ORDINANCE OF THE TOWN OF LOS GATOS
AMENDING THE SUBDIVISION ORDINANCE
CONCERNING FEES.
THE TOWN COUNCIL OF THE TOWN OF LOS GATOS DOES ORDAIN AS
FOLLOWS:
SECTION 1.
Section 27 -28 of the Code of the Town of Los Gatos is
amended to read as follows:
SEC. 27 -28 FILING, RECORDING AND INSPECTION FEES
Upon the submission of a final map for checking and
certification by the Town Engineer the subdivider or his
agent shall pay the following fees: (1) a filing fee in
the amount of one hundred twenty -five dollars plus four
dollars for each lot shown on the final map; (2) a sum
equal to the amount required by law for the recordation
of the map; and (3) a, fee to cover the costs of inspecting
the installation of the street, drainage, and other
improvements to be installed for the subdivision. The
amount of such fee to cover the cost of inspecting the
installation of such improvements, shall be based upon
percentages of the Town Engineer's estimate of the value
of such improvements, and shall be calculated as follows:
Six per cent of the first ten thousand dollars of
value or any fraction thereof, plus
Four and five - tenths per cent of - the next twenty
thousand dollars of value or any fraction thereof, plus
Three and five - tenths per cent of the next thirty
thousand dollars of value or any fraction thereof, plus
Two and five - tenths per cent of that value which
exceeds sixty thousand dollars.
SECTION 2.
Section 27 -7 of the Code of the Town of Los Ga.tos is amended
to read as follows:
SEC. 27 -7 FILING; FILING FEE
Not less than ten copies of a, tentative map of any
proposed subdivision shall be filed with the Planning
Commission by the subdivider or by his agent. The
secretary or other authorized agent of the Planning
Commission shall stamp or write on each copy of such
tentative map the date of receipt thereof and shall
return one copy to the person who filed the same. At
the time of the filing of each tentative map the
subdivider or his agent shall pay a filing fee of two
hundred twenty -five dollars plus four dollars for each
lot shown upon such tentative map.
SECTION 3.
Section 27 -87 of the Code of the Town of Los Gatos is amended
to read as follows:

SEC. 27 -87 FEES FOR CONSTRUCTION OF FACILITIES SERVING
NEW BUILDINGS IMPROVEMENTS AND PLANNED
STRUCTURES SCHEDULE.
There is hereby established the following schedule
of fees to be used for construction of drainage facilities
serving new buildings, improvements (including but not
limited to paving) or structures to be constructed in
Local Drainage Areas No. I, No. II and No. III, which,
as determined by the engineer, substantially impair the
perviousness of the surface of land.
(a) For single - family residences and buildings,
structures and improvements appurtenant thereto;
(1) In areas which are subdivided pursuant to
the terms of the Subdivision Map Act or local
ordinance supplementary thereto:
a. For single - family residences, buildings,
structures and improvements appurtenant thereto
located within the "Hillside Subdivision Area,"
as described in Exhibit B of Ordinance 715 of
the Town, the fee shall be computed at the rate
of one thousand one hundred dollars per acre.
b. For single - family residences, buildings,
structures and improvements appurtenant thereto
located in all other areas, the fee shall be
computed at the rate of thirteen hundred fifty
dollars per acre.

C. The maximum drainage fee charged residential
lots which are in excess of one acre in area shall
be one thousand one hundred dollars per lot in the
"Hillside Subdivision Area" and thirteen hundred
fifty dollars per lot in all other areas until
division of such lot into additional building sites,
at which time an additional drainage fee shall be
paid in an amount equivalent to that prescribed by
subparagraph a. or b. above for each additional
building site created.
(2) In areas not subdivided pursuant to the terms
of the Subdivision Map Act or local
thereto, the schedule of fees shall
subsection a. above; provided, that
shall be computed on the basis of a,
by the Town Engineer.
(b) For multiple - dwelling units, whi

numerous single- living units, duplexes, triplexes, quadruplexes
or apartment houses, and buildings, structures or improvements
appurtenant thereto, included within the gross site development
plan of lot of such dwelling, a fee at the rate of thirteen
hundred fifty dollars per acre for land appurtenant to such
buildings, structures or improvements within the gross site
development plan or lot, plus a fee of fifty dollars for
each living unit in excess of two provided, that the total
amount of such fee shall not exceed the fee for commercial
or industrial buildings; and further provided, that the
minimum fee shall be two hundred dollars.
(c) For commercial or industrial buildings, hospitals,
churches, schools and buildings, structures or improvements
appurtenant thereto, included within the gross site development
plan or lot, a fee at the rate of sixteen hundred dollars
per acre for land appurtenant to such buildings, structures
or improvements within the gross site development plan or
lot; provided that the minimum fee shall be two hundred
dollars, except for additions to buildings, structures or
improvements used or to be used for commercial or industrial
purposes, for which the fee shall be computed at the rate of
sixteen hundred dollars per acre to the extent of the addition
and the land appurtenant thereto; and except, that any fee
determined under this section to be less than five dollars
may be waived.
(d) For all other types of buildings, structures, or
improvements including all accessory structures or improvements
appurtenant thereto, a fee at the rate of sixteen hundred
dollars per acre for land appurtenant to the buildings,
structures or improvements within the gross site development
plan or lot; provided, that fees determined to be less than
five dollars shall be waived.

Upon application for a building permit, or filing of
a tentative subdivision map, record of survey map, or
parcel map, the applicant shall certify to the number of
square feet in each lot.
SECTION 4.
Subsection (a) of Section 27 -89 of the Code of the Town of
Los Gatos is amended to read as follows:
SEC. 27 -89 SAME -- TOTAL DRAINAGE COST OBLIGATION
DEDUCTIONS FROM REQUIRED FEES
(a) The construction costs of drainage facilities located
in publicly -owned streets or rights -of -way required to
be constructed by the Town Engineer for or in connection
with the property to be subdivided or developed shall be
deducted from the fees set forth in Section 27 -87.
Deductible drainage costs shall not include allowances
for land required to be dedicated, profit, overhead,
inspection or engineering. Such deductible costs shall
include those incurred for construction as determined by
the Town Engineer prior to installation and materials in
accordance with the following schedule:

(2) Pavement replacement: Replacement footage shall be
allowed for a width of two and one -half feet more than the
outside diameter of corregated metal pipe; and three feet
more than the outside diameter of reinforced concrete pipe.
a. Double armor coat -- 15 cents per square foot.
b. :Asphalt concrete surfacing -- 15 cents per square
foot per inch of thickness.
C. Import base material, four cents per square foot
per inch of thickness.

SECTION 5.
Subsection (c) of Section 31 -10 of the Code of the Town of
Los Gatos is amended to read:
SEC. 31 -10 SAME -- LARGE SCALE PLANTING
(c) The applicant shall be required to deposit an amount
of sixty cents per lineal foot of front roadway (as
designated on tract map) with the Town for the purchase,
planting and maintenance of the specified number of
street trees as determined by using criteria set up
in this section.
THIS ORDINANCE shall take effect and shall be in force
thirty (30) days after the date of its adoption. The Town Clerk
of the Town of Los Gatos shall cause this ordinance to be published
once within fifteen (15) days after its adoption, in the Los Gatos
Times - Saratoga Observer, a newspaper of general circulation,
published and circulated in the Town of Los Gatos.
The above and foregoing ordinance was duly and regularly
introduced at a regular meeting of the Town Council
of the Town of Los Gatos held on the 21St day of
1975.
