RECOMMENDATION: 1. Adopt a resolution authorizing application for Proposition IB Local Streets and Roads Funds for FY 2008/09. 2. Upon confmnation of State approval, authorize transfer
of funding from Street Repair & Resurfacing (411-811-9901) to appropriate Proposition IB funds to the Curb, Gutter, and Sidewalk Replacement Project (411-813-9921). BACKGROUND: A 2008
State Budget Act (AB 88) has made an additional $187 million in Proposition lB funds available to cities on a first-come, first serve basis, for FY 2008/09. Each city can apply for a

It is a requirement of Prop 1B that a resolution be adopted and the funds being requested are part of an approved budget plan. DISCUSSION: Prop lB was instituted in November 2006 as
part of the statewide infrastructure bond package. ProplB is the transportation portion, out of which funds were dedicated to cities and counties for local streets and roads. These funds
can be used for street pavement maintenance, traffic congestion reliefprojects, transit facility improvements, safety projects, or as local match for state and federal funded projects.
The Town received $472,992 in FY 2007/08, which were used for street repair and resurfacing projects during that period. These projects were approved by Council under the adopted FY
2008/09-2012/13 Capital Improvement Program budget. The State Controller's Office has allocated $437,175 in Prop 1B funds to the Town for FY 2008/09. Ifthe ProplB funding is appropriated,
these funds will be allocated to the Curb, Gutter, and Sidewalk Replacement Project for concrete repair and replacement. The repair and replacement ofhazardous curbs, gutters, and sidewalks
throughout the Town is an on-going issue and maintenance resources are limited. The Prop 1B funds have been budgeted in the FY 2008/09 budget under the Street Repair and Resurfacing
Project and will be transferred to Curb, Gutter, and Sidewalk to allow the Town to enhance pedestrian and bicyclist safety and comfort, and improve water runoff. The monies received
from Prop 1B will fund a concrete and repair replacement project in the residential streets adjacent to, and including Cmnino del Cerro Road, in between Los GatosAlmaden Road and Blossom
Hill Roads. These residential streets have received only spot and patch repairs over the last several years, and are in need of a more neighborhood-wide concrete repair and replacement
project. Furthennore, this area had been identified by staff as one of the areas needing concrete repair and replacement, and is next on the priority list for such a proj ect. The main
reason this area qualifies for this project is a combination of old and deteriorated curbs and sidewalks, in addition to large trees and over growth of roots throughout the neighborhood.
In order for the Town to apply for the Prop1B funds, the Council must adopt a resolution accepting a plan for the use of these funds. CONCLUSION: It is recommended that the Council adopt
the attached Resolution authorizing application for . Prop1B Local Streets and Roads funds for FY 2008/09 and transfer funding from Street Repair & Resurfacing (411-811-9901) and appropriate
these funds to the Curb, Gutter, and Sidewalk Replacement Project (411-813-9921).

of the attached resolution is not a project defIned under CEQA, and no further action is required. FISCAL IMPACT: The signing of this Resolution will allow the Town to apply for ProplB
allocated funding in the amount of $437,175. The funds, if approved by the State, will be allocated to the Cmb, Gutter, and Sidewalk Replacement Account 411-813-9921. Attachments: 1.

RESOLUTION OF THE TOWN COUNCIL OF LOS GATOS AUTHORIZING APPLICATION FOR PROPOSITION IB LOCAL STREETS AND ROADS FUNDS FOR FY 2008/09 AND APPROVING USE OF THE FY 2008/09 PROPOSITION IB
FUNDS WHEREAS, the Town of Los Gatos (Town) is eligible to apply for additional Proposition IB funding for local street and maintenance; and WHEREAS, the Town received its full allocation
for FY 2007/08 and submitted an approved plan to the State Department ofFinance for use of those funds; and WHEREAS, if the FY 2008/09 Proposition IE fund are received, the Proposition
IE funds will be encumbered prior to July, I, 2009; and WHEREAS, the Town agrees that the funds from FY 2008/09 allocation will be used for projects that are not cUlTently fully funded
with a dedicated funding source or sources; and WHEREAS, the Town will report the use of FY 2008/09 Proposition IB funds to the State of California Department of Finance by the requested
time; and NOW, THEREFORE BE IT RESOLVED that the Town Council of the Town of Los Gatos Town authorizes application for Proposition IB Local Streets and Roads Funds for FY 2008/09 and
approves the Town's plan for use of its Proposition IE funds. PASSED AND ADOPTED at a regular meeting of the Town Council of the Town of Los Gatos, California, held on the 2nd day of
