fridays and Saturdays between 9:00 p.m. to 1:00 a.m.
The applicant provided a letter of justification (Exhibit 4), a supplemental letter of
justification (Exhibit 5), and development plans (Exhibit 6).
The applicant is willing to accept a condition for periodic review to allow the Town to
determine whether the use remains appropriate for and compatible with the North Forty
Specific Plan area and its future development. A condition requiring periodic review is
included in the conditions of approval. The condition requires that staff review the CUP
every two years or within one year of adoption of a North Forty Specific Plan, whichever
occurs fast, to determine whether the use is appropriate for the area and compatible with
the North Forty Specific Plan. Town staff would report their findings to the Planning
Commission. The Planning Commission may direct that a public hearing be held. The
condition allows the Planning Commission to recommend revocation or modification to the
Town Council should the Planning Commission find that the use is not appropriate for the
area and /or not compatible with the North Forty Specific Plan. The Town Council would
be the final deciding body.
C. Zoning Compliance
The zoning designation allows a bar subject to the approval of a Conditional Use Permit.
The use meets the parking requirements.

ANALYSIS
A. Alcoholic Beverage Policy
The Town's Alcoholic Beverage Policy was adopted to allow the review of all applications
for new alcohol service or change in existing service which is consistent with past Town
policy when reviewing nonconforming bar uses that were required to obtain a CUP to
legalize the use. This application is not subject to the Town's Alcoholic Beverage Policy
since the application is not for a new alcoholic beverage serving establishment or to change
existing service which is consistent with past Town policy when reviewing nonconforming
bar uses that were required to obtain a CUP to legalize the use. This application is to allow
an existing establishment to change its nonconforming status to legally operate.
B. Entertainment
The Boulevard Tavern's existing entertainment consists of live bands, karaoke, televisions
and a pool table as described earlier in this report. The Town is currently in the process of
drafting an entertainment policy and permit process. Staff included a condition that the use
be subject to the entertainment policy once adopted by the Town.
C. Conditional Use Permit Findings
In order to grant approval of a Conditional Use Permit, the deciding body must make the
following findings:
(1) The proposed uses of the property are essential or desirable to the public convenience
or welfare; and
(2) The proposed uses will not impair the integrity and character of the zone; and
(3) The proposed uses would not be detrimental to public health, safety or general
welfare; and
(4) The proposed uses of the property are in harmony with the various elements or
objectives of the General Plan and the purposes of the Town Code.
In regards to finding one, the use is desirable to the public convenience or welfare in that it
maintains a drinking and entertainment venue for Town residents. In regards to the second
finding, the use would not impair the integrity of the zone since the use is existing, in a
commercial zone, and not adjacent to residential uses. In regards to finding three, the
recommended conditions of approval would mitigate potential impacts. In regards to the
final finding, the proposed use would meet the objectives of the General Plan the Town
Code as discussed within this report.

D. General Plan
The goals and policies of the 2020 General Plan listed below are applicable to this project.
Staff s comments regarding the goals and policies are italicized.
• Policy LU -9.2 — Maintain a variety of commercial uses, including a strong Downtown
commercial area combined with Los Gatos Boulevard and strong neighborhood
commercial enters to meet the shopping needs of residents and to preserve the small -
town atmosphere. The proposed use would allow an existing nonconforming
commercial venue to change its nonconforming status to legally operate on Los Gatos
Boulevard where the specific use, a bar known as The Boulevard Tavern, is
appropriate,
• Goal NOI -5 — To ensure that residential land uses are not adversely affected by noise.
The use is not immediately adjacent to residential uses, However, conditions of
approval limit the hours of deliveries and recycling disposal to reduce the noise
impacts to prevent impacts to future residential uses that may be approved on the
adjacent North 40 property.
E. Environmental Review
The project is Categorically Exempt according to Section 15301 of CEQA as adopted by
the Town, which exempts permitting an existing facility involving no expansion beyond
the existing use. No significant effect on the environment will occur since the project uses
an existing structure with no increase in floor area or seating.
PUBLIC COMMENTS
At this time, the Town has not received any public comment.
SUMMARY AND RECOMMENDATION
A. Summary
The project would allow an existing bar to change its nonconforming status to legally
continue operating. The proposal meets parking requirements and the intent of the 2020
General Plan.
B. Recommendation
Staff recommends approval of the project because it would allow an existing use to change
its nonconforming status to legally operate. If the deciding body concurs with staff's
recommendation, it should:

1. Find that the proposed project is categorically exempt, pursuant to Section 15061 of
the California Environmental Quality Act as adopted by the Town (Exhibit 2); and
2. Make the required findings as required by Section 29.20.190 of the Town Code for
granting approval of a Conditional Use Permit (Exhibit 2); and
3. Make the required findings as required by the Town's Alcoholic Beverage Policy to
approve a Conditional Use Permit to serve alcoholic beverages after 10:00 p.m.
(Exhibit 2); and
4. Recommend approval of Conditional Use Permit application U -11 -018 to the Town
Council with the conditions contained in Exhibit 3.
Alternatively, if the Commission has concerns with the application, it can:
1. Recommend approval of the application to the Town Council with additional and /or
modified conditions of approval; or
2. Recommend denial of the application to the Town Council. It should be noted that the
Commission must modify the findings noted in Exhibit 2 if the Commission
recommends denial of the proposal.

PROPERTY OWNER/APPLICANT: Robert & Georgianna Spinazze
TO THE SATISFACTION OF THE DIRECTOR OF COMMUNITY DEVELOPMENT:
Planning Division
1. APPROVAL: This application shall be completed in accordance with all of the conditions
of approval listed below. Any changes or modifications to the approved plans shall be
approved by the Community Development Director, the Development Review Committee,
the Planning Commission, or the Town Council depending on the scope of the change(s).
2. LAPSE FOR DISCONTINUANCE: If the activity for which the Conditional Use Permit
has been granted is discontinued for a period of one (1) year, the approval lapses pursuant
to Section 29.20.340 of the Zoning Ordinance.
3. USE: This approval is for a bar. A change in ownership may require a new operational
agreement.
4. TWO -YEAR REVIEW: Town staff shall review the Conditional Use Permit every two
years or within one year of adoption of a North Forty Specific Plan, whichever occurs first,
to determine whether the use is appropriate for the area and compatible with the North
Forty Specific Plan. Town staff shall report their findings to the Planning Commission
who may direct that a public hearing be held to review the permit as specified in Section
29.20.310 of the Town Code. If the Planning Commission finds that the use is not
appropriate for the area and/or not compatible with the North Forty Specific Plan, the
Planning Commission may recommend revocation or modification of the Conditional Use
Permit to the Town Council. The Town Council shall be the final deciding body.
5. OPERATIONAL AGREEMENT: Within 60 days of approval of the subject CUP, the
applicant shall enter into an operational agreement with the Town guaranteeing the
performance of the business per the representations of the application and the applicant at
the public hearings as well as the observance of the conditions of approval. Said agreement
shall be subject to approval of the Chief of Police, the Director of Community
Development, and the Town Attorney, and will be signed by the applicant. Operators who
are successors in interest to the business and CUP shall be required to meet with the
Director and Chief and agree to all the terms of the Operational Agreement by executing a
copy of the Agreement. The Operational Agreement shall be reviewed by the Director of
Community Development Department and the Town Attorney, biannually for the first five
years and annually thereafter, to ensure compliance with the Conditional Use Permit and
operating covenants, including police notification of any incident which results in, or is
thought to result in, an injury to any involved party.
6. OPERATION HOURS: Maximum hours of operation shall be 10:00 a.m. to 2:00 a.m.,
seven days a week.
7. ENTERTAINMENT: One pool table is permitted. Karaoke is allowed on Thursdays from
9:00 p.m. to 1:00 a.m. Live music is allowed Fridays and Saturdays from 9:00 p.m. to 1:00
a.m. Live music may be amplified. This Conditional Use Permit shall be subject to the
live entertainment policy when the policy is adopted by the Town.

