BACKGROUND:
On July 28, 2004, the Planning Commission approved a Conditional Use Permit (CUP) for a high-
turnover, sit-down restaurant (Main Street Burgers) within the Lyndon Plaza. Main Street has been
operating in this location since May 2005.
On October 27, 2004, the Commission approved a modification to the CUP to allow an outdoor
dining area for the joint use of Main Street and Cold Stone Creamery. The existing conditions of
approval are included as Exhibit C to Attachment 6.

On April 25, 2007 the Planning Commission considered the subject application and voted
unanimously to recommend denial based on concerns about how the outdoor patio would be policed
and the potential for minors to obtain alcohol.
DISCUSSION:
Project Summary:
The applicant is requesting approval of an alcohol license for service of beer and wine in conjunction
with food service for an existing restaurant. The applicant submitted a letter providing background
on the restaurant approval and operation and explaining the rationale behind the request (see Exhibit
E of Attachment 6). The applicant also owns and operates Willow Street Pizza and points to an
established record of responsible service of alcohol for that restaurant. The applicant intends to
incorporate the same responsible service of alcoholic beverages into the operation of Main Street
Burgers.
Exhibit F of Attachment 6 includes news articles about the restaurant and other similar types of
restaurants as well as a list of high turnover sit down restaurants in the Downtown and which have
approval for service of alcoholic beverages.
The applicant submitted a petition signed by over 500 people in support of the request to provide
beer and wine at Main Street Burgers. The petition is available for review in the project file in the
Community Development Department.
The Police Department does not have any concerns about the present business operation or the
proposed service of beer and wine. When reviewing requests, the department considers the
following:
• The type of restaurant
• Presence of a stand alone or separate bar
• Calls for service (for existing establishments)
Alcohol Policy
The Town's Alcohol Policy requires any change in the service of alcoholic beverages to be approved
by the Town Council. The Council reviews CUP requests for new alcohol service on a case by case
basis. New alcohol service in the Downtown has been an issue and the Commission and Council
have carefully reviewed applications to ensure that the request is appropriate for the specific
restaurant and its location.

The request for alcohol service is consistent with the general policies in Section II of the Alcohol
Policy and the specific policy in Section IV (see Exhibit G of Attachment 6). The Alcohol Policy
requires specific findings to be made for service of alcohol past 10:00 pm, as follows:
6. The deciding body shall make the following findings prior to approving an application
for conditional use permit to serve alcoholic beverages past l OPM:
A. Late night service will not adversely impact adjacent residential neighborhoods.
B. The applicant does not have a history of complaints and non-compliance with local
ordinances or the Alcoholic Beverage Policy.
C. The applicant has demonstrated a clear benefit to the community.
The applicant's existing CUP allows the restaurant to stay open until 11:00 pm although the
restaurant currently closes at 10:00 pm. Unless the above findings can be made, the restaurant hours
should be restricted to 10:00 pm or the service of beer and wine should not be allowed past 10:00
pm. The Commission did not address this question in its recommendation.
The request for service of beer and wine conforms with the following aspects of the Alcohol Policy:
• The restaurant will not have a stand alone or separate bar.
• There will be no entertainment provided at the restaurant.
• The CUP conditions of approval include conditions recommended by the Police
Department for the service of alcohol.
• Alcohol will only be served with meals.
• Service of alcohol in the outdoor patio is separated from public areas with a physical
barrier and will be separated from outdoor seating used by Cold Stone Creamery.
Patio Seating
Patrons will order beer or wine with their food and can choose to sit inside the restaurant or in the
patio. The outdoor seating is shared by Main Street Burgers and Cold Stone Creamery. The Police
Department does not have any concerns about service of alcohol within the outdoor seating area as it
currently exists. However, when Alcohol Beverage Control (ABC) issues a license for outdoor
seating, it is required to be for a designated area that must be separated from other uses and areas
used by the general public. A portion of the patio will be designated for consumption of beer and
wine and a barrier will be needed to separate it from areas used by patrons of Cold Stone. The
applicant submitted a site plan showing the proposed division of the patio (see Attachment 3).
Condition #17 requires the patio to be modified as necessary to meet ABC requirements. If
approved, staff can work with the applicant to ensure the proposed fencing ties in with the existing
patio and complies with the Commercial Design Guidelines.

PLANNING COMMISSION ACTION:
The Planning Commission voted 4-2 to recommend denial of the request for beer & wine service.
Commissioners were concerned with that the lack of visibility from the restaurant to the patio limited
the restaurant's ability to supervise the patio area. Commissioners were also concerned with the
potential for minors to obtain alcoholic beverages. Commissioners commented that the restaurant is
seen as a youth friendly facility which conflicts with service of alcohol. Commissioners asked for
Council's guidance on parameters for evaluation of future applications for alcohol service in the
Downtown and for similar type restaurants to Main Street Burgers (high turnover sit-down).
Attachment 4 is a verbatim transcript of the Commission's discussion.
FISCAL IMPACT: None
CONCLUSION:
If the Council decides to approve the modifications to the CUP modification, it should make the
required findings and considerations specified in Attachment 1, and approve the applications, subject
to the conditions in Attachment 2.

Planning Division
1. APPROVAL: This application shall be completed in accordance with all of the
conditions of approval listed below and in substantial compliance with the plans noted as
received by the Town on December 5, 2006 and approved by the Town Council on
March 5, 2007. Any changes or modifications to the approved plans and/or business
operation shall be approved by the Community Development Director or the Planning
Commission, depending on the scope of the changes.
2. EXPIRATION OF APPROVAL: The Conditional Use Permit application will expire
two years from the date of approval unless it is used before expiration. Section 29.20.335
defines what constitutes the use of an approval granted under the Zoning Ordinance.
3. BUSINESS OPERATION. This approval is for a quality restaurant use, and is restricted
to the areas shown on the approved plans. Any change in the type of business requires
modification of the Conditional Use Permit.
4. HOURS OF OPERATION. Hours of operation are limited to 7:00 am to 11:00 pm daily.
5. SEATS. The maximum number of seats is 44 (26 indoors and 18 outdoors).
6. ALCOHOL SERVICE. The service of beer and wine is permitted only with meals. A
meal is defined as a combination of food items selected from a menu (breakfast, brunch,
lunch, or dinner). Appetizers such as popcorn, nachos, pretzels, potato skins, relish trays,
etc. (hot or cold) are not meals. There shall be no separate bar for the restaurant.
7. ALCOHOL LICENSE: The applicant shall have an ABC license issued as required by
that agency for alcohol service for all service features of the restaurant.
8. LIVE ENTERTAINMENT. No live entertainment is allowed.
9.. RECYCLABLE MATERIALS. The restaurant shall utilize recycled products whenever
such a product is available.
10. REFUSE CANS. Employees of the business shall monitor the refuse can in the public
right of way adjacent to the business and empty the can if full. A trash receptacle shall be
located on the outdoor patio and maintained by Main Street Burger staff..
11. OUTDOOR UMBRELLAS. Outdoor umbrellas shall not have any writing, logos or
emblems.
12. OUTDOOR PATIO. Any changes to the outdoor patio shall be approved by the Director
of Community Development.
13. PORTER. A porter shall be available at all times to maintain the patio area.
14. STORAGE. Storage of outdoor furniture shall be located out of site from the street.
15. REVIEW. If the Director finds issues with trash or debris associated with this use, the
Director will agendize the project for Planning Commission review. The Planning
Commission will review the project and modify or add conditions as necessary.

16. LAPSE FOR DISCONTINUANCE. If the activity for which the Conditional Use Permit
has been granted is discontinued for a period of one (1) year, the approval lapses pursuant
to Section 29.20.340 of the Zoning Ordinance.
TO THE SATISFACTION OF THE POLICE CHIEF:
17. ALCOHOL SERVICE IN PATIO. Separation from public areas shall be provided to the
satisfaction of the Police Chief and ABC. The separation and signage shall clearly
establish that alcohol consumption is not allowed outside the patio area.
18. UNIFORMED SECURITY: Uniformed privately provided security guards may be
required in or around the premises by the Chief of Police if alcohol related problems
recur that are not resolved by the licensed owner.
19. CONSULTATION AND TRAINING: At the discretion of the Chief of Police, periodic
meetings will be conducted with representatives from the Police Department for on-going
employee training on alcoholic beverage service to the general public.
20. TRAINING MANUAL: The restaurant operator shall use an employee training manual
that addresses alcoholic beverage service consistent with the standards of the California
Restaurant Association.
21. DESIGNATED DRIVER PROGRAM: The restaurant operator shall actively promote a
designated driver program such as complimentary non-alcoholic beverages for designated
drivers.
22. POSTING OF TAXICAB TELEPHONE NUMBERS: Taxicab telephone numbers shall
be posted in a visible location.

We would like to take this opportunity to respond to and clarify the principal
issues brought up during the May 9th Planning Commission Meeting.
PROFILE OF MAIN STREET BURGERS
It was suggested that Main Street Burgers is a "kids place", built to cater to kids
and teens and therefore it is a venue unsuitable to serve beer and wine. As
"proof", it was noted that the interior design is "retro", and that as noted by one
commissioner, "I always see a lot of kids in there". First, to the extent the look is
"retro", Main Street was designed to appeal to the "baby boomer market' to
which a retro look would have some meaning. The look and feel is certainly not
aimed at today's teens. Secondly, as the accompanying attachment shows, we
cater primarily to adults or adults with children. In fact, nearly 80% of the guests
paying for meals are over 21 years old. Only 18% of entrees ordered are
children's entrees. Our customer base is primarily adult and secondarily families.
Only a small part of our business are teenagers. Our $10.00 per person average
is simply not in the budget of the typical teenager. Third, as we detailed in our
original letter with our application, Main Street Burgers was conceived and
designed to be a high quality casual restaurant specializing in the finest gourmet
hamburgers available in Los Gatos.
SERVICE OF ALCOHOL
Members of the Planning Commission voiced concern about the way alcohol will
be served at a counter service restaurant like Main Street. It was proposed that
the beer and wine could be delivered to the table in an effort to keep alcohol out
of the hands of minors. In reality, there is absolutely no evidence that this mode
of service is more likely to accomplish our mutual goal than standard counter
service. Virtually all of the high turnover counter service restaurants that serve
alcohol, do so from the counter with no apparent problems or complaints
regarding under age drinking. The Mexican restaurant, Andale, which has
applied for a license to serve hard alcohol in addition to their beer and wine will
continue to serve beer and wine directly from the counter.

The service of alcohol is closely regulated by the ABC. The ABC sets strict
standards as to time, place, and manner of alcohol service. The ABC is the
expert agency charged to evaluate and determine the best mode of service for
alcohol in any particular location. If table service would better prevent alcohol
service to minors, the ABC would no doubt incorporate such mandates in their
licensing restrictions.
Our present staff as well as all future employees will go through a rigorous
training program that will instruct them in the legal service of alcohol, including
who can legally pour the alcohol, how and when to check the age of customers,
and what particular abuses to look for specifically among teenage customers.
In addition, Main Street Burgers will add a bus person to circulate around to
immediately pick up unconsumed beer or wine after customers depart and be on
guard for the passing of alcohol to minors. Every shift will have a supervisor
tasked with overseeing our alcohol program. Our service managers and owners
will provide regular oversight and monitoring of our program.
As with all alcohol applications, an ABC field agent will visit and inspect our
premises to specifically evaluate the plot plan of the proposed alcohol service
area. The ABC then will specify the area of the patio where alcohol can be
served. The patio will be reconfigured to separate Main Street Burgers and
ColdStone tables. We have attached a proposed plot map that we will be
submitting to the ABC with our application showing how the patio will be
physically partitioned to ensure alcohol service compliance. In addition there will
be appropriate signage to indicate where alcohol can be consumed. Our
employees and managers will circulate regularly to insure that the seating
requirements are enforced.
Keeping alcohol out of the hands of minors, as well as protecting our under age
employees is also extremely important to us. Any alcohol violation affects the
licensee's status not only at the location in question but in all others in which the
licensee may have an interest. In our case, there are 3 other restaurant licenses
(as well as all future applications) that could be placed in jeopardy with alcohol
violations at Main Street. However, if the foregoing is not enough to ensure the
Town that alcohol will be kept out of the hands of minors, the Council need only
look at our blemish free record for the last 30 years at some 10 different
locations. There has never been a violation or complaint that minors were
served alcohol even during the World Cup Brazilian stampede in 1994.
PETITION
In the history of applications for alcohol permits in the Town of Los Gatos, we are
confident that the receipt of ius t one letter of protest is highly unusual. Receiving
but one letter is evidence that the local residents do not oppose this application.
And this one letter itself seems to confuse the service of beer and wine at Main
Street Burgers with the late night operations at No. 1 Broadway that serves beer,
wine and hard alcohol. In contrast to this one letter, Main Street submitted the
names and signatures of over 500 customers who support our application and
who have indicated a desire to enjoy a glass of beer or wine with their meals at
Main Street.
NEED AND FAIRNESS
The Planning Commission also questioned whether Main street "needs" a beer
and wine license, perhaps with the assumption that Main Street is simply a "kids'
place" or a fast food outlet. As noted earlier, neither assumption is consistent
with, the facts. Main Street has not undergone this lengthy and expensive
process in the absence of a clear business need. As we noted in our application
to the Planning Commission, virtually all of the similarly situated high turnover
restaurants serve beer and wine to their customers.
Finally, as noted in our letter to the Planning Commission, more and more
upscale, gourmet hamburger places are opening across the country. The newest
(called "The Counter") is opening at Santana Row later this year. Like virtually all
other upscale, gourmet hamburger restaurants, they will offer beer and wine.
Santana Row is hugely successful as a restaurant center and annually draws
100 million dollars out of the Valley's restaurant market (see attached) It is a
challenge to all retail stores and restaurants in Los Gatos. We do not want to
give our customers and Los Gatos residents a reason to go to Santana Row. We
want to keep them in town and maintain Los Gatos as a vibrant downtown
destination.

A. BACKGROUND:
Swensen's Ice Cream closed in July 2003 and the tenant space is currently vacant. The owner of
Lyndon Plaza Shopping. Center has split the floor area into two tenant spaces and Cold Stone
Creamery was recently approved to occupy one of the spaces.
B. DISCUSSION:
1. Use
The applicant is requesting approval to operate a 1,237 square foot restaurant within the
existing Lyndon Plaza Shopping Center. The maximum number of seats proposed is 26. The
maximum proposed hours of operation will be 7 AM to 11 PM seven days a week. Staff has

attached General Plan policies and implementing strategies that apply to the Downtown to
assist the Commission in evaluating the application (Exhibit B). In addition, Ordinance 2021
(Exhibit D) was adopted to discourage the displacement of retail uses by-restaurants by
requiring the Planning Commission to conduct a careful review of all applications for new
restaurant uses. The proposed use will replace a portion of the now vacant, Swenson's Ice
Cream restaurant, which also sold meals. Therefore, the approval of this use would not
displace a retail establishment. Approval of the proposed restaurant will result in an increase
in the overall number of restaurants in the Central Business District. If a restaurant is not
approved for this tenant space, the property owner would have to seek out an alternative
tenant.
2. Parking
The subject site has 34 on-site parking spaces and 176 parking spaces in the parking district
for a total of 210 spaces. The required parking for the proposed use is one space per four
seats. The business will have a total of 26 seats which requires a total of 7 spaces. Based on
data provided by the applicant and Town records, following is a parking analysis for the
Center.

The total required parking is 195 spaces and the available parking is 210 parking spaces.
With approval of the proposed application, there is an excess of ten parking spaces for the
Center.

The proposed use requires fewer parking spaces than the previous use due to the decrease in
seating. Swenson's had approval for a total of 70 seats. Cold Stone Creamery is approved
for eight seats. With the approved and proposed use, the total seating for the Swenson's space
is 34.
3. Traffic
The previous and proposed use is classified as a high turnover sit- down restaurant. Based on
the reduced number of seats from the previous use, there will be a decrease in the number of
average daily trips and PM peak hour trips. Swenson's was not open during the AM peak
hours, so there will be a net increase of 12 AM peak hour trips with the proposed use. A
finding of community benefit is required for this in The applicant has submitted a
letter of justification which discusses the project's community benefit and cites specific
sections from the General Plan to justify comphance.with Town goals and policies (Exhibit
A).
4. General Plan Compliance
As stated above, the applicant has submitted a letter citing numerous sections of the General
Plan he feels the project complies with. Staff believes that the following sections from the
General Plan are the most pertinent to this application.
Section 2.4.2.b states that the Central Business District is designated to encourage a
mixture of community oriented commercial goods, services and lodging that is unique in
its accommodation of small town style merchants and the maintenance of a small town
feel and character.
Policy L. G. I states that a variety of commercial uses. shall be maintained to meet the
shopping needs of residents and to preserve the small Town atmosphere.
Policy L.P.6.5 states that different functions, land use patterns, and use mixes of the
various commercial areas within the downtown should be recognized.
Issue 5 of the Land Use Section states that it is important to the economic vitality of the
Town Policy and to the general benefit of the residents, that goods and services are readily
available to the citizens of Los Gatos.
Goal L.G.6.2 states that the downtown is to be preserved as the historic center of the
Town with goods and services for local residents while maintaining the existing Town
identity, environment and commercial viability.
The above statements encourage a diversity of uses to maintain a full service Town. In the
C-2 zone (Central Business District) there are approximately 59 restaurants which constitutes
approximately 19% of the businesses in the Central Business District.
Policy L.P.5.2 states that in the Central Business District, retail should be emphasized.

When Lyndon Plaza opened in the late 1970's, there was a mix of retail and office uses. The
retail uses were located on the main and lower floors and office uses were located at the upper
level. It soon became apparent that the Plaza was not conducive to pedestrian circulation and
the retail uses went out of business or relocated to a more prominent street frontage. The
owners of the Plaza attempted to convert most of the spaces to office use. However, due to
parking requirements, this total change in use could not occur. Therefore, to maintain
occupancy of the building and to meet parking requirements, the Plaza evolved into a mix of
restaurants, personal service businesses and offices.
C. RECOMMENDATION:
The Development Review Committee considered this matter on July 7, 2004. Since the proposed
use is not displacing a retail establishment, the project is in compliance with the restaurant
ordinance. The Planning Commission should carefully evaluate the proposed use in light of the
General Plan policies included as Exhibit B. Staff believes that the approval of this application
would not be detrimental towards the Town's goal to maintain a diversity of uses in the Central
Business District.
If the Planning Commission finds merit with the proposal, it should:
1) Make the required findings (Exhibit C);
2) Approve the Conditional Use Permit application subject to conditions (Exhibit D).
If the Commission has concerns with the proposed application, it should do one of the following:
1) Approve the proposed application with additional conditions; or
2) Refer the application back to staff for further work as directed; or
3) Deny the application.

