Ord 0555-ROBERTS ROAD NUMBER THREE ANNEXATIONORDINANCE NO. ,3-j- l AN ORDINANCE APPROVING THE ANNEXATION OF CERTAIN UNINHABITED TERRITORY, DESIGNATED "ROBERTS ROAD NUMBER THREE ANNEXATION" TO THE TOWN OF LOS GATOS THE TOWN COUNCIL OF THE TOWN OF LOS GATOS DOES ORDAIN AS FOLLOWS WHEREAS on the 6th day of September , 19 60 , the Council of the Town of Los Gatos did pass and adopt a Resolution giving notice of the proposal to annex certain uninhabited territory to the down of Los Gatos, said territory being therein designated as "ROBERTS ROAD NUMBER THREE ANNEXATION" , and said action being taken by the Council of said Town as the legislative body of the Town pursuant to a written petition therefore, said Resolution describing the boundaries of the territory so proposed to be annexed to said Town; and WHEREAS, said Resolution did contain a notice of the clay, hour and place when and where the said Council of said Town would hear protests made by any person awning real property with- in the territory proposed to be annexed, the time of said hearing being net less than twenty nor more than sixty days from the date of the passage of said Resolution, and WHEREAS, on the 17th day of October 1960 at the hour of 8:00 o'clock p.m. in the Los Gatos Council Chambers in the Town Mail of the Town of Los Gatos, County of Santa Clara, State of California, said time and place being the clay, hoar and place fixed in said Resolution for hearing protests to said annexation, the said Council of said Town did hear and pass upon all protests wade to said proposed annexation and did determine that no protests to said proposed annexation have been made by or on behalf of the owners of one-half of the value of the territory proposed to be annexed as shown by the equalized roll, nor by public and private owners of equal to one-half of Page of Pages the value of the territory proposed to be annexed as determined by said legislative body; and WHEREAS, said territory is contiguous to the Town of Los Gatos, and is uninhabited territory in the County of Santa Clara, and all of the procedural requirements of the annexation of Uninhabited Territory Act of 1939, particularly Government Code Sections 35300 and 35314 inclusive have been fully complied with; NOW, THEREFORE, the said Councii of the Town of Los Gatos does hereby approve the annexation of said territory, hereinafter described, to the Town of Los Gatos and does hereby further ordain that the said territory be and is hereby annexed to the Town of Los Gatos. That said territory, the annexation of which to the Town of Los Gatos is hereby approved, is all that territory situate in the County of Santa Clara, State of California, more particularly described as follows: Page of Pages 7 • Beginning at the Southeasterly corner of Lot 1 of the Roberts Sub- division, the Map of which was filed for record in the Office of the Recorder of the County of Santa Clara, State of California, on August 20, 1896 in Book I of Maps, at page 41, records of said County, said point of beginning being also in the Town Limits line of the Town of Los Gatos; Thence, Northerly along the Easterly lane of said Lot 1 of said Roberts Subdivision and along the Town Limits line of the Town of Los Gatos, to the point of intersection with the Southeasterly line of Roberts Road, as the same now exists, such point being the true point of beginning for this annexa- tion description; __II Proceeding thence, from said true point of beginning and continuing along the Town Limits line of the Town of Los Gatos Northwesterly across Roberts Road and across San Jose Water Works Lot 19-A to the point of inter- section of the Northerly line of said San dose dater Works Lot 19-A with the Northeasterly line of the State of California, Division of Highways Freeway Route 5 right-of-way line as the same is described in Parcel One of the Deed from Charles J. Thelan and Mary E. Thelan to the State of California, recorded January 23, 1957, in Book 3713 of Official Records, at page 389, Santa Clara County Records; Thence, following the various courses and distances of the above mentioned State of California, Division of Highways Freeway Route 5 right-of- way line and the Town Limits line of the Town of Los Gatos, in a generally Westerly direction to an angle point on said right-of-way line located approxi- mately seventy-five (75) feet Northerly from the North line of Roberts Road (¢o feet in width) and sixty (60) feet Westerly from the East line of Lot 3 of said Roberts Subdivision, as hereinbefore mentioned; Thence, Northerly along the Easterly line of said State of California Freeway Route 5 right-of-way line and along the Town Limits line of the Town of Los Gatos 850 feet MA to the point of intersection with the Southerly line of Lot 5 of the hereinbefore mentioned Roberts Subdivision; Thence, Easterly along the southerly line of said Lot 5, Roberts Subdivision and the Town Limits line of the Town of Los Gatos to the point of intersection with the Easterly line of that certain parcel of land conveyed in the Deed from Arch W. Horst, et al to Edward L. V.
