Ord 0495-REGULATING SIGNS AND OTHER ADVERTISING STRUCTURES, PROVIDING FOR PERMITS AND PROVIDING FOR EXEMPTIONS THEREFROM, AND PROVIDING FOR PENALTIES FOR THE VIOLATION THEREOFORDINANCE NO. 495
AN ORDINANCE OF THE TOWN OF LOS GATOS REGULATING
:SIGNS AND OTHER ADVERTISING STRUCTURES, PROVIDING
FOR PERMITS AND PROVIDING FOR EXEMPTIONS THEREFROM,
AND PROVIDING FOR PENALTIES FOR THE VIOLATION THEREOF.
THE TOWN COUNCIL OF THE T014N OF LOS GATOS DOES
ORDAIN AS FOLLOIWS:

Section 1. It shall be unlawful for any person, firm or
corporation to erect, place or relocate any exterior sign
or other advertising structure within the Town of Los
Gatos without first obtaining a sign permit and making
payment of the fee required by Section 4 hereof.
Section 2. Applications for Sign Permit. Application for
sign permits shall be made upon blanks provided by the
Town Clerk, and shall contain the following information:
(a) Name, address and telephone number of the
applicant and of the person for whom the sign
is to be erected or installed.
(b) Location and photograph of building, structure
or lot to which or upon which the sign or other
advertising structure is to be attached or
erected,
(c) Three copies of drawings and specifications showing
the sign and method of installation and designating
the materials to be used,
(d) List of any and all signs already on the premises,
(e) Statement that consent of owner or tenant of
premises upon which sign is to be installed or
erected, has been obtained.
Section 3. Approval by Planning Commission. No sign permit
shall be issued by the Building Inspector until such time as
the Planning Commission approves the said application.
Section 4. Permit Fees. Every applicant for a sign permit
at the time of making application therefor, shall pay to

the Town Clerk a fee of $3.00.
Section 5. Exemptions from Permits and Permit Fees. The
following signs shall be exempted from Sections 1, 2, 3
and 4:
(a) , Real Estate signs not exceeding>six (6) square feet
in area which advertises the sale, rental or lease of
the premises upon which the said sign is located; pro-
vided, however, that only one such sign shall be permitted
on the said premises unless the said premises is located
on a corner then one such sign shall be permitted facing
each street.
(b) Professional name plates not exceeding 3 square feet
in area.
(c) Bulletin Boards not over 12 sq. ft. in area for public,
charitable or religious institutions when the same is
located on the premises of said institution.
(d) A sign denoting the architect, engineer and contractors
when placed upon work under construction.
(e) Occupational signs denoting only the name and profession
of an occupant of a commercial building and not exceeding
3 sq. feet in area.
(f) Memorial signs or tablets, names of buildings and date
of erection when not in excess of 10 sq. ft. and cut
into masonry surface, or when constructed of bronze
or other non-combustible materials and installed flush
with the building.
Section 6. Any person, firm or corporation, whether as
principal, agent, employee or otherwise, violating or
causing the violation of any of the provisions of this ord-
inance shall be guilty of a misdemeanor and upon conviction
thereof shall be punishable by a fine of not more than
Five Hundred Dollars ($500.00) or by imprisonment in
the County Jail of the County of Santa Clara for a term
not exceeding six (6) months, or by both such fine and
imprisonment. Such person, firm or corporation shall
be deemed guilty of a separate offense for each and every
day during any portion of which any violation of this
ordinance is committed, continued or permitted by such
person, firm or corporation, and shall be punishable
as herein provided.
Scction.7. This Ordinance is hereby declared to be of a tempor-
ary nature and to serve only until the expiration of six
months after its effective date or prior thereto if it
is repealed in the event the Town Council of the Town of
Los Gatos shall pass and adopt a comprehensive ordinance
regulating signs and other advertising structures within
the Town of Los Gatos, except that the expiration of
this ordinance or repeal thereof shall not affect or
prevent the prosecution or punishment of any person, firm
or corporation for any act done or committed in violation
of this ordinance during the period between its effective
date and expiration or repeal.
Section 3. Constitutionality. If any section, sub-section,
sentence, clause or phrase of this Ordinance is for any
reason held to be unconstitutional, such decision shall
not affect the validity of the remaining portions of
this Ordinance. The Town Council of the Town of Los Gatos
hereby declares that it would have passed the Ordinance
and each sectinn, sub-section, sentence, clause and phrase
thereof, irrespective of the fact that any one or more
sections, sub-sections, sentences, clauses or phrases
be declared unconstitutional.
Section 9. Publication. This Ordinance shall be published once
in the LOS GATOS TINEES-SARATOGA OBSERVER.' a newspaper of
general circulation., printed and published in the Town of
Los Gatos.

The above and foregoing Ordinance was duly
and regularly introduced at a continued regular
meeting of the Town Council of the Town of Los
Gatos held on the day of I" ` 1959, and
was thereafter at a regular meeting held on the
l ` day of ' .z 1959, duly and regularly
adopted by the eollowing vote:
