ORDINANCE OF THE TOWN OF LOS GATOS
AMENDING SECTIONS 29.10.020, 29.20.150 29.20.185 AND 29.20.190
OF THE TOWN CODE
TO DEFINE AND REGULATE
HAZARDOUS WASTE FACILITIES
THE TOWN COUNCIL OF THE TOWN OF LOS GATOS DOES ORDAIN AS
FOLLOWS:
SECTION I
Section 29.10.020 of the Town Code is amended to add a new definition:
Section 29.10.020. Definitions.
Hazardous Waste Management Facility, An operation that entails the systematic control
of the storage, transportation, processing, treatment, collection, source separation, recovery and
disposal of hazardous wastes. Hazardous wastes are those wastes which because of quantity,
concentration, or physical, chemical, or infectious characteristics may pose a substantial present
or potential hazard to human health or environment when improperly treated, stored, transported,
or disposed of, or otherwise managed.
SECTION II
A new subsection (9) is added to Section 29.20.150 of the Town Code as follows:
Section 29.20.150. Considerations in review of applications.
(9) Considerations relating to the location of a Hazardous Waste Management Facility.
A hazardous waste facility shall not be located closer than 500 feet to any residentially
zoned or used property or any property then being used as a public or private school
primarily educating persons under the age of 18. An application for such a facility will
require an Environmental Impact Report, which may be focused through the initial study
process.
SECTION II
A new subsection (5) (o) is added to the Table of Conditional Uses in Section 29.20.185 as
follows:

SECTION III
A new subsection (5) is added to Section 29.20.190 as follows:
(5.) A hazardous waste facility proposal is subject to the California Health and Safety
Code, Article 8.7, Section 25199 - 25199.14 and shall be consistent with the Santa
Clara County Hazardous Waste Management Plan.
SECTION IV
This Ordinance was introduced at a regular meeting of the Town Council of the Town of Los
Gatos on October 16, 1995, and adopted by the following vote as an ordinance of the Town of Los
Gatos at a meeting of the Town Council of the Town of Los Gatos on November 6, 1995. This
ordinance takes effect 30 days after it is adopted.
