TOWN COUNCIL/PARKING AUTHORITY/REDEVELOPMENT AGENCY CLOSED SESSION BEGAN AT 5:45 P.M. MEETING CALLED TO ORDER ROLL CALL Present: Mayor Joe Pirzynski, Vice Mayor Steve Rice, Council Member Steven Leonardis, Council Member Diane McNutt, and Council Member Barbara Spector. Absent: None. PLEDGE OF ALLEGIANCE  Jocelyn Potmesil, RJ Fisher Middle School, led the Pledge of Allegiance. The audience was invited to participate. Mayor Joe Pirzynski requested that the meeting be adjourned in memory of Former Mayor Egon Jensen. CLOSED SESSION REPORT CONFERENCE WITH LABOR NEGOTIATOR (Government Code Section 54957.6) To meet with Town Negotiators listed below in closed session pursuant to Government Code §54957.6 regarding negotiations with the Employee Organizations listed below: Town Negotiators (Lead): Rumi Portillo, Human Resources Director / Greg Larson, Town Manager Employee Organizations: Management Employees, Confidential Employees, Town Employees Association (TEA), American Federation of State, County and Municipal Employees Local No. 101 (AFSCME) Ms. Propp stated that direction was given and no reportable action was taken. P a g e 2 Closed Session Report – Continued CONFERENCE WITH LEGAL COUNSEL - EXISTING LITIGATION (Government Code Section 54956.9 [a]) To meet with Town Attorney regarding existing litigation pursuant to Government Code §54956.9(a). Discussion in open session would prejudice the position of the Town in litigation. Three Cases: a. Mitchell Matlow v. Town of Los Gatos, Santa Clara County Superior Court, Case No. 110CV187058 b. Ross Creek Neighbors v. Town of Los Gatos, Santa Clara County Superior Court, Case No. 110CV189381 c. Ross Creek Neighbors, et al. v. Town of Los Gatos, S anta Clara County Superior Court, Case No. 108CV106461 Ms. Propp stated that direction was given and no reportable action was taken. TOWN COUNCIL COUNCIL/TOWN MANAGER REPORTS Council Matters  There were no Council Matters for this meeting. Manager Matters  Commented that the Town has had no major incidents related to the storms that hit the Bay Area this past week and that staff will remain on standby through the balance of the holiday season given the anticipated weather.  Announced that tomorrow is the re-opening of the Roberts Road Bridge and invited the community to attend the re-opening event at 1:30 p.m.  Commented that the Town will be closed through Jan 2, 2011; however, Police, Library, and Parks and Public Works will have a reduced schedule.  Commented that the Town has launched the recruitment to fill the vacant positions on the Town's various boards and commissions and invited the community to apply. Did You Know?? Mr. Todd Capurso, Director of Parks and Public Works  Presented information on the Town’s Street Maintenance Program.  Commented that more information can be found by accessing the Town’s website at www. LosGatosCa.gov or by calling the Parks and Public Works Department at 408-399-5770. P a g e 3 CONSENT ITEMS (TO BE ACTED UPON BY A SINGLE MOTION) 1. Adopt Council Committee Appointments effective January, 2011. 2. Approve Council Minutes of November 29, 2010 Special Meeting. 3. Adopt an ordinance to amend the Town Code effecting a zone change from R -1:8 to R-1:8LHP, for property located at 16221 Shannon Road. ORDINANCE 2194 4. New Building and Fire Codes a. Adopt an ordinance of the Town of Los Gatos repealing Chapter 6, Building Regulations, and Chapter 9, Fire Prevention and Protection, adopting and amending new 2010 California Building and Fire Codes. ORDINANCE 2195 b. Adopt resolution making findings for modifying the 2010 California Building and Fire Codes. RESOLUTION 2010-107 TOWN COUNCIL/REDEVELOPMENT AGENCY 5. Approve Council/Agency minutes of December 6, 2010. 6. Adopt resolution approving the FY 2009/10 Los Gatos Redevelopment Agency Annual Report. RESOLUTION 2010-109 MOTION: Motion by Council Member Diane McNutt to approve Consent Items #1 - 6. Seconded by Council Member Barbara Spector. VOTE: Motion passed unanimously. VERBAL COMMUNICATIONS Ms. Sanchez  Commented about the new on-line newspaper called Los Gatos Patch.  Commented that the on-line paper went live at 1:00 p.m. today and the community may access the website at www.losgatos.patch.com. Adopt resolution authorizing the continued use of Supplemental Local Law Enforcement Services funds (SLESF) to provide funding for two (2) full-time Police officers assigned as motorcycle traffic officers. RESOLUTION 2010-108 Staff report made by Greg Larson, Town Manager. Open/Closed Public Hearing MOTION: Motion by Vice Mayor Steve Rice to adopt resolution authorizing the continued use of Supplemental Local Law Enforcement Services funds (SLESF) to provide funding for two (2) full-time Police officers assigned as motorcycle traffic officers. Seconded by Council Member Diane McNutt. VOTE: Motion passed unanimously. OTHER BUSINESS Mayor Joe Pirzynski announced that there is an additional item that was not on the agenda. 347 Massol Avenue - Bay Tree Apartments Approve the final map for 347 Massol Avenue - Lyon Bay Tree Apartments in conformance with the approved Planned Development Ordinance 2171. Mr. Larson  Commented that the Town had received a request from Mr. Cole and Ms. Staples requesting to place the final map approval on the agenda for tonight.  Commented that the item is a ministerial act that implements what Council had approved on December 15, 2008, and does not require any separate public notice. Ms. Propp  Clarified that there would need to be a motion by Council to consider whether or not to discuss the item. P a g e 5 Other Business 347 Massol Avenue – Continued MOTION: Motion by Council Member Diane McNutt to move that Council consider the request to approve a final map for Lyon - Bay Tree Apartments at 347 Massol Avenue. Seconded by Council Member Steven Leonardis. VOTE: Motion passed unanimously. MOTION: Motion by Council Member Diane McNutt to approve final map, subject to review and approval by the Town Manager for 347 Massol Avenue - Lyon Bay Tree Apartments in conformance with the approved Planned Development Ordinance 2171.
