PROPERTY OWNER/APPLICANT: SANTA CLARA DEVELOPMENT COMPANY APPROVAL OF OFF -SITE BMP UNIT RECOMMENDATION Approve the off -site BMP unit and direct staff to commence the process to make the unit available for sale to a qualified low income recipient. DISCUSSION On October 7, 2011, the Town Council approved a Planned Development (PD) for construction of 22 single - family homes on the former Honda dealership site at 16213 Los Gatos Boulevard. As part of the approval, one Below Market Price (BMP) unit will be constructed within the project and one off -site BMP unit will be provided. Performance standard #4 from PD Ordinance 2203 requires Council approval of the off -site BMP unit. The applicant is proposing to convert a studio unit located in the Wedgewood Manor condominium complex at 14225 Lora Drive to a BMP unit (see Attachment 1). There are currently no affordable units within the complex. The studio unit has recently been upgraded as shown in the photos attached to the letter, and is ready to be released for sale upon approval by Council and completion of a BMP Agreement with the developer. The unit will be sold to a low income individual or household through the Town's BMP program. In addition to the off-site unit, the applicant is also providing one on -site unit per the PD approval. The on -site unit is a very large, four bedroom, two car garage, 2,000 s.f. home that will be sold to a moderate level qualified buyer. The adopted BMP Guidelines state that BMP units should be similar in size to the market rate units in a project. The next largest unit in the Town's inventory has approximately 1,500 square feet of living space and includes three bedrooms. Equally important is that the off -site unit will be the first for -sale low income BMP unit in the inventory (all other for -sale units have been moderate income units). Staff finds that there are mitigating circumstances with the overall proposal due to the size of the on -site unit and the ability to provide the Town's first low- income for -sale BMP unit. Consequently, staff believes the Council has the discretion to find that the proposal meets the intent of the BMP Guidelines. FISCAL IMPACT None ATTACHMENTS 1. The offsite unit was approved with the understanding that it would be a "low income, for sale unit ", and not be located in close proximity to other BMP units and not lie within the Los Gatos Union School District boundaries. A low income unit is particularly attractive because, while demand for such units is high, the Town does not have any in its inventory. Thus, this offsite BMP further advances the goals of the Town's BMP policy. Since the exact location and description of the home was not presented at the meeting, the Council requested that once identified and documented, the particular unit would be brought before Council for final authorization. This document provides that information and requests your approval. The home is located at 14225 Lora Drive, #67, Los Gatos, in the Wedgewood Manor complex. It is a 786 square foot studio condominium with a recently updated kitchen including new granite counters, sink and faucet, microwave and range combo, and low profile light; updated bathroom including new sink and faucet, tub shower, and vinyl flooring; and new paint and hardwood flooring throughout. It appears spacious and inviting due to its open floor plan and light, bright, and "airy" decor. The home features include an entertainment nook, dining bar, office area, extra storage closets, and privacy from neighbors. HOA dues are approximately $286 per month. The studio condominium is on the second floor of its building and is accessed by a stairway or an elevator. The laundry room and mailbox are located on the ground floor near the stairs and one assigned covered parking stall with storage is located close by. Additional on- site parking is available (one -time permit fee) and there is guest parking. The common areas are spacious and well maintained. There is an onsite clubhouse which includes a well stocked library, an exercise room, workshop, lounge with a fireplace, kitchen facilities, a dining area, and an outdoor area with a table and chairs and water fountain. There is also an outdoor area outfitted with a gas -fired barbeque and tables and chairs. The amenities and features of the complex, coupled with the attractive floor plan, updated interior and private location of the home make it a very desirable and practical living space. The unit is located in the Marshall Lane Elementary, Rolling Hills, and Westmont High School Districts.
