Open and hold the public hearing and receive public testimony. 2. Close the public hearing. 3. Make the required findings (Attachment 1) and approve the modification to the Conditional Use Permit application U-08-015 subject to conditions (Attachment 2) (motion required). 4. Refer to the Town Attorney for the preparation of the appropriate resolution (no motion required). BACKGROUND: The subject site is located on the east side of North Santa Cruz Avenue, north of Highway 9 in the Los Gatos Shopping Center. The existing Use Permit for a high turnover sit down restaurant (Aldo's Deli) was approved by the D evelopment Review Committee in May of 2007. The approval included a 22 seat restaurant with maximum operating hours of 11 AM to 9 PM daily. The applicant would like to modify the Use Permit to include beer and wine service and the ability to seasonally locate 2 of the 22 approved seats in the existing outdoor patio area to be shared by Starbucks. No alcohol will be permitted in the outdoor seating area. On November 12, 2008, the Planning Commission considered the subject application and voted 6-0 to recommend approval of the proposed modifications to the existing CUP with the recommended conditions. SANTA CRUZ AVE, FILE # U-08-015 December 9, 2008 DISCUSSION Project Summary: The applicant is requesting approval to modify the existing CUP to allow beer and wine service. The applicant is also applying to seasonally locate two of the 22 approved seats in the existing outdoor seating area. Alcohol Polic : The Town's Alcohol Policy requires any change in the service of alcoholic beverages to be approved by the Town Council. The request complies with the requirements of the Town Alcohol Policy. PLANNING COMMISSION ACTION The Planning Commission voted 6-0 to recommend approval of the request with the modified conditions of approval recommended by staff. The Commissioners only concerns were in relation to the implementation of the outdoor seating and the number of teens that linger in the vicinity. The Commissioners believed the business owner's long tern management of Aldo's Restaurant at Winchester and Knowles showed an understanding and respect for the Town's alcohol policy. Attachment 3 is a verbatim transcript of the Commission's discussion. FISCAL IMPACT: None CONCLUSION: If the Council decides to approve the modifications to the CUP, it should make the required findings specified in Attachment 1, and approve the application, subject to the conditions in Attachment 2. APN: 529-07-094 PROPERTY OWNER: Los Gatos Shopping Center LLC APPLICANT: Barbara Lonsbury TO THE SATISFACTION OF THE PLANNING DIRECTOR: (Planning Section) 1. APPROVAL: This application shall be completed in accordance with all of the conditions of approval listed below and in substantial compliance with the plans approved and noted as received by the Town on June 23, 2008. Any changes or modifications to the approved plans and/or business operation shall be approved by the Community Development Director or the Planning Commission/Town Council, depending on the scope of the changes. 2. EXPIRATION OF APPROVAL: The Conditional Use Permit will expire two years from the date of approval unless it is used before expiration. Section 29.20.335 defines what constitutes the use of an approval granted under the Zoning Ordinance. 3. USE: The approved use is a high turn over sit down restaurant. 4. HOURS OF OPERATION: Hours of operation shall not exceed 11:00 am to 9:00 pm daily. 5. SEATING: A maximum of twenty two (22) seats are allowed inclusive of indoor and outdoor seating. A maximum of two seats may be placed in the outdoor seating area adjacent to 442 North Santa Cruz Avenue. 6. OUTDOOR SEATING: The outdoor seating shall be approved by Town staff prior to installation to ensure that the furniture is complimentary to the existing Starbucks furniture, but will be easily distinguished for patron use. There shall be no alcohol permitted in the outdoor seating area. 7. ACCESSIBLE SEATING: The applicant shall provide accessible seating which complies with current building codes. 8. ALCOHOL SERVICE: The service of alcoholic beverages is permitted only with meals. A meal is defined as a combination of food items selected from a menu (breakfast, brunch, lunch, or dinner). Appetizers such as popcorn, nachos, pretzels, potato skins, relish trays, etc. (hot or cold) are not meals. No "off sale" of alcohol beverages is permitted. 9. TAKE OUT: Take out food shall be served in recycled material containers. 10. UTENSILS: All beverages and food served on site shall be served on reusable materials. 11. LIVE ENTERTAINMENT: No live entertaimnent shall be provided unless the applicant receives future approval of live entertainment. ATTACHMENT 2 440 North Santa Cruz / U-08-015 December 15, 2008 12. ONE YEAR REVIEW: Town staff shall review the Conditional Use Permit within one year from approval to determine if there are any problems associated with the Permit and report their findings to the Planning Commission. The Planning Commission may direct that a public hearing be held to review the permit as specified in Section 29.20.3 10 of the Town Code. 13. LAPSE FOR DISCONTINUANCE: If the activity for which the Conditional Use Permit has been granted is discontinued for a period of one (1) year, the approval lapses pursuant to Section 29.20.340 of the Zoning Ordinance. 14. TOWN INDEMNITY: Applicants are notified that Town Code Section 1. 10.115 requires that any applicant who receives a permit or entitlement from the Town shall defend, indemnify, and hold harmless the Town and its officials in any action brought by a third party to overturn, set aside, or void the permit or entitlement. This requirement is a condition of approval of all such permits and entitlements whether or not expressly set forth in the approval. TO THE SATISFACTION OF THE CHIEF OF POLICE: 15. UNIFORMED SECURITY: Uniformed privately provided security guards may be required in or around the premises by the Chief of Police if alcohol related problems recur that arc not resolved by the licensed owner. 16. CONSULTATION AND TRAINING: At the discretion of the Chief of Police, periodic meetings will be conducted with representatives from the Police Department for on-going employee training on alcoholic beverage service to the general public. 