RESOLUTION OF THE TOWN COUNCIL OF THE TOWN OF LOS GATOS
ADOPTING FEES FOR DEVELOPMENT APPLICATIONS THAT ARE REFERRED BACK
TO THE PLANNING COMMISSION ~BY THE TOWN COUNCIL AND ESTABLISHING
APPEAL FEES FOR APPEALS OF DIRECTOR OF COMMUNITY DEVELOP1y1`ENT AND
DEVELOPMENT REVIEW COMMITTEE DECISIONS. ~
WHEREAS, the Town has had an increase in the number of applc~~ations being appealed;
and
WHEREAS, a number of applications are being appealedto the Town Council and are
subsequently referred back to the Planning Commission for re . esign; and
WHEREAS, applications that are referred back to~he Planning Commission and those
that are appealed result in additional processing time ar~d noticing costs; and
WHEREAS, development proj ects going
resulting in costs not being recovered and the

THEREFORE, BE IT RESOLVED; The'Town Council hereby amends the Town Fee
Schedule to establish the following fegg: (a) A fee of 5'0% of the original planning application fee
for processing applications that are eferred from the Town Council to the Planning Commission,
except when the Town Council ~ etermines that the Planning Commission erred in its decision;
and (b) A fee of $50 for app ding a decision of the Director of Community Development or
Development Review Co mittee {DRC).
FURTHER SOLVED: The Town Council shall have the authority to waive the 50%
remand fee if it de rmnes this to be an appropriate action.

PASSED AND ADOPTED at a regular meeting of the Town Council of the Town of
Los Gatos, California, held on the 18th day of December, 2000 by the following vote:
