Ord 1833 - Amending the Zoning Ordinance Effecting a Zone Change No. 83 from R-1:8000 to R-1:8000-PDORDINANCE 1833 AN ORDINANCE OF THE TOWN OF LOS GATOS AMENDING THE ZONING ORDINANCE EFFECTING ZONE CHANGE NO. 83 FROM R- 1:8000 TO R- 1:8000 -PD THE TOWN COUNCIL OF THE TOWN OF LOS GATOS DOES HEREBY ORDAIN: SECTION I The Zoning Ordinance of the Town of Los Gatos is hereby amended to change the zoning on property addressed as 15347 National Avenue shown on the map which is attached hereto marked Exhibit A and is part of this Ordinance, from R- 1:8000 (Single - family Residential, 8,000 square foot lot size minimum) to R- 1:8000 -PD (Single- family Residential, 8,000 square foot size minimum - Planned Development). SECTION II The PD (Planned Development Overlay) zone established by this Ordinance authorizes the following construction and use of improvements: 1. Demolition of an existing single - family residence, secondary dwelling unit and other accessory structures; 2. Construction of four (4) detached single - family residential structures. 3. Landscaping, parking and other improvements shown and required on the Official Development Plan; 4. Uses permitted are those specified in the R-1 (Single-family Residential) zone by Section 4.26.020 (Permitted Uses) and 4.26.030 (Conditional Uses) of the Zoning Ordinance, as those sections exist at the time of the adoption of this Ordinance, or as they may be amended in the future. However, no use listed cher \reports \z -89 -2 1 in Section 4.26.030 is allowed unless specifically authorized by this Ordinance, or by Conditional Use Permit. SECTION III COMPLIANCE WITH OTHER DEVELOPMENT STANDARDS All general provisions in Article 3 of the Zoning Ordinance apply, and the provisions of Chapter 4.10 of the Zoning Ordinance apply, except when the Official Development Plan specifically shows otherwise. SECTION IV Architecture and Site Approval is required before the grading, demolition or construction work is performed, whether or not a permit is required for the work, and before any permit for grading, demolition and construction is issued. Grading, demolition or construction permits shall only be used in a manner complying with Section 4.82.120 of the Zoning Ordinance. SECTION V OFFICIAL DEVELOPMENT PLAN In addition to Exhibit A, (Zone Change Vicinity Map), the attached Exhibit B (Site Plan and Conceptual Elevations, sheets 1 through 20) are part of the Official Development Plan. The following performance standards are part of the Official Development Plan and must be complied with before issuance of any grading, demolition or construction permits: TO THE SATISFACTION OF THE PLANNING DIRECTOR: cher \reports \z -89 -2 2 TO THE SATISFACTION OF THE PLANNING DIRECTOR: 1. Applicant shall file an Architecture and Site Application for the demolition of the the single - family residence and the secondary dwelling unit. 2. All residences shall be pre - plumbed for solar hot water. 3. A Tree Removal Permit shall be obtained prior to the issuance of a Building Permit. 4. All residences shall have sectional roll -up garage doors. TO THE SATISFACTION OF THE TOWN ENGINEER: 5. Final grading, drainage, utility, driveway, private street and street lighting plans shall be provided. 6. A soils and geologic report shall be prepared which provides specific criteria and standards governing site grading, drainage and a recommendation for private street structural section. A registered civil engineer, specializing in soil mechanics, should be included in the group that prepares this report. 7. Any work in the public right -of -way will require an Encroachment Permit. 8. A well information questionnaire (available through the Town Engineer) shall be completed. 9. The applicant shall dedicate ingress- egress, storm drain, sanitary sewer and public service easements as required. 10. Applicant shall pay a traffic mitigation fee of $14,104.00. 11. The applicant shall sign a five -year Tree Maintenance Agreement with the Town. 12. Active cable television service shall be provided to each lot. 13. All lots shall be surveyed and monumented (set pipes) prior to construction. 14. Horizontal and vertical controls shall be set by a licensed surveyor or a registered civil engineer for the following items: cher \reports \z -89 -2 3 14. Retaining wall, top -of -wall elevation, location e. Toe and top of cut and fill slopes 15. All fees, as applicable, shall be paid prior to recordation of the final map or issuance of any permits. TO THE SATISFACTION OF THE DIRECTOR OF PARKS, FORESTRY & MAINTENANCE SERVICES: 16. Newly planted trees shall be double - staked, using rubber tree ties and shall be planted prior to occupancy. 17. Prior to any Construction or Building Permits being issued, the applicant shall meet with the Director of Parks, Forestry and Maintenance Services concerning the need for protective fencing around the existing trees. A plan for such protective fencing demonstrating type and location shall be submitted to the Planning Director after being approved by the Director Parks, Forestry and Maintenance Services. Such fencing is to be installed prior to, and be maintained during, construction. 18. No irrigation or planting shall be permitted under the dripline of existing native trees. 19. All tree care activities shall be accomplished by a licensed, competent tree care firm as approved by and under the supervision of the Director of Parks, Forestry & Maintenance Services. 20. Any impervious surface encroaching under the dripline of existing trees shall have aeration tubes installed or interlocking pavers. cher \reports \z -89 -2 4 TO THE SATISFACTION OF THE DIRECTOR OF BUILDING SERVICES: 21. Every residential unit shall be designed to include the following features: a. Wheelchair reachable light switches, thermostat controls and electrical outlets. b. Door handles rather than knobs. C. Wooden backing in bathroom walls to allow structural strength for addition of grab bars by the occupants. d. Faucets and shower controls operable with one hand requiring a minimal amount of grasping with exceptio of those used on vanity faucets. e. All doors at least 32 in. wide. f. Two outside door thresholds no higher than � in. above landings. Landings to be a least five feet by five feet. TO THE SATISFACTION OF THE CENTRAL FIRE PROTECTION DISTRICT: 22. Applicant shall mark the entire street as "Fire Lane ". SECTION VI This Ordinance takes effect 30 days after the date it is adopted.
