AN ORDINANCE ADOPTING BY REFERENCE AND MODIFY-
ING THE 1958 E DITION OF THE UNIFORM BUILDING
CODE, VOLUME I.AND.VOLUME III,AND PROVIDING FOR
PENALTIES.
THE TOWN COUNCIL OF THE TOWN OF LOS GATOS DOES ORDAIN
AS FOLLOWS:
SECTION 1.
(a) Rules and Regulations for the erection, con-
struction, enlargement, alteration, repair, moving, removal,
conversion, demolition, occupancy, equipment, use, height,
area, and maintenance of buildings or structures, providing mini-
mum standards to safeguard life or limb, health, property, and
public welfare, by regulating and controlling the design, con-
struction, quality of materials, use occupancy, location and
maintenance of all buildings and structures and certain equip-
ment, specifically regulated therein, and providing for the
issuance of permits and collection of fees therefor, having
been printed as a code in book form, consisting of Volume I
(pages 19 to 364 inclusive), and Volume III, said Code being
entitled as follows: "Uniform Building Code 1958 Edition
Volume V and "Uniform Building Code Volume III Uniform Build-
ing Code Standards 1958 Edition," not less than three copies
of Volume I, and not less than three copies of Volume III, all
certified to be true copies by the Town Clerk of the Town of
Los Gatos, having been for at least 15 days preceding the
Public Hearing on this ordinance, and continuously since, and
are now, and shall be kept on file in the Office of the Town
Clerk of the Town of Los Gatos for public inspection thereof;
reference being hereby made to said Volume I. and Volume III

of said Uniform Building Code 1958 Edition, for all the regula-
tions, provisions, conditions, terms and requirements therein
shown, and said regulations, provisions, conditions, terms and
requirements and said Volume I, and said Volume III of said
Uniform Building Code 1958 Edition, are and each is hereby
adopted by reference and made a part hereof, the same as if
fully set forth in this ordinance and are and each is by such
reference adopted as Sections of this ordinance, bearing the
same numerical Section designations as appear in said Uniform
Building Code with exceptions as are hereinafter set forth in
Sub-section '(c)', and as such, are and each is adopted as and
for the Building Code of the Town of Los Gatos.
(b) That wherever the words 'Permit' or 'Permits'
appear in said Uniform Building Code there shall be substituted
in lieu thereof, the words "Written Permit" or "Written Permits",
and that all permits required to be issued by said Building
Code shall be in writing signed by the Building Official, or his
duly authorized deputy. Said written permits shall be issued
in triplicate, one to the applicant, one filed with the Town
Clerk, and one shall remain with the Building Inspector.
(c) (l) The following sentence is hereby added
to Section 303 (a): "Pees shall not be required for issuance
of permits for buildings erected or remodeled for and owned by the
United States of America, State of California, County of Santa
Clara, Town of Los Gatos, Los Gatos Union High School District,
Los Gatos Union elementary school district, or any other political
subdivision of the State of California."
(2) The following sentence is hereby added
to Section 303 (b): "Buildings erected or remodeled for the

United States of America, State of California, County of Santa
Clara, Town of Los Gatos, Los Gatos Union High School District,
Los Gatos Union Elementary School District, or any other politi-
cal subdivision of the State of California."
(3) Section 205 of Volume I of the Uniform..
Building Code is hereby -omitted and deleted therefrom.
(4) Whenever the words "the City" or the
word "City" is used in said,code, said words shall be held to
mean and referto the Town of Los Gatos, and whenever the words
"Building Official" are used in said code, said words shall
be held to refer to the Building Inspector of the Town of Los
Gatos appointed by the Town Council.
SECTION 2. In the case of any conflict between the terms
of said code, as adopted herein, and this ordinance, the terms
of the ordinance shall be controlling.
SECTION 3. If any section, sub-section, sentence, clause
or phrase of said code, as adopted herein, or of this ordinance,
is, for any reason, declared to be unconst.b Tonal, such decision
shall not affect the validity of the remaining portions of said
code or of this ordinance. The Town Council hereby declares that
it would have adopted said code and passed this ordinance and
each section, subsection, sentence, clause or phrase of each
irrespective of the fact that any one or more sections, sub-
sections, sentences, clauses or phrases of either, be declared
unconstitutional.
SECTION 4. It shall be unlawful for any person, firm or
corporation to erect, construct, enlarge, alter, repair, move,
improve, remove, demolish, convert, equip, use, occupy, or
maintain any building or structure or any portion of any building
or structure in the Town contrary to or in violation of any
provision of said code, as herein adopted, or of this ordinance,

or to cause, permit, or suffer the same to be done.
SECTION 5. Any person, firm or corporation violating any
of the provisions of said code, as adopted herein, or of this
ordinance, shall be deemed guilty of a misdemeanor and each such
person, firm or corporation shall be guilty of a separate offense
for each and every day, or portion thereof, during which any
violation of any of the said provisions of said code, or of this
ordinance, is committed, continued or permitted, and, upon con-
viction thereof, shall be punished by a fine of not more than
FIVE HUNDRED DOLLARS ($500.00), or by imprisonment in the Santa
Clara County Jail for not more than six (6) months, or by both
such fine and imprisonment.
SECTION 6. This Ordinance shall not be construed as
imposing upon the Town of Los Gatos any liability or responsibility
for damage resulting from defective buildings; nor shall the Town
of Los Gatos, or any official or employee thereof, be held as
assuming my such liability or responsibility by reason of the
inspection authorized thereunder.
SECTION 7. All Ordinances or parts of Ordinances in conflict
with this Ordinance are hereby repealed.
SECTION 8. This Ordinance shall be published once within
fifteen (15) days after its final passage in the "Los Gatos Times-
Saratoga observer", a newspaper of general circulation, printed
and published in the Town of Los Gatos, California..
Introduced at a regular meeting of the Town Council
of the Town of Los Gatos after a Public Hearing thereon held in the
manner and after notice given thereof as required by law, this
