AND ACCEPT NEW REPLACEMENT EASEMENTS AT 150 WINCHESTER
CIRCLE (FORMERLY 14300 WINCHESTER BOULEVARD)
RECOMMENDATION:
Adopt resolution to abandon portions of an easement and accept new replacement easements at
150 Winchester Circle (formerly 14300 Winchester Boulevard).
BACKGROUND:
The developer, Sobrato Development Companies, requested approval of a planned development
subdivision on the northeast corner of Winchester Boulevard and Highway 85, and on May 3,
2004, the Town Council approved the Planned Development Ordinance (Ordinance 2130). The
Tentative Map (M-04-008) was approved by the Development Review Committee on May 25,
2004. The final map (Tract No. 9620) was approved by Council on October 18, 2004 (Resolution
2004-123) and recorded February 4, 2005. A Lot Line adjustment application M-07-14 was
approved by the Development Review Committee February 6, 2007.
DISCUSSION:
Tract No. 9620 created four (4) lots for commercial use and 290 condominium dwellings on
approximately 12.2 acres of land located on the northeast corner of Winchester Boulevard and
Highway 85. Lot 2 of Tract No. 9620 originally corresponded to the footprint of the second
Netflix building at 150 Winchester Circle. A public service easement was provided adjacent to
the Lot 2 boundary.

The developer requested minor modifications to the Lot 2 building that required adjustment of
the adjacent property and easement boundaries. Easement abandonment was required in
locations where building modifications extended beyond the original building limits, and
additional public service easement dedications were required where building boundaries
retreated to locations within the original building boundaries. The Lot 2 boundaries were
adjusted to match the revised footprint of the second Netflix building.
The adoption of this resolution is needed to approve the abandonment of portions of an easement
and to accept new replacement easements at 150 Winchester Circle (formerly 14300 Winchester
Boulevard).
ENVIRONMENTAL ASSESSMENT:
An Environmental Impact Report (EIR) was prepared for the project and was certified by the
Town Council on February 4, 2002. An Addendum to the EIR was subsequently prepared and
was accepted by Council on April 23, 2004. No additional environmental review is required for
the lot line adjustment, easement abandonment, or easement acceptance.
FISCAL IMPACT:
The developer, Sobrato Development Companies, has paid the following fees:
1. Lot Line Adjustment fee $1,264.50 (paid)
2. Abandon Excess Public Easement fee $2,095.00 (paid)

RESOLUTION OF THE TOWN COUNCIL
OF THE TOWN OF LOS GATOS
TO ABANDON PORTIONS OF
EASEMENT AND ACCEPT NEW REPLACEMENT EASEMENTS
AT 150 WINCHESTER CIRCLE
(FORMERLY 14300 WINCHESTER BOULEVARD)
WHEREAS, on February 6, 2007, the Development Review Committee of the Town of
Los Gatos approved the Lot Line Adjustment Application M-07-014 with conditions; and
WHEREAS, the Owner or Subdivider has complied with the conditions of Lot Line
Adjustment Application M -07-014.
NOW, THEREFORE, IT IS RESOLVED that the certain Parcel Map For Lot Line
Adjustment Purposes in the Town of Los Gatos, dated November 2007, and prepared by Kier &
Wright, for approval by the Town Engineer of the Town of Los Gatos, is hereby approved; and
all offers of easements for public use, and all public service easement abandonment therein made
on said Map are hereby accepted.
PASSED AND ADOPTED at a regular meeting of the Town Council held on the 3`d day
