Open and hold the public hearing. 2. Close the public hearing. 3. Adopt the resolution continuing certain department fees, rates and charges, and amending certain fees, rates, and charges. BACKGROUND: The Town of Los Gatos' financial policies require that certain fees, rates and charges for services be maintained to provide for cost recovery based on the cost to the Town. In order to comply with this mandate, staff periodically reviews the cost of providing such services and recommends appropriate increases in fees supported by cost data. For development-related fees, the California Government Code requires a 60-day waiting period between the approval of a Resolution adopting the fees and the implementation of such fees. As the Town's proposed FY 2009/10 Fee Schedule contains a number of development-related fee changes, staff recommends an effective date of July I, 2009 (85 days) for implementing all fees contained in the proposed Fee Schedule. Staffbased the proposed FY 2009/10 Fee Schedule on the comprehensive fee study that was prepared by Public Resource Management, Inc, (PRM) as part of the FY 2005/06 fee update. Staff first reviewed all fees charged by the Town for various departmental services and for private development activity, and then used cunent costs to update the Town's cost of service "baseline" data established by PRM. Building permit fees were increased by 4.6% based on the February Building Cost Index (BCI). It is anticipated that these increases better reflect the cost of service delivery in FY 2009/10. Below is a summary of proposed or modified FY 2009/10 fees, other than those increased by CPIIBCI: Administrative Fees • The proposed increase for the return check fee is based on the California Civil Code Section l719(a) (I) and closely matches other municipal agencies. Development Services • General Development Services Fees. The proposed Engineering Review Service Fee has been adjusted to better reflect costs associated with reviewing complex, development-related projects. This fee would increase from 7.25% to 10% for all applicable dcvclopment applications. The building review percentage will remain at 7.25%. • Planning and Building Division Fees. In addition to the Consumer Price Index (CPI) and the Building Code Index (BCI), an increase of 5% will be charged to plamling and building fees to rccover overhead costs. The overhead costs are due to significant increases in salmy and benefits as a result of higher annual actuarial costs for GASB 45 post retirement medical costs effectivc FY 2008/09 and a 3% increase in miscellaneous employees' employer rates charged by PERS. Since FY 2004/05, these rates have cumulatively increased over 7%. • Engineering Division Fees. An increase in several engineering fees has been proposed to more accurately reflect thc cost of project review and tmcking. The encroaclmlent permit fee, for example, will increase from $200 to $220. Based on an informal survey of cities in Santa Clara County, Los Gatos' encroaclunent permit fee is the lowest in the area. Community Services • With the exception of grammatical changes, no additional changes me proposed for the Community Service schedule of fees. Library Fees and Fines • There are no proposed changes to the Library schedule of fees. The Replacement of a Single Cassette £i'om Audio Book fee has been deleted as it is no longer applicable. Parks and l'ublic Worl{s • Parks Division Fees. Proposed Fees for the Parks program have been revised to better refleet the cost of service delivery, although the level of recovery remains below the true cost of pmk services. The Park Use Permit fee would increase from $75 to $95 for residents and $100 to $125 for non-residents. Other proposed changes include an increase in Oak Meadow Park non-resident parking fees from $5 to $6 per car, which is comparable to the Santa Clara County Vasona Park parking fee. The hourly rate to use park facilities (i.e. Oak Meadow Park Bandstand and Pageant Grounds) would increase by an average of $1 0 per reservation. Police Fees and Fines • There m'e two new proposed fees for the Police Department schedule of fees. The first fee is a Firearms Storage Fee for the intake and storage of seized or impounded weapons as a rcsult of a protective order or arrest for domestic violence. The State Pcnal Code allows cities, counties, and state agencics to impose a chargc equal to the administrative cost associated with the impound or storagc of weapons duc to protective order or domestic violencc. Firearms that are seized as evidencc or surrendered for destruction are not subject to the fee. Thc fee would be $75 per firearm and additional $1 per day the firemm is stored. The second fee is an Annual Alarm Registration Fee to recover the cost of tracking and updating contact information for the efficient response to rcsidential and commercial false alarm service calls. The registration fee would be $30 for residential alarms mld $50 for commcrcial alarms. The registration of alarms would be required annually in January of each calendm' year. Implementation of this fee will require a modification of the Town Code rcgarding alarms which will be addressed within the next fiscal year. Separate new fees for taxicab mld towing services may be recommended as part of the Proposed Budget in May following staff's review ofthese issues. CONCLUSION: It is recOlmnended that Town Council approve thc attached adjustments to the Town Fee Schedule effective July I, 2009. ENVIRONMENTAL ASSESSMENT: The Town's fee resolution is is not a project subject to CEQA. FISCAL IMPACT: The Town's financial policies require that fees be maintained to provide for the recovery of costs associated with Town services. The proposed new fees better represent thc cost to deliver services and thus, decrease the Town's subsidy of private activity. Staff will incOlporate the estimated revenue increases into the Town's FY 2009/10 Opcrating and Capital Budget using conscrvative activity projections. Attachments: 1. Resolution 2. Up to ten percent (10%) shall be retained for related administrative eosts and for code enforcement education. 11 DEVELOPMENT SERVICES Planning Division The fees listed below constitute all fees imposed by the Planning Division. Certain types of applications must be reviewed /processed by other departments/agencies, which may impose separate fees. Applicants are advised that the fees for those services are not included in the Planning Department's fees. Where the term "actual cost" is used here, it shall mean: materials, supplies (including any costs ofnoticing or publication), outside consultants, employee cost will be billed at the top step, plus benefits, plus overhead. The following fee schedule is established for applications filed pursuant to the Town Code. The fees are collected bythe CommunityDevelopment Department at the time the application is filed unless otherwise noted. Fees for Additional Processing In the event additional processing services by the Town are required due to changes, modifications, additions, errors, omissions, or discrepancies caused by the applicant or hislher agents or representatives, the applicant shall pay an additional fee as determined by the Director ofCommunity Development to cover the actual cost. Fees for Lack of Progress If additional information is required by the Town for an application and the requested information is not submitted within 180 days, the applicant will be required to pay a fee of 10 percent of the current application fee at the time the requested information is submitted. Any re-submittal after one year will be processed as a new application, subj ect to new fees. Fees for Major Projects If it is anticipated that the application processing costs of selected major projects will significantly exceed the following fees, the Director of Community Development may collect a deposit and charge actual time spent to process the applications based upon current hourly rates.
