2004-097- Establishing Penalties An Administrative CitationsRESOLUTION 2004 - 97 RESOLUTION OF THE TOWN COUNCIL OF THE TOWN OF LOS GATOS ESTABLISHING AN ADMINISTRATIVE CITATION SCHEDULE OF PENALTIES FOR VIOLATIONS OF THE LOS GATOS TOWN CODE WHEREAS, on March 1, 2004, the Los Gatos Town Council adopted Ordinance No. 2127, as set forth in Chapter 1 of the Los Gatos Town Code, which established administrative citation and administrative remedies processes for enforcing provisions of the Los Gatos Town Code; WHEREAS, section 1.30.020 of the Town Code, provides that an enforcement officer of the Town of Los Gatos charged with enforcement of the Town Code shall have the authority to issue administrative citations and correction notices to any person or entity responsible for violation of the Code; WHEREAS, section 1.30.025 of the Town Code, states that the administrative penalty amounts for code violations shall be set forth in a schedule of penalties established by resolution of the Town Council, which schedule shall specify any increased penalties for repeat violations of the same Code section, and shall further specify the amount of any late payment charges imposed for the payment of a penalty after its due date; WHEREAS, subsection (a) of California Government Code section 53069.4 states that where the violation of a municipal code would otherwise be an infraction, the administrative fine or penalty shall not exceed the maximum fine or penalty amounts for infractions set forth in subdivision (b) of Government Code section 36900; WHEREAS, subdivision (b) of Government Code section 36900 states that all violations determined to be an infraction are punishable by (1) a fine not exceeding one hundred dollars ($100) for a first violation; (2) a fine not exceeding two hundred dollars ($200) for a second violation within one year; and (3) a fine not exceeding five hundred dollars ($500) for each additional violation within one year; and WHEREAS, subdivision (c) of Government Code section 36900 states that, "notwithstanding any other provision of law," a violation of local building and safety codes determined to be an infraction is punishable by (1) a fine not exceeding one hundred dollars ($100) for a first violation; (2) a fine not exceeding five ($500) for a second violation within one year; and 1 (3) a fine not exceeding one thousand dollars ($1,000) for each additional violation within one year. RESOLVED, The penalties for violations of the Los Gatos Town Code shall be as set forth in Exhibit "A," attached and incorporated by this reference, except: 1. The penalties for all violations of the Town Code not specifically set forth in Exhibit "A" and that do not involve violations of local building and safety codes shall be: (1) one hundred dollars ($100) for a first violation; (2) two hundred dollars ($200) for a second violation within one year; and (3) five hundred dollars ($500) for each additional violation within one year; 2. The penalties for all violations of the Town Code not specifically set forth in Exhibit "A" and that involve violations of local building and safety codes and are not otherwise designated as misdemeanors shall be: (1) one hundred dollars ($100) for a first violation; (2) five hundred dollars ($500) for a second violation within one year; and (3) one thousand dollars ($1,000) for each additional violation within one year; and 3. The penalties for all knowing and willful violations of the Town Code shall be: (1) five hundred dollars ($500) for a first violation; and (2) one thousand dollars ($1,000) for each additional violation within thirty -six months thereafter.
