AN ORDINANCE APPROVING THE ANNEXATION OF CERTAIN
UNINHABITED TERRITORY, DESIGNATED
NORTHWEST NUMBER FIVE ANNEXATION"
TO THE TOWN OF LOS GATOS
THE TOWN COUNCIL OF THE TOWN OF LOS GATOS DOES ORDAIN
AS FOLLOWS:
WHEREAS on the 2nd day of October , 19 61 , the Council
of the Town of Los Gatos did pass and adopt a Resolution giving
notice of the proposal to annex certain uninhabited territory to the
-Teen of Los Gatos, said territory being therein designated as
"Northwest Number Five Annexation" T , and said action being
taken by the Council of said Town as the legislative body of the
flown pursuant to a written petition therefore, said Resolution
describing the boundaries of the territory so proposed to be
annexed to said Town, and
WHEREAS, said Resolution did contain a notice of the
day, hour and place when and where the said Council of said Town
would hear protests made by any person owning real property with-
in the territory proposed to be annexed, the time of said hearing
being not less than twenty nor more than sixty days from the date
of the passage of said Resolution; and
WHEREAS, on the 20th day of November 19 1
at the hour of 5;00 o'clock F.H. in the Los Gatos Council
Chambers in the Town Hall of the Town of Los Gatos, County of
Santa Clara, State of California, said time and place being the
day, hour and place fixed in said Resolution for hearing protests
to said annexation, the said Council of said Town did hear and
pass upon all protests made to said proposed annexation and did
determine that no protests to said proposed annexation have been
made by or on behalf of the owners of one-half of the value of
the territory proposed to be annexed as shown by the equalized
roll, nor by public and private owners of equal to one-half of

the value of the territory proposed to be annexed as determined by
said legislative body; and
WHEREAS, said territory is contiguous to the Town of
Los Gatos, and is uninhabited territory in the County of Santa
Clara, and all of the procedural requirements of the annexation of
Uninhabited Territory Act of 1939, particularly Government Code
Sections 35300 and 35314 inclusive have been fully complied with;
NOVI, THEREFORE, the said Council of the Town of Los Gatos
does hereby approve the annexations of said territory, hereinafter
described, to the Town of Los Gatos and does hereby further ordain
that the said territory be and is hereby annexed to the Town of Los
Gatos.
That said territory, the annexation of which to the
Town of Los Gatos is hereby approved, is all that territory situate
in the County of Santa Clara, State of California, more particularly
described as follows:

Beginning at the Northeasterly corner of that certain parcel of
land conveyed tb Edward M. Band, et ux, by Deed recorded May 19, 1943
in Book 1139, Official Records, Page 561, Santa Clara County Records;
Thence, Northwesterly along the Northerly line of said Band
parcel to the point of intersection of said line with the Easterly
line of that certain parcel of land conveyed to A.W. Hoenig,-et ux,
by Deed recorded July 11, 1951, in Book 2247, Official Records,
Page 416, Santa Clara County Records.;
Thence, Northeasterly along said Easterly line of said Hoenig
parcel to the Northeast corner thereof, said point being also a point
in the City Limits line of the City of Monte Sereno;
Thence, following on and along the City Limits line of the
City of Monte Sereuo Northwesterly and Southwesterly to the point
of intersection with the Southerly line of that certain parcel of
land conveyed to John F. Carey, et ux, by Deed recorded May 12,.1954,
in Book 2871, Official Records, Page 650, Santa Clara County Records;
Thence, Easterly along said Southerly line of said Carey parcel
to' the Southeast corner -thereof-V
Thence, Northeasterly along the Easterly line of said Carey
parcel to the point of intersection of sad line with the Northerly
line of that certain parcel of land eonve ed to Elliot Wax, et -ux
by Deed recorded September 1, 1955, in Bok 3269, Official Records,
Page 512, Santa Clara County Records;

Thence, Easterly along the Northerlfline of said wax parcel

and further Easterly along the Easterly °olongation of said North-
erly line to-the point of intersection of"said line with.tbe .center
line of the San Tomas Aquino Road. (Presenly Santa Clara-Los.Ga.tos
Road} as the same-existed prior to June 1954, said point being
also a point in the'Town Limits line of the Town of Los Gatos;
Thence, following the center line of said San Tomas Aquino Road
(Presently Santa Clara-Los'Gatos Road) generally Northerly to the
point of intersection of said line with the Easterly. Prolongation of
the Northerly line of the hereinbefore mentioned Bang parcel;
Thence, Westerly along the Easterly prolongation of said-North
erly line of said Band parcel to the point of beginning...