17. TRAINING MANUAL: The restaurant operator shall use an employee trailing manual that addresses alcoholic beverage service consistent with the standards of the California Restaurant Association. 18. DESIGNATED DRIVER PROGRAM: The restaurant operator shall actively promote a designated driver program such as complimentary non-alcoholic beverages for designated drivers. 19. Floor plan received October 28, 2008 (one page) BACKGROUND: The subject site is located on the east side of North Santa Cruz Avenue approximately 500 ft north of Los Gatos-Saratoga Road. The current Conditional Use Permit (CUP) was approved by the Development Review Committee on May 15, 2007. The Permit established a minor restaurant with 22 seats and operating hours of 11 AM to 9 PM daily. PROJECT DESCRIPTION: The applicant is requesting approval to modify the existing CUP to allow beer and wine service with meals. They would also like to be able to offer two seats outdoors in the defined patio space along with Starbucks. These two seats would be in lieu of two indoor seats. Alcohol will not be permitted outside the restaurant. ANALYSIS : A. Alcohol Polite The Town's Alcohol Policy requires any change in the service of alcoholic beverages to be approved by the Town Council. The request complies with the requirements of the Town Alcohol Policy. The Police Department has reviewed the application, and had no concerns specific to this application. However, based on the Police's past experiences of dealing with transients and alcohol use within the area, a condition was included that staff would review the application within one year of approval to ensure there are no problems associated with the permit. B, Traffic and Parking There is no proposed intensification of the existing use, therefore, traffic and parking will not be impacted by this application. APPROVAL: This application shall be completed in accordance with all of the conditions of approval listed below and in substantial compliance with the plans approved and noted as received by the Town on June 23, 2008. Any changes or modifications to the approved plans and/or business operation shall be approved by the Community Development Director or the Planning Commission, depending on the scope of the changes. 2. EXPIRATION OF APPROVAL: The Conditional Use Permit will expire two years from the date of approval unless it is used before expiration. Section 29.20.335 defines what constitutes the use of an approval granted under the Zoning Ordinance. 3. USE: The. approved use is a high turn over sit down restaurant. 4. A maximum of two seats may be placed in the outdoor seating area adjacent to 442 North Santa Cruz Avenue. 6. OUTDOOR SEATING: There shall be no alcohol permitted in the outdoor seats. 7. ALCOHOL SI~RVICE: The service of alcoholic beverages is permitted only with meals. A meal is defined as a combination of food items selected from a menu (breakfast, brunch, lunch, or dinner). Appetizers such as popcorn, nachos, pretzels, potato skins, relish trays, etc. (hot or cold) are not meals. No "Off sale" of alcohol beverages is permitted. 8. TAKE OUT: Take out food shall be served in recycled material containers. 9. UTENSILS: All beverages and food served on site shall be served on reusable materials. 10. LIVE ENTERTAINMENT: No live entertainment shall be provided unless the applicant receives future approval of live entertainment. 11. ONE YEAR REVIEW: Town staff shall review the Conditional Use Permit within one year from approval to determine if there are any problems associated with the Permit and report their findings to the Planning Commission. The Planning Commission may direct that a public hearing be held to review the permit as specified in Section 29.20.3 10 of the "Down Code. LAPSE FOR DISCONTINUANCE: If the activity for which the Conditional Use Permit has been granted is discontinued for a period of one (1) year, the approval lapses pursuant to Section 29.20.340 of the Zoning Ordinance. 13. TOWN INDEMNITY: Applicants are notified that Town Code Section 1.10.115 requires that any applicant who receives a permit or entitlement from the Town shall defend, indemnify, and hold harmless the Town and its officials in any action brought by a third party to overturn, set aside, or void the permit or entitlement. This requirement is a condition of approval of all such permits and entitlements whether or not expressly set forth in the approval. TO THE SATISFACTION OF THE CHIEF OF POLICE: 14. UNIFORMED SECURITY: Uniformed privately provided security guards may be required in or around the premises by the Chief of Police if alcohol related problems recur that are not resolved by the licensed owner, 15. CONSULTATION AND TRAINING: At the discretion of the Chief of Police, periodic meetings will be conducted with representatives from the Police Department for on-going employee training on alcoholic beverage service to the general public. 16. TRAINING MANUAL: The restaurant operator shall use an employee training manual that addresses alcoholic beverage service consistent with the standards of the California Restaurant Association. 17. DESIGNATED DRIVER PROGRAM: The restaurant operator shall actively promote a designated driver program such as complimentary non-alcoholic beverages for designated drivers. 18. BACKWATER VALVE: The scope of this project may require the installation of a sanitary sewer backwater valve per Town Ordinance 6.50.025. The fee shall be paid before the building permit is issued, The traffic impact mitigation fee for this project, using the current fee schedule and the preliminary plans is $ 8,621.61. This fee estimate is based on conversion of 1,679 square feet of specialty retail space to high turnover sit-down restaurant use with 22 seats, resulting in an average daily traffic increase of 31.85 trips, and a PM peak hour increase of 4.69 trips. The final fee shall be calculated from the final plans using the rate schedule in effect at the time of the building permit application, using a trip generation rate based on high turnover sit-down restaurant use. 18. Aldo's Ristorante & Bar has operated in Los Gatos since 1999 with a full liquor license and has never had any complaints or problems or charges against it regarding alcohol. 7.
