A RESOLUTION APPROVING AND ACCEPTING
FINAL MAP OF TRACT N0. 5326
WHEREAS, that certain Final Map of Tract No. 5.326 for the -
subdivision of land situated in the Town of Los Gatos, County of
Santa Clara, State of CaLfornia, dated November, 1972 ~
and prepared by VTN Engineers, Inc. (Joseph R. Bennie, Licensed Land
Surveyor) for LAWXERS TITLE INSURANCE CORP., as Subdivider, has
been filed with the Town Council of the Town of Los Gatos for approval
and acceptance; and the following documents have been .filed with the
Town Clerk of the Town of Los Gatos in connection therewith:
1. An Agreement executed by Subdivider, entitled "Contract
for the Improvement of Tract No. 5326, lios Gatos, California", dated
January 15> 1973 , wherein in consideration of the
approval of said map by the Town, Subdivider agrees to construct and
complete all streets and other improvements required of owners under
the provisions of Chapter 27 of the Los Gatos Town Code and the
conditions of approval of the Tentative Map pursuant to which that
Final Map was prepared;
2. Two (2) bonds in the amount of Eighty-One Thousand and
00/100 ($B1, 000.00) Dollars and Sixty-Six Thousand and 00/100
($66,000.00) Dollars, guaranteeing the faithful performance by
Subdivider of all work and the construction of all improvements re-
fer-red to in the above-described agreement and the payment of claims
of labor and materialmen, respectively;
3. Certificates of public liability and property damage
insurance providing public liability insurance in the amounts of
$300,000 for each person, $500,000 for each accident or oceur-renee,
and property damage coverage of $100,000, whereby the Town of Los Gatos,
and in their capacity as such, its councilmen, officers, boards, com-
missions, and its employees will be insured, indemnified and held
harmless from any and all claims of any kind or nature, arising or

resulting from the construction of said improvements or other work
of subdividing within or outside said subdivision, and/or arising
or resulting from or concerning the doing or failing to do by said
Subdivider of all things required to be done in the above-mentioned
agreement; and
4. An Agreement executed by Subdivider and any and all other
persons or entities having an interest in the lands entitled, "Contract
Regulating Dedication and Acceptance of Streets in Tract No. 5326,
LosGatos, California", dated- January 9, 1973 , regulating
the nature and extent of physical improvements which can be installed
on certain streets within said tracts by the owners for the purpose
of regulating traffic flow and ingress and egress while said streets
remain private, the procedures and circumstances under which the offer
of dedication of said streets which, by virtue-of this resolution will
be initially rejected, may be accepted in the future and the streets
made public, and authorizing the Town to remove any gates and appurten-
ances which have been installed at such time as the offer of dedication
is accepted by the Town;
5. Certified copies of letters, dated January 3, 1973, from
Jos. C. Wolf, Director of Finance, County of Santa Clara, certifying
that there are no liens against the subdivision for taxes o-r special
assessments collected as taxes, except taxes or special assessments
not yet payable, and estimating the amount thereof, and tax bonds
in the amounts of (nil), the originals of which are on file in the
Office of the Clerk of the Santa Clara County Board of Supervisors;
MOW, THEREFORE BE IT RESOLVED AND IT IS HEREBY RESOLVED by
the Town Council of the Town of Los Gatos, County of Santa Clara,
State of California, that the above-described Final Map for Tract
No. 5326 is hereby approved.
BE IT FURTHER RESOLVED that all offers of dedication of land
for public use made on said Final Map a-re hereby rejected subject to

the right of future acceptance pursuant to the terms and conditions
of the above described agreement, entitled "Contract Regulating
Dedication and Acceptance of Streets in Tract No. 5326, Los Gatos,
California",.and said offers are hereby rejected subject to the
right of future acceptance pursuant to the terms and conditions of
said agreement.
PASSED AND ADOPTED AT A REGULAR MEETING OF THE TOWN COUNCIL
OF THE TCWN OF LOS GATOS, held on the 15th day of January ,
1973, by the following vote:
