ORDINANCE NO. 1630
ORDINANCE AMENDING THE ZONING ORDINANCE OF THE TOWN
OF LOS GATOS ESTABLISHING A ZONING APPROVAL
FOR THE STORAGE OF HAZARDOUS MATERIALS
The Town Council of the Town of Los Gatos hereby ORDAINS:
Section 1.
Section 4.40.070 of the Zoning Ordinance of the Town of Los Gatos is
hereby amended as follows:
SEC. 4.40.070 OUTDOOR STORAGE
When a conditional use permit is granted for outdoor storage the area
for storage must be suitably screened from adjoining property by a wall,
dense evergreen hedge of trees or other screen planting, or by a solid
fence not less than six feet high. Materials shall not be stored in such
a manner as to project above the wall, planting or fence. This section
shall not apply to any zoning approval issued under Chapter 4.70 of this
Ordinance relating to the storage of hazardous materials.
Section 2.
Section 4.70.020 of the Zoning Ordinance of the Town of Los Gatos is
hereby enacted as follows:
SEC. 4.70.020: ZONING APPROVAL FOR STORAGE OF HAZARDOUS MATERIALS
The Development Review Committee is empowered to issue a zoning
approval for the storage of hazardous materials in the CM or LM zones only
subject to the following:
(1) The storage facility shall be required in order to comply
with a fire department Hazardous Materials Storage Permit.
(2) The maximum area for the facility shall be subject to review
and recommendation by the Fire Chief.
(B) If the facility is a structure, the building materials and
color shall be in harmony with the existing buildings on the
site.
(4) If the facility is not a structure, it shall be screened so
as not to be visible from on the site. Screening may be fencing,
landscaping or a combination, subject to the discretion of the
Committee. All landscaping shall be subject to a two -year
maintenance agreement.

(5) The facility shall never be located in a required front yard
nor in a required side or required rear yard if that yard is
adjacent to a street, a residential use or zone, a park or a
creek.
(5) The facility shall not reduce the number of parking
spaces below the minimum requirements as stated in this
Ordinance.
(7) The facility shall be located so as not to involve or
endanger other structures or persons.
(8) The facility shall be located for ease of transfer to work
stations so as not to increase potential risk in the hand-
ling and transportation of hazardous materials.
(9) The facility shall be removed when it is no longer needed,
or if the Hazardous Materials Storage Permit is suspended,
revoked or has expired.
Section 3.
Section 4.70.030 of the Zoning Ordinance of the Town of Los Gatos is
hereby enacted as follows:
SEC. 4.70.030: LIMITATION
The use of a hazardous raterials storage facility is limited to the
storage, decanting and dispensing of hazardous materials. No other
storage or manufacturing activities are allowed.
Section 4.
Section 4.70.040 of the Zoning Ordinance of the Town of Los Gatos is
hereby enacted as follows:
SEC. 4.70.040: REVOCATION
The Zoning Approval for the storage of hazardous materials shall be
revoked if the storage area is used for anything other than the storage of
hazardous materials under a valid Hazardous Materials Storage Permit, as
provided by section 5.30.120.

Section 4.70.050 of the Zoning Ordinance of the Town of Los Gatos is
hereby enacted as follows:
SEC. 4.70.050: EXPIRATION
The Zoning Approval expires automatically if the use of the facility
for the storage of hazardous materials is abandoned or if a new business
entity occupies the premises.

Section 5.30.040 of the "Zoning Ordinance of the Town of Los Gatos is
hereby enacted as follows:
SEC. 5.30.040: APPEALS FROM DECISIONS BY THE DEVELOPMENT REVIEW
COMM
Any interested person may appeal to the Commission from a decision of
the Development Review Committee determining an application for the
storage of hazardous materials.
Section 7.
Section 5.50.060 of the Zoning Ordinance of the Town of Los Gatos is
hereby amended as follows:
SEC. 5.60.060: FIRE CHIEF
The Fire Chief:
(1) Authorizes changes in driveway standards for height
clearance and radius of curves.
(2) Reviews and recommends the maximum area for a facility for
the storage of hazardous materials as provided in Chapter 4.70.
(3) Sends a list of hazardous storage facilities and the status
of each to the Director of Planning every six (6) months.
(4) is a member of the Development Review Committee.
Section 8.
Section 5.60.100 of the Zoning Ordinance of the Town of Los Gatos is
hereby amended as follows:
SEC. 5.60.100: DEVELOPMENT REVIEW COMMITTEE
The Committee:
(1) Regularly reviews and makes recommendations to the Plan-
ing Commission concerning the determination of all matters which
come before the Commission except zoning ordinance amendments,
zone changes (not including rezoning to PD), General Plan
adoptions and amendments, specific plan adoptions and amendments,
and capital improvement plans.
(2) Reviews and makes recommendations to the Council concerning
community- oriented bulletin boards and kiosks proposed to be
erected on public property.
(3) May on its own motion review and make recommendations
concerning matters not assigned to it.

(4) Determines and issues zoning approval for the storage of
hazardous materials as provided in Chapter 4.70.
(5) Determines appropriate screening (fencing, landscaping or
a combination) for hazardous materials storage sites as provided
in Chapter 4.70.
No Commission action is invalid because of omission of review and
recommendation.
Section 9.
The ordinance No. 1518 (Urgency Ordinance Extending Urgency Interim
Zoning Ordinance Establishing a Zoning Approval for the Storage of
Hazardous Materials Until April 15, 1985) shall be no longer effective
after the effective date of this Ordinance.
This ordinance takes effect 30 days after the date it is adopted.
Within 15 days after this ordinance is adopted, the Town Clerk shall cause
it to be published once in a newspaper of general circulation published
and circulated in the Town.
The above and foregoing Ordinance was duly and regularly introduced at
a regul meeting of the Town Council of the Town of Los Gatos held
on the 5th day of November , 1984.

California at a requl meeting of the Town Council held on the 19t
