BACKGROUND: The proposed annexation consists of six properties (identified by nine parcel numbers) comprising approximately 61.10 acres. A map of the proposed annexation is attached as Exhibit B of Attachment 1. In 2008, the Town almexed 75 acres in this area (ArnerichRoad No.1). The proposed annexation encompasses most ofthe remaining unincorporated land along Arnelich/Wagoer/Hicks Roads within the Urban Service Area. Section 56757 of the Cortese-Knox-Hertzberg Local Government Reorganization Act of 2000 gives the cities in Santa Clara County the authority to almex territory within the Town's Urban Service Area without application to and hearing by the Santa Clara County Local Agency Fonnation Commission (LAFCO). March 26, 2009 The subject amlexation is uninhabited because the area contains less than 12 registered voters. Staff has knowledge ofone property owner that does not consent to the subject application. Therefore, the subject aill1exation is considered a non-100% consent aooexation. A public hearing is required to hold protest proceedings for a non-1 00% consent aill1exation. There are properties within the proposed amlexation area that are under a Williamson Act Contract. These properties filed a Notice of Nonrenewal and the contract expired on JanuaJy 1, 2009 (Sepahmansour & Perzow/Leier). The parcels within the proposed aJUlexation area that were not within the Santa Clara County Fire Protection District were aill1exed into the District on March 12, 2009. DISCUSSION: A. Annexation Petition The Town has received a petition from Robelt L. Puette requesting aJUlexation to the Town of Los Gatos. Nine additional property owners have consented to and signed petitions to aill1ex .. (Eleven propcrty owners own six properties identified by nine parcel numbers). The owners of one property (Assessor's Parcel Numbers 537-17-024 and 537-17-032) that was required to be included by aJUlexation law have not consented to the aill1exation. The petition states the reason for aooexation is 'to obtain high quality services to the residences ofthe area and allow them a full voice in local govenunent' (Attachment 2). B. Location and Property The proposed aJUlexation consists of six properties comprising approximately 61.10 acres (Exhibit B of Attaclunent 1). The properties are locatcd in aJ1 unincorporated "island" of the County. In addition to the properties proposed for annexation, the Town will also be acquiring approximately 700 linear feet of Hicks Road, in confonnance with the Santa Clara County Road Annexation Policy. The properties located within the Town's Urban Services Area are contiguous to a Town boundaJY, alld are pre-zoned HR-20 (Hillside Residential, 20 to 160 acres for each dwelling unit) and RC (Resource Conservation). Annexation will allow Town services to be extended to the properties alld help fill all existing County "island." C. Process The propelty owners of Assessor's Parcel Numbers 537-17-024 alld -032, Mr. & Mrs. Kokinos, do not consent to the subject aill1exation (Attachment 3). Therefore, the subject aooexation is considered a non-l00% consent annexation. A public hearing is required to hold protest proceedings for non-I00% consent annexations. March 26, 2009 Staffmet with the Local Agency Fonnation Commission (LAFCO) and the County Surveyor to detelmine if the Kokinos property could be excluded from the subject annexation. If the proposed almexation was approved without the inclusion ofthe Kokinos propeliy, the Kokinos . property would be sUlTounded on all sides byTownjurisdiction. The Cortese-Knox-Hertzberg Local Government Reorganization Act of 2000 states that an annexation proposal shall not create islands of one jurisdiction surrounded by another jurisdiction. Therefore, the propeliy owned by Kokinos must be included in this annexation to prevent the creation of an island. The protest proceeding has been scheduled for May 4, 2009. Any propeliy owner of the affected territory must submit written statements of protest by the conclusion of the protest proceeding. Within 30 days ofthe protest proceedings, the Council shall detennine the value ofwritten protests filed and not withdrawn. The detennination ofvalue may be made on May 4, 2009 or set for a future Town Council agenda. If the value of lalld within the affected telTitory owned by those protesting the annexation is less than 50% of the value of the entire territory to be annexed, the Council shall order the annexation without election. Ifthe value of land within the affected territory owned by those protesting the annexation is 50% or more of the value of the entire tenitory proposed to be annexed, the Council shall abandon the annexation. D. Value Although the Council will not make detenninations on property value until the protest' proceeding concludes, a table of the cunent value is provided in Attachment 4. The value of the entire area to be annexed is $10,743,511.00 (2008-09 tax roll). The value ofthe property owned by Kokinos is $1,149,561.00, or 10.7% of the entire area. ENVIRONMENTAL ASSESSMENTS: Almexation of the subject property is exempt for the California Environmental Quality Act guidelines, pursuant to Section l5061(b)(3). FISCAL IMPACT: The following fees are assessed by Santa Clara County, LAFCO and the State Board ofEqualization, and must be paid by the petitioner: Map, Legal Description and Guideline Checking Fees $2,000 (paid) LAFCO Processing Fee $1,103 (not paid) State Board of Equalization Fee $1,500 (not paid) The petitioner has also paid an Annexation Fee to the Town of $415.00.
