M11-21-2011P a g e 1 Council/Agency Meeting 12/5/11 Item #5 MINUTES OF THE TOWN COUNCIL/PARKING AUTHORITY/REDEVELOPMENT AGENCY MEETING NOVEMBER 21, 2011 The Town Council of the Town of Los Gatos conducted a Regular Meeting on Monday, November 21, 2011 at 7:00 P.M. TOWN COUNCIL/PARKING AUTHORITY/REDEVELOPMENT AGENCY MEETING CALLED TO ORDER AT 7:00 P.M. ROLL CALL Present: Mayor Joe Pirzynski, Vice Mayor Steve Rice, Council Member Steven Leonardis, Council Member Diane McNutt, and Council Member Barbara Spector. Absent: None. PLEDGE OF ALLEGIANCE Members of the Los Gatos Youth Commission led the Pledge of Allegiance. The audience was invited to participate. PRESENTATIONS Mayor Joe Pirzynski presented the Certificate of Achievement for Excellence in Financial Reporting (CAFR) for Fiscal Year Ending June 30, 2010 and the Silicon Valley Business Journal CFO Award to Steve Conway, Finance Director. Mayor Joe Pirzynski commented on the contributions to the community made by former Mayor and Council Member Steve Glickman, in whose memory the meeting was being adjourned. CLOSED SESSION REPORT There was no closed session for this meeting. TOWN COUNCIL MATTERS P a g e 2 TOWN MANAGER MATTERS Greg Larson, Town Manger - Commented that several Town staff members serve in leadership roles for various regional and state-wide organizations. - Commented that the Annual Tree lighting will take place on Friday, December 2nd at 4:00 p.m. and that the Holiday Parade will be on Saturday, December 3rd at 10 a.m. Did You Know?? Benjamin Baranovsky, Youth Commission Chair - Commented that the Los Gatos Youth Commission is comprised of 20 students who work to address youth issues in the community. - Commented that the Youth Commission created a work plan that is aligned with the Council’s six core values. CONSENT ITEMS (TO BE ACTED UPON BY A SINGLE MOTION) 1. Accept First Quarter Investment Report FY 2011/12 (July through September 2011) 2. Planned Development Application PD-11-004. Project Location: 15400 Los Gatos Boulevard. Property Owner/Applicant: SHP, LLC Adopt an Ordinance of the Town of Los Gatos rescinding Ordinance 2175 and amending the Town Code effecting a Zone Change from CH:PD to CH:PD for property at 15400 Los Gatos Boulevard. APN: 424-15-045 - Mr. Arzie pulled Item #2 from the consent calendar. 3. Planned Development Application PD-11-001Mitigated Negative Declaration ND- 11-005. Project Location: 800 Blossom Hill Road (The Terraces of Los Gatos) Property Owner: American Baptist Homes of the West (ABHOW). Applicant: Dan Schneider, Boulder Associates. Adopt an ordinance amending the Planned Development Ordinance 1788 to allow a new memory service and assisted living building for property at 800 Blossom Hill Road, zoned RM-12:20:PD. APN 523-05- 001 4. Hazardous Vegetation Abatement (Weeds) a. Adopt resolution declaring hazardous vegetation (weeds) a public nuisance and providing for their abatement and setting a public hearing in order to hear protests b. Set January 17, 2012 as a public hearing date on this annual program. 5. Approve Council/Agency minutes of November 7, 2011 P a g e 3 Consent Items - Continued MOTION: Motion by Council Member Barbara Spector to approve Consent Items #1-5, exclusive of Item #2. Seconded by Vice Mayor Steve Rice. VOTE: Motion passed unanimously. Consent Item #2 2. Planned Development Application PD-11-004. Project Location: 15400 Los Gatos Boulevard. Property Owner/Applicant: SHP, LLC Adopt an Ordinance of the Town of Los Gatos rescinding Ordinance 2175 and amending the Town Code effecting a Zone Change from CH:PD to CH:PD for property at 15400 Los Gatos Boulevard. APN: 424-15-045 Mr. Arzie - Expressed concerns about the proposed project. Mr. Larson - Commented that the requirement for retail, or lack thereof, for the project is a policy decision that the Planning Commission forwarded to the Town Council. - Commented that the ordinance before the Council reflects the Council’s unanimous direction at its last meeting. MOTION: Motion by Vice Mayor Steve Rice to approve Consent Item #2. Seconded by Council Member Steven Leonardis VOTE: Motion passed unanimously. VERBAL COMMUNICATIONS (Up to three minutes may be allotted to each speaker to address matters that are not on tonight’s agenda.) Mr. Van Nada - Clarified a statement he made in a Letter to the Editor in the Los Gatos Weekly Times. P a g e 4 PUBLIC HEARINGS 6. Adopt resolution authorizing the continued use of Supplemental Local Law Enforcement Services funds (SLESF) to provide funding for two (2) full-time Police officers assigned as motorcycle traffic officers Chief Scott Seaman presented the staff report. Open/Closed the public hearing. MOTION: Motion by Council Member Barbara Spector to adopt a resolution authorizing the continued use of Supplemental Local Law Enforcement Services funds (SLESF) to provide funding for two (2) full-time Police officers assigned as motorcycle traffic officers. Seconded by Vice Mayor Steve Rice. VOTE: Motion passed unanimously. OTHER BUSINESS There was no other business for this meeting. APPOINTMENT OF MAYOR AND VICE MAYOR MOTION: Motion by Mayor Joe Pirzynski to appoint Steve Rice as the Mayor of Los Gatos. Seconded by Council Member Steven Leonardis VOTE: Motion passed unanimously. The following comments were made prior to the vote: Council Comments - Commented that the natural progression is for the Vice Mayor to become Mayor. Mr. Miller - Commented that as the Mayor of Saratoga, he appreciates the Town of Los Gatos and its incoming and outgoing mayor. Mayor Steve Rice - After his appointment, expressed his gratitude for the opportunity to be Mayor during 2012, which will be a significant year for the Town of Los Gatos. P a g e 5 Appointment of Mayor and Vice Mayor – Continued MOTION: Motion by Mayor Steve Rice to nominate Barbara Spector as Vice Mayor Seconded by Council Member Diane McNutt. VOTE: Motion passed unanimously. The following comments were made prior to the vote: Council Comments - Expressed gratitude for community members' support. Mr. Boyd - Expressed support for the nomination of the Vice Mayor. Mr. Arzie - Expressed support for the nomination of the Vice Mayor. Mr. Mangano - Expressed support for the nomination of the Mayor and Vice Mayor. Mr. Wasserman - Expressed support for the nomination of the Mayor and Vice Mayor - Commented that Los Gatos has exemplary staff and elected officials. Vice Mayor Spector - After her appointment, commented that she will take the Town’s best interest into consideration when making decisions regarding land use and budget issues. Mayor Steve Rice presented outgoing Mayor Joe Pirzynski with a commemorative gavel. The audience viewed a video with highlights from Council Member Pirzynski’s year as Mayor. Outgoing Mayor Joe Pirzynksi reflected on his year as Mayor and expressed gratitude for the community’s support. Ms. Claire Lincoln Rice swore in the Mayor and Vice Mayor P a g e 6 ADJOURNMENT The meeting adjourned at 8:20 p.m. in memory of former Los Gatos Council Member, Steve Glickman.
