ORDINANCE OF THE TOWN OF LOS GATOS
AMENDING ARTICLE IV OF THE TOWN CODE
RELATING TO BINGO GAMES
THE TOWN COUNCIL OF THE TOWN OF LOS GATOS DOES ORDAIN:
SECTION 1.
Section 4.56.5 is added to Article 4 of the Town Code of the
Town of Los Gatos to read:
SEC. 4.56.5 CRIMINAL HISTORY
The Chief of Police has authority to obtain criminal
history information concerning each person who will operate
or assist in operating a bingo game for purposes of his
investigation. If the operator or persons who will assist
in operating a bingo game have been convicted of crimes
involving lotteries, gambling, larceny, perjury, bribery,
fraud or similar crimes involving moral turpitude, the
Chief of Police shall not approve issuance of the permit.
SECTION 2.
Section 4.56.6 is added to Article 4 of the Town Code of the
Town of Los Gatos to read:
SEC_ 4.56.6: FTLT_NG OF REPORT
At the end of the term of each permit, every permittee
shall file a written report made under penalty of perjury
with the Chief of Police containing the following information:
(1) The total amount of money received from the operation
of the bingo games during the term of the permit.

(2) The total amount paid in prizes.
(3) Detailed costs of operation of the bingo games.
SECTION 3.
Section 4.62 of Article 4 of the Town Code of the Town of
Los Gatos is amended to read:
SEC. 4.62: PROFITS TO BE KEPT IN SEPARATE FUND OR ACCOUNT
All profits derived from bingo games shall be kept in
a special fund or account and shall not be commingled with
any other fund or account. The permittee shall keep for
a minimum of three years full and accurate records of the
income and expenses received and disbursed in connection
with its operation, conduct, promotion, supervision and
any other phase of bingo games. The Town has the right
to examine and audit such records at any reasonable time
and the permittee shall fully cooperate with the Town by
making such records and supporting data available.
SECTION 4.
Section 4.62.5 is added to Article 4 of the Town Code of the
Town of Los Gatos to read:
SEC. 4.62.5: INSPECTION OF PREMISES
At any time during the operation of a bingo game
representatives of the Town may enter and inspect the premises
to ascertain whether this ordinance, the Town Code or State
law is being violated.

SECTION 5.
This Ordinance takes effect 30 days after the date of its
adoption. The Town Clerk of the Town of Los Gatos shall cause
this Ordinance to be published once within 15 days after the date
of its adoption, in the Los Gatos Times - Saratoga Observer, a
newspaper of general circulation, published and circulated in the
Town of Los Gatos.
The above and foregoing Ordinance was duly and regularly
introduced at a regular meeting of the Town Council of the Town of
Los Gatos held on the 6th day of December , 1976.
PASSED AND ADOPTED as an Ordinance of the Town of Los Gatos,
California, at a regular meeting of the Town Council,
held on the 3rd day of January 1977, by the following
vote:
