Ord 0639-WEDGEWOOD NUMBER FOUR ANNEXATIONORDINANCE NO. 639 AN ORDINANCE APPROVING THE ANNEXATION OF CERTAIN UNINHABITED TERRITORY, DESIGNATED ED 1 -1-1 M TO THE TOWN OF LOS GATOS THE TOWN COUNCIL OF THE TOWN OF LOS GATOS DOES ORDAIN AS FOLLOWS: WHEREAS on the 4t1 day of De Cc ._ber, 19 61 , the Council of the Town of Los Gatos did pass and adopt a Resolution giving notice of the proposal to annex certain uninhabited territory to the Town of Los Gatos, said territory being therein designated as '-Fa%,cc Fum'be "'ozsknn, c , and said action being taken by the Council of said Town as the legislative body of the Town pursuant to a written petition therefore, said Resolution describing the boundaries of the territory so proposed to be annexed to said Town; and WHEREAS, said Resolution did contain a notice of the day, hour and place when and where the said Council of said Town would hear protests made by any person owning real property with- in the territory proposed to be annexed, the time of said hearing being not less than twenty nor more than sixty days from the date of the passage of said Resolution; and ~ s WHEREAS, on the 15th day of J nuEr r 19 at the hour of :00 c' cl ""r in the Los Gatos Council Chambers in the Town Hail of the Town of Los Gatos, County of Santa Clara, State of California, said time and place being the day, hour and place fixed in said Resolution for hearing protests to said annexation, the said Council of said Town did hear and pass upon all protests made to said proposed annexation and did determine that no protests to said proposed annexation have been made by or on behalf of the owners of one-half of the value of the territory proposed to be annexed as shown by the equalized roll, nor by public and private owners of equal to one-half of Page of Pages the value of the territory proposed to be annexed as determined by said legislative body; and WHEEEAS, said territory is contiguous to the Town of Los Gatos, and is uninhabited territory in the County of Santa Clara, and all of the procedural requirements of the annexation of Uninhabited Territory Act of 1939, particularly Government Code Sections 35300 and 35314 inclusive have been fully complied with; NOVI, THEREFORE., the said Council of the Town of Los Gatos does hereby approve the annexation of said territory, hereinafter described, to the Town of Los Gatos and does hereby further ordain that the said territory be and is hereby annexed to the Town of Los Gatos. That said territory, the annexation of which to the Town of Los Gatos is hereby approved, is all that territory situate in the County of Santa Clara, State of California, more particularly described as follows: Page_ of Pages .-"w ® 9 "WEDI Ec OOD NWMER FOUR ANNEXATION" Beginning at the Northeasterly corner of Lot 11 of the subdivision shown upon that certain map entitled, "San Benito Tract, Tract No. 113", which map was filed for record in the office of the Recorder of the County of Santa Clara, State of California, on July 17, 1939, in Book 4 of Maps, Page 10, said point of beginning being also in the Town Limits line of the Town of Los Gatos; Thence, following the Northerly line of said Lot 115 San Benito Tract and along the 'town Limits of the Town of Los Gatos Northwesterly to the point of intersection of said line with the Easterly line of Lora Drive, as said Drive is shown upon the hereinbefore mentioned San Benito Tract, Tract No. 113; Thence, Southwesterly along the Easterly line of said Lora Drive to the point of intersection of said line with the Northerly line of Wedgewood Avenue, as the same now exists; Thence, following the various courses and distances of the Northerly line of said Wedgewood Avenue generally Easterly to the point of intersection of said line with the Easterly line of the certain parcel of land conveyed in the Deed from Ethel Olive Johnson to Kenneth Avery, a single man and Wm. Avery, et ux, recorded January 18, 1957, in Book 3710-of Official records, at page 270, Santa Clara County Records; Thence, following the Easterly line of said last mentioned to the. point of intersection of said line Avery parcel Northerly/with the Southerly line of Lot 10, of the said San Benito Tract, Tract No. 113; Thence, Easterly along the Southerly line of said Lot 10, San Benito Tract, to the Southeast corner thereof; Thence, Northerly along the Easterly line of said Lot 10, San Benito Tract and further Northerly along the Easterly line of said hereinbefore mentioned Lot 11 of,said San Benito Tract to the point of beginning. r.