S. NUMBER OF SEATS: The maximum number of seats, including up to 15 stools at the bar
top, is 50. Outdoor seating is not allowed.
9. DELIVERIES: Deliveries shall be limited to the hours of 9:00 a.m. to 7:00 p.m.
10. TRASH AND RECYCLING DISPOSAL HOURS: Trash and recycling from the business
shall only be emptied between 9:00 a.m. and 9:00 p.m. to limit the noise impacts.
11. ENVIRONMENTAL HEALTH APPROVAL: The applicant shall submit plans to the
County of Santa Clara Department of Environmental Health for review prior to
commencement of use. The applicant shall provide a copy of the approval from the County
of Santa Clara Department of Environmental Health prior to commencement of use and/or
issuance of building permits.
12. TOWN INDEMNITY: Applicants are notified that Town Code Section 1.10.115 requires
that any applicant who receives a permit or entitlement from the Town shall defend,
indemnify, and hold harmless the Town and its officials in any action brought by a third
party to overturn, set aside, or void the permit or entitlement. This requirement is a
condition of approval of all such permits and entitlements whether or not expressly set
forth in the approval, and may be secured to the satisfaction of the Town Attorney.
TO THE SATISFACTION OF THE CHIEF OF POLICE:
13. VIDEO SURVEILLANCE: The business shall maintain a video surveillance system in
working order with a minimum 14 day recording/replay capacity. Video shall be made
available to representatives of the Police Department upon request to support criminal, civil
or administrative investigations or monitoring. Camera location, recording quality and
lighting shall be to the satisfaction of the Chief of Police, and installed within 30 days of
approval of the Conditional Use Permit.
14. POLICE NOTIFICATION: Staff/management are required to notify police immediately
upon learning of any incident which results in, or is thought to result in, an injury to any
involved patty,
15 SECURITY MANUAL: The owners shall create a security manual to be reviewed and
approved by the Chief of Policy prior to the approval of the Operational Agreement.
16. UNIFORMED SECURITY: Uniformed privately provided security guards may be required
in or around the premises by the Chief of Police if alcohol related problems recur that are
not resolved by the licensed owner.
17. CONSULTATION AND TRAINING: At the discretion of the Chief of Police, periodic
meetings will be conducted with representatives from the Police Department for on -going
employee training on alcoholic beverage service to the general public.
18. TRAINING MANUAL: The restaurant operator shall use an employee training manual that
addresses alcoholic beverage service consistent with the standards of the California
Restaurant Association.
19. DESIGNATED DRIVER PROGRAM: The restaurant operator shall actively promote a
designated driver program such as complimentary non - alcoholic beverages for designated
drivers.
20. POSTING OF TAXICAB TELEPHONE NUMBERS: Taxicab telephone numbers shall be
posted in a visible location.

IS ISOLATED FROM THE DOWNTOWN HUB OF SIMILAR BUSINESSES AND IS NOT IN COMPETITION BECAUSE OF THIS LOCATION.
MOST OF THE CUSTOMERS WORK AT THE NEARBY BUST NESSES AND OWN HOMES IN LOSGATOS.

SUBSTANTIAL POSITIVE INFLUENCE ON THE CLIENTELE MY ESTABLISHMENT HAS ATTRACTED. I ONCE
AGAIN WANT TO STRESS TO THE TOWN COUNCIL THAT I AM SIMPLY TRYING TO HAVE THIS USE PERMIT
GRANTED WITH A STIPULATION STATING THAT WHEN THE AREA BEHIND MY BUSINESS IS DEVELOPED,
WILL CEASE OPERATIONS IN ATIMELY MANNER THAT IS ACCEPTABLE TO THE COUNCIL. MY BUSINESS IS

FULL LIQUOR. MY ESTABLISHMENT HAS BEEN HERE SINCE THE 1940'S. GARDINO'S HAS BEEN GRANTED
FULL LIQUOR, CHICAGO STEAK AND FISH, LOSGATOS BREWING CO. OPA, JAMES RANDALL, AND THE
GARRETT TO NAME A FEW, YET MY ESTABLISHMENT HAS BEEN HERE FOR YEARS. AND I HAVE BEEN A
RESLRENTHERE FOR OVER 20 YEARS..
THE NEW LOCATION OF THE POLICE HEADQUARTERS IS DIRECTLY DOWN LOS GATOS BLVD, AND HAS
