Ord 0558-FARLEY ROAD - SUELDURNME WAY ANNEXATION• ORDINANCE NO. AN ORDINANCE APPROVING THE ANNE'XA'TION OF CERTAIN UNINHABITED TERRITORY, DESIGNATED °"FARLE-Y ROAD - SUELDURNME WAY ANNEXATION" TO THE TOWN OF LOS GA T OS THE TOWN COUNCIL OF THE TOWN OF LOS GATOS DOES ORDAIN AS FOLLOWS : WHEREAS on the 20th day of March , 19 Sl , the Council of the Town of Los Gatos did pass and adopt a Resolution giving notice of the proposal to annex: certain uninhabited territory to the --Town of Los Gatos, said territory being therein designated as "Farley Road-Shelburne Way Annexation14 , and said action being taken by the Council of said Town as the legislative body of the Town pursuant to a written petition therefore, said Resolution describing the boundaries of the territory so proposed to be annexed to said Town; and WHEREAS, said Resolution did contain a notice of the day, hour and place when and where the said Council of said Towns would hear protests made by any person owning real property with- in the territory proposed to be annexed, the time of said hearing being not less than twenty nor more than sixty days from the date of the passage of said Resolution; and , WHEREAS, on the lst day of May , 19 61 at the hour of 8:00 o'clock p.m. in the Los Gatos Council Chambers in the Town Hall of the Town of Los Gatos, County of Santa Clara, State of California., said time and puce being the day, hour and place fixed in said Resolution for hearing protests to said annexation, the said Council of said Town did hear and pass upon all protests made to said proposed annexation and did determine that no protests to said proposed, annexation have been made by or on behalf of the owners of one-half of the value of the territory proposed to be annexed as shown by the equalized roll, nor by public and private owners of equal to one-half of Page-of Pages the value of the territory proposed to be annexed as determined by said legislative body; and WHEREAS, said territory is contiguous to the Town of Los Gatos, and is uninhabited territory in the County of Santa Clara, and all of the procedural requirements of the annexation of Uninhabited Territory Act of 1339, particularly Government Code Sections 3530£ and 35314 inclusive have been fully complied with; NOW, THEREFORE, the said Council of the Town of Los Gatos does hereby approve the annexation of said territory, hereinafter described, to the Town of Los Gatos and does hereby further ordain that the said territory be and is hereby annexed to the Town of Los Gatos. That said territory, the annexation of which to the Town of Los Gatos is hereby approved, is all that territory situate in the County of Santa Clara, State of California, more particularly described as follows: Page of pages t Beginning at the Northeast corner of that certain parcel of land as conveyed in the Quit Claim Deed from Harry L. Marsh to Myrtle A. Marsh, recorded September 11, 1955, in Book 4170 Official Records, Page 405, Santa Clara County, said point of beginning in the Town Limits of the Town of Los Gatos; Thence, Westerly along the Northerly line of said Marsh parcel to the point of intersection of said line with the Easterly right- of-way line of the Southern Pacific Railroad Company; Thence, following the various courses and distances of the Easterly right-of-way line of the Southern Pacific Railroad Company Southerly to the point of intersection of said line with the center line of Earley Road, as the same now exists; Thence, Westerly along the center line of Farley Road and further Westerly along the Westerly prolongation of said center line of Farley Road to the point of intersection of said line with the Westerly line of San Tomas Aquino Road (Presently Santa Clara- Los Gatos Road),as the same now exists; Thence, following the various courses and distances of the Westerly line of said San Tomas Aquino Road (Santa Clara-Los Gatos Road), as the same now exists, Southerly to the point of intersection of said line with the Westerly prolongation of the center line of Shelburne Way, as the same now exists; Thence, Easterly along the Westerly prolongation of said center line of Shelburne Way, as the same now exists, and further Easterly along said center line of Shelburne Way to the point of intersection of said line with the Westerly right-of-way line of the Southern Pacific Railroad Company; Thence, following the various courses and distances of the Westerly right-of-way line of the Southern Pacific Company Southerly to the point of intersection of said line with the Town Limits line of the Town of Los Gatos; Thence, Easterly along the Town Limits line of the Town of Los Gatos to the point of intersection of said line with the Easterly right-of-way line of the Southern Pacific Railroad Company said point being also apoint in that certain parcel of land described in the Resolution approving annexation to the Town of Los Gatos Adopted and Filed by the Board of Supervisors of Santa Clara County on April 17, 1939; - 1 - • 0 Thence, following on and along the Town Limits of the Town of Los Gatos, as the same now exists, following the boundaries of the parcel of land described in said Resolution of the Board of Super- visors, N. 240 17' E., on and along said Easterly line of said right-of-way of the Southern Pacific Railroad Company, 264.00 feet to the most Westerly corner of lands now or formerly of Ray Scof ieldj Thence, following the Southerly line of lands now or formerly of Ray Scof ield, S. 76' 14' E., 540.14 feet to the most Southerly corner thereof-. Thence following the Easterly line of the lands now or formerly of.._.,R,a-fir Scofield, George Hubbell, and Minerva A. White, N. 380 48' E., 1161,60 feet, S.. 870 24' E., 212,52 feet, N. 290 51' E., 112.24 feet and N.. 120 07' E., to a point in the Southerly line of Farley Road as the same now exists; Thence, continuing on and following the various courses and distances of the Town Limits line of the Town of Los Gatos Westerly and generally Northerly to the point of beginning,.
