AN ORDINANCE REGULATING TIE CONSTRUCTION OF SIDEWALKS,
DRIVEWAYS, CURBS AND GUTTERS IN THE TOWN OF LOS GATOS
THE TO`rzN COUNCIL OF THE TOWN OF LOS GATOS DOES
MMAIN AS FOLLOWS :
Section 1: No person, firm or corporation shall,
within the Town of Los Gatos, lay down, build or construct
any sidewalk, driveway, curb or gutter upon any street, lane,
or alley therein, without first having applied to and ob-
tained from the Department of Public Works of said Town a
written permit to do so, and all of said work small be done
under the supervision and to the satisfaction of the
Superintendent of Streets of the Town of Los Gatos.
Section 2: All sidewalks, driveways, curbs and
gutters shall be constructed in accordance with specifica-
tions, plans and detailed drawings prepared by the Town
Engineer of the Town of Los Gatos and on.file with the
Town Clerk. The specifications entitled "Specifications
For Cement Concrete Sidewalks, Driveways, Curbs and Gutters,
Town of Los Gatos," and the plans and detailed drawings
therefor entitled "Sidewalks, Driveway, Curb and Gutter
Details, and specifications entitled "Specifications for
Asphaltic Concrete Sidewalks and Driveways" and the plans
and detailed drawings therefor entitled "Asphaltic Concrete
Sidewalks and Driveways," prepared by the Town Engineer and
riled with the Town Clerk are and each is hereby approved
and adopted.
Section 3: All sidewalks, driveways, curbs and gutters
shall be constructed to the official lines and grades
established by the Town Engineer.

Section 4: That the person, firm or corporation
laying down, building, or constructing any such sidewalk,
driveway, curb or gutter, before proceeding to do said work,
shall first file with the Superintendent of Streets of the
Town of Los Gatos a request for the Town Engineer to mark
upon the ground the official lines and grades for said side-
walk, driveway, curb, or gutter and shall not downy work
thereon until the said Town Engineer shall have first given
and marked on the ground the official lines and grades
therefor;
Section 5: All sidewalks, driveways, curbs and gutters
shall be constructed of cement concrete in accordance with
the specifications, plans and detailed drawings set forth
in Section 2 of this,Ordinance; provided, however, that
for good cause shown 'in a. special or unusual case, the Town
Planning Commission may prepare and file its written report
and recommendation with the.Town.Council recommending the
use of asphaltic concrete for sidewalks and driveways, in
-which event the Town Council may by resolution permit said
sidewalks and driveways to be constructed in accordance with
the specifications, for asphaltic concrete sidewalks and
driveways, and plans and detailed drawings therefor, as set
forth.in Section 2 of the Ordinance; provided further that
the Town Planning Commission may prepare and file a written
report and recommendation with the Town Council recommending
that materials other than cement or asphaltic concrete be
used for sidewalks or driveways in the Town of Los Gatos in
special or unusual cases, in which event, the Town Council
may by resolution permit such materials to be used, provided
the materials used and the method of preparing and applying
the same, and the construction of said sidewalks and driveways

are all in accordance with'specifications., plans and detailed
drawings prepared by the Town Engineer and filed with the
Town Clerk of the Town of Los Gatos and all of said work
shall be done under the supervision and to the satisfaction
of the Superintendent of Streets of the Town of Los Gatos.
Section 6: Immediately after the completion of the work
for which the permit is granted as hereina.bove provided, the
person, firm or corporation doing said work shall remove all
unused material, refuse and dirt placed by him on or in the
vicinity of said work.
Section 7: It is hereby declared to be unlawful for
any person, firm or corporation to repair or construct, or
cause to be repaired or constructed, in the Town of Los Gatos,
any sidewalks, driveway, curb or gutter or to cut any curb
for the purpose of constructing a driveway or to begin the
excavation for the purpose of constructing a sidewalk, curb
or gutter within the Town of Los Gatos, without first obtain-
ing from the Superintendent of Streets a permit in writing to
do s.o. The Superintendent of Streets shall charge a fee of.
$2.00 for each and every permit issued. The provision herein
for payment of a fee of $2.00 for a permit shall not apply to
persons, firms or corporations constructing sidewalks, drive-
ways, curbs or gutters in a new subdivision for which fees
have been paid or where inspection fees are provided for and
paid under any contract entered into with the Town of Los Gatos.
Section 8 All ordinances and parts of ordinances in
conflict herewith are hereby repealed.
Section 9: Any person, firm or corporation violating
any provisions of this ordinance shall upon conviction, be
punished by a fine.not to exceed the, sum of $500.00 or im-
prisonment in the County Jail of the County of Santa Clara,
not to exceed six months, or, by both such fine and imprison-
ment.
Section 10: This ordinance shall be published once in
the Los Gatos Times-Saratoga. Observer, a newspaper of general
circulation, published in the Town of'.Los Gatos.

Town Council of the Town of Los Gatos, held on the 30th day
of October, 1961.
PASSED AND ADOPTED as an Ordinance of the Town of
Los Gatos at a regular meeting of the Town Council of the
Town of. Los Gatos held on the 6th day of November,.1961, by
the following vote;
