2002-153-Authorizing Town Manager To Send Letter To Silicon Valley Animal Control Authority And Authorizing A Budget Adjustment Of $174,600RESOLUTION NO. 2002-153 RESOLUTION AUTHORIZING THE TOWN MANAGER TO: (A) :SEND A LETTER TO THE .SILICON VALLEY ANIMAL CONTROL AUTHORITY GENERAL MANAGER TO COMMIT TO CONTINUED PARTICIPATION IN THE JOINT POWERS AGREEMENT FOR ANIMAL CONTROL AND TO AUTHORIZE ADDITIONAL FUNDING FOR THE SILICON VALLEY ANIMAL CONTROL AUTHORITY SHELTER COSTS, CONTINGENT UPON THE CITY OF SUNNYVALE CONTINUING THEIR PARTICIPATION IN THE JPA AND (B) AUTHORIZE A BUDGET ADJUSTMENT OF $174,600 FROM GENERAL FUND RESERVES FOR ANIMAL SHELTER TO PROVIDE BASE LEVEL APPROPRIATIONS FOR THE FISCAL YEAR 2002/03 PHASED CAPITAL COSTS AS PART OF THIS AGREEMENT, WITH THE UNFUNDED BALANCE TO BE ALLOCATED THROUGH THE FISCAL YEAR 2003/08 CAPITAL IMPROVEMENT PROCESS WHEREAS, On July 17, 2000, the Town Council of the Town of Los Gatos entered into a Joint Powers Agreement with the Cities of Sunnyvale, Santa Clara, Cupertino, Saratoga, Campbell .and Monte Sereno for the purposes of providing animal control services to those communities; and, WHEREAS, pursuant to the Agreement, the total start up cost for the JPA was established at $551,000 and the Town's share was 8.42% of that cost, with an additional appropriation of 8.42%, which was the Town's share of an estimated three million dollar ($3,000,000) shelter construction project; and, WHEREAS, the total cost for the shelter project has increased to eight million dollars ($8,000,000), due to increased construction costs and errors in the original facility design, .and the Town's share .is now estimated to be $676;620 but could potentially fluctuate $100,000- 200,000 higher or lower; and, WHEREAS, the Town believes that continued participation in this JPA and the shelter construction project is in the best interest of the Town and its' residents in order to ensure that animal control services are available in the Town, with the contingency that the City of Sunnyvale commits to continued participation in the JPA; NOW, THEREFORE, BE IT RESOLVED, by the Town Council of the Town of Los Gatos, County of Santa Clara, State of California, that the Town Manager is authorized, and is hereby .directed, to execute a letter of commitment and funding support from the Town of Los Gatos to SVACA for the purposes of building a JPA animal shelter and to authorize a budget adjustment of $174.;600 from the General Fund Reserves for the animal shelter, with the remaining balances programmed into the FY 2003-2008 Capital Improvement Plan process where funding allocations can be appropriated from identified funding sources.
