AND AUTHORIZE RECORDING BY THE CLERK ADMINISTRATOR. RECOMMENDATION Authorize the Town Manager to execute a Certificate of Acceptance and Notice of Completion accepting the work of Bogard Construction, Inc. and authorize recording by the Clerk Administrator. BACKGROUND The Los Gatos Library project is progressing according to schedule with the grand opening scheduled for February 2012. With the opening of this new facility, there are several associated site improvements needed for the Civic Center complex. One of the site improvements identified was the replacement of the original wooden siding on the Los Gatos - Saratoga Adult Recreation Center. The original siding was approximately 30 years old and due to weather exposure over the years was in need of complete replacement. In addition, the building has experienced leaks from the siding area over the last several years due to deterioration of the water - proofing material underneath the siding. This project was initiated to address both the exterior appearance of this building (located directly adjacent to the new library), as well as the water intrusion issues associated with leaks during the storm season. DISCUSSION On July 19, 2011, the Town Manager awarded the contract to Bogard Construction, Inc. in the amount of $50,962 during the July Town Council recess. Ten percent of the faithful performance bond will remain in effect for a period of two years to guarantee any needed repair and /or replacement caused by defective materials and workmanship. The execution and recordation of the Certificate of Acceptance is now required to finalize the Town's acceptance of the project. CONCLUSION Staff recommends that the Town Council authorize the Town Manager to execute a Certificate of Acceptance and Notice of Completion accepting the work of Bogard Construction Inc. and authorize recording by the Clerk Administrator. ENVIRONMENTAL ASSESSMENT This is a project as defined under CEQA but is Categorically Exempt (Section 15301c). A Notice of Exemption will not be filed. FISCAL IMPACT The project was completed under budget as demonstrated in the table below.
