SUBJECT: ADOPT RESOLUTION DECLARING THE RESULTS OF THE
PRESIDENTIAL PRIMARY ELECTION HELD FEBRUARY 5, 2008
RECOMMENDATION:
Adopt a resolution declaring the results of the Presidential Primary Election held February 5,
2008 in Los Gatos.
BACKGROUND & DISCUSSION:
On February 5, 2008, a Presidential Primary Election was held and conducted in the Town of
Los Gatos. The State of California requires counties, cities, and towns to declare the results of
all elections held in their respective jurisdictions by resolution. The attached resolution declares
the election results as certified by the Santa Clara County Registrar of Voters for two ballot
initiates: Measure C and Measure D. Exhibit A of the attached resolution includes Certificate of
the Election Results from the Santa Clara County Registrar of Voters for each measure and a
summary of votes cast.
FISCAL IMPACT:
The cost of the February 5, 2008 election is anticipated to be $65,000. Funds were budgeted for
this expense in FY2007/08 Operating Budget.

RESOLUTION NO.
A RESOLUTION OF THE TOWN COUNCIL OF THE TOWN OF LOS GATOS,
CALIFORNIA, DECLARING THE RESULTS OF THE PRESIDENTIAL PRIMARY
ELECTION HELD FEBRUARY 5, 2008
WHEREAS, a Presidential Primary Election was held and conducted in the Town of Los
Gatos, California, on Tuesday, February 5, 2007 as required by law; and
WHEREAS, pursuant to State statute, the Santa Clara County Registrar of Voters has
canvassed the returns of the election as required by the provisions of the laws of the State of
California related to general law cities; and
WHEREAS, the Santa Clara County Registrar of Voters has certified the results of the
February 5, 2008 Presidential Primary Election to this Town Council, including a summary of votes
cast which has been attached and made a part hereof as "Exhibit A."
NOW THEREFORE THE TOWN COUNCIL OF THE TOWN OF LOS GATOS
DOES RESOLVE, DECLARE, DETERMINE, AND ORDER AS SHOWN ON EXHIBIT A:
SECTION 1: That the total whole number of ballots cast in the City was 16,846.
That the measures voted upon at the election are as follows:
Measure C: Shall the offices of Town Clerk and Town Treasurer be appointive?
Measure D: Shall the Town of Los Gatos be required to construct and operate a
skate park for the free use of its citizens on its Miles Avenue property, generally
conforming with plans and specifications approved by the Town, the one-time cost to
design and construct not to exceed $1,000,000, paid from existing Town funds, the
annual operating cost not to exceed $50,000, said costs to be reduced by any valuable
contributions made by others?
SECTION 2: That the number of votes given at each precinct and the number of votes given in
the Town for and against each measure named above is as listed in the attached
Exhibit A.
SECTION 3: That as a result of the election, a majority of the voters voting on Measure C
related to making the office of the Town Clerk and Town Treasurer appointive voted
in favor of the measure and therefore shall be deemed adopted and ratified.
That as a result of the election, a majority of the voters voting on Measure D
related to the construction and operation of a skate park did not vote in favor of it
and therefore the measure was not carried and shall not be deemed adopted and
ratified.
SECTION 4: The Clerk Administrator shall enter on the records of the Town Council of the Town
of Los Gatos, a statement of the result of the election, showing: (1) the whole number
of votes (ballots) cast in the City; (2) the measures voted upon: (3) the total number
of votes given for and against each measure. Said information is set forth in this
Resolution and the documentation attached hereto as Exhibit A.
SECTION 5: That the Clerk Administrator shall certify to the passage and adoption of this
resolution and enter upon the records of the Town Council of said Presidential
Primary Election.