A. BACKGROUND:
On July 28, 2004, the Planning Commission approved a Conditional Use Permit (CUP) for a
high-turnover, sit-down restaurant (Main Street Burgers) within the Lyndon Plaza. Main Street
has been operating in this location since May 2005.
On October 27, 2004, the Commission approved a modification to the CUP to allow an outdoor
dining area for the joint use of Main Street and Cold Stone Creamery. The conditions of
approval are attached as Exhibit C.
B. REMARKS:
The applicant is requesting approval of an alcohol license for service of beer and wine in
conjunction with the service of food for an existing restaurant. The applicant submitted a letter
providing background on the restaurant approval and operation and explaining the rationale
behind the request (see Exhibit E). The applicant also owns and operates Willow Street Pizza
and points to an established record of responsible service of alcohol for that restaurant which
would also be applied to the operation of Main Street Burgers.
Exhibit F includes news articles about the restaurant and other similar types of restaurants as
well as a list of high turnover sit down restaurants in the Downtown and which have approval for
service of alcoholic beverages. The Police Department does not have any concerns about the
present business operation or the proposed service of beer and wine.
The applicant submitted a petition signed by over 500 people in support of the request to provide
beer and wine to patrons of Main Street Burgers. The petition is available for review in the
project file.
Alcohol Policy
The Town's Alcohol Policy requires any change in the service of alcoholic beverages to be
approved by the Town Council. The request is consistent with the general policies in Section II
of the Alcohol Policy and the specific policy in Section IV (see Exhibit G). The restaurant's
conditions allow it to remain open until 11:00 pm daily and the applicant is not requesting to
modify the approved hours of operation. The Town's Alcohol Policy requires specific findings
to be made for service of alcohol past 10:00 pm (see page 2 of Exhibit B). Unless these findings
can me made, the restaurant hours should be modified to require it to close at 10:00 pm or the

service of beer and wine should not be allowed past 10:00 pm. The Planning Commission's
recommendation on the application will be forwarded to the Council for final action.
Patio Seating
Patrons will order beer or wine with their food and can choose to sit inside the restaurant or in
the patio. The outdoor seating is shared by Main Street Burgers and Cold Stone Creamery. The
Police Department does not have any concerns about service of alcohol within the outdoor
seating area. When Alcohol Beverage Control (ABC) issues a license for outdoor seating, it is
for a designated area that must be separated from other uses and areas used by the general public.
A portion of the patio can be designated for consumption of beer and wine and a barrier will be
needed to separate it from areas used by patrons of Cold Stone. Condition #17 has been included
requiring the patio to be modified as necessary to meet ABC requirements.
C. RECOMMENDATION:
The Planning Commission should formulate a recommendation to the Town Council on the
requested approval for new alcohol service for Main Street Burgers. Required findings are in
Exhibit A and recommended conditions of approval are in Exhibit D.

Planning Division
1. APPROVAL: This application shall be completed in accordance with all of the conditions of
approval listed below and in substantial compliance with the plans approved and noted as
received by the Town on September 24, 2004. Any changes or modifications to the approved
plans and/or business operation shall be approved by the Community Development Director or
the Planning Commission, depending on the scope of the changes.
2. EXPIRATION: Zoning approval will expire two years from the approval date pursuant to
Section 29.20.320 of the Town Code, unless the approval has been vested.
3. SEATS. A maximum of 26 indoor seats and 18 outdoor seats are allowed.
4. ALCOHOLIC BEVERAGES. The sale of alcoholic beverages is not permitted.
5. HOURS OF OPERATION. The hours of operation are 7 AM to 11 PM seven days a week.
6. RESTAURANT USE. A high turnover sit down restaurant is permitted.
7. RECYCLABLE MATERIALS. The restaurant shall utilize recycled products whenever such a
product is available.
8. REFUSE CANS. Employees of the business shall monitor the refuse can in the public right of
way adjacent to the business and empty the can if full. A trash receptacle shall be located on the
outdoor patio and maintained by Main Street Burger staff.
9. MATERIALS. All proposed brick shall match the existing brick wall on the south edge of the
property.
10. LANDSCAPE PLAN. A landscape plan shall be approved by the Community Development
Department prior to issuance of building permits.
11. OUTDOOR UMBRELLAS. Outdoor umbrellas shall not have any writing, logos or emblems.
12. OUTDOOR PATIO. The colored concrete for the outdoor patio shall be approved by the
Community Development Department prior to issuance of building permits.
13. OUTDOOR FURNITURE. Outdoor furniture shall be consistent with the furniture shown in
exhibit dated October 12, 2004, located in the project file.
EXHIBIT C
14. OUTDOOR FURNITURE. Outdoor furniture shall be consistent with the furniture shown in
exhibit dated October 12, 2004, located in the project file. The colors and materials of the
outdoor furniture (umbrellas, chairs, etc.) shall be approved by the Director of Community
Development prior to operation of the patio. Umbrellas and space heaters shall have neutral
colors.
15. DESIGN REVIEW. Prior to issuance of building permit, the design of the patio/planter wall
shall be reviewed and approved by the Director of Community Development in conjuction with
the Town's Consulting Architect. The design of the perimeter wall shall be designed to increase
screening from the street and to be compatible with the design of the existing patio.
16. LIGHTING. The lighting fixtures and height shall be consistent with existing lighting on the
property. No string lighting shall be allowed.
17. PORTER.- A porter shall be available at all times to maintain the patio area.
18. STORAGE. Storage of outdoor furniture shall be located out of site from the street.
19. REVIEW. If the Director finds issues with trash or debris associated with this use, the Director
will agendize the project for Planning Commission review. The Planning Commission will
review the project and modify or add conditions as necessary.
Building Division
20. PERMITS REQUIRED: A building permit shall be required for the construction of the outdoor
seating area. Separate permits are required for electrical, mechanical, and plumbing work as
necessary.
21. CONDITIONS OF APPROVAL: The Conditions of Approval must be blue-lined in full on the
cover sheet of the construction plans.
22. SIZE OF PLANS: Four sets of construction plans, maximum size 24" x 36."
23. TITLE 24 - COMMERCIAL: For any proposed tenant improvements, on-site general path of
travel shall comply with the latest California Title 24 Accessibility Standards. Work shall
include, but not be limited to, accessibility to building entrances from parking facilities and
sidewalks.
24. NONPOINT SOURCE POLLUTION STANDARDS: The Town standard Santa Clara Valley
Non-point Source Pollution Control Program shall be part of the plan submittal as the second
page. The specification sheet is available at the Building Division Service Counter for a fee of $2
or at San Jose Blue Print.
25. PLANS: The construction plans shall be prepared under the direct supervision of a licensed
architect or engineer. (Business and Professionals Code Section 5538)

27. TRAFFIC IMPACT MITIGATION FEE (U-05-006). The developer shall pay a proportional to
the project's share of transportation improvement needed to serve cumulative development
within the Town of Los Gatos. The fee amount will be based upon the Town Council resolution
in effect at the time the building permit application is made. The fee shall be paid before the
conditional use permit is issued. The traffic impact mitigation fee for this project, using the
current fee schedule and the preliminary plans is $7,680. The final fee shall be calculated from
the final plans using the rate schedule in effect at the time of the building permit application,
using a trip generation rate based on "high turnover sit down" use. -

two years from the date of approval unless it is used before expiration. Section 29.20.335
defines what constitutes the use of an approval granted under the Zoning Ordinance.
3. BUSINESS OPERATION. This approval is for a quality restaurant use, and is restricted
to the areas shown on the approved plans. Any change in the type of business requires
modification of the Conditional Use Permit.
4. HOURS OF OPERATION. Hours of operation are limited to 7:00 am to 11:00 pm daily.
5. SEATS. The maximum number of seats is 44 (26 indoors and 18 outdoors).
6. ALCOHOL SERVICE. The service of beer and wine is permitted only with meals. A
meal is defined as a combination of food items selected from a menu (breakfast, brunch,
lunch, or dinner). Appetizers such as popcorn, nachos, pretzels, potato skins, relish trays,
etc. (hot or cold) are not meals. There shall be no separate bar for the restaurant.
7. ALCOHOL SERVICE IN PATIO. Separation from public areas shall be provided to the
satisfaction of the Police Chief. The separation and signage shall clearly establish that
alcohol consumption is not allowed outside the patio area.
8. ALCOHOL LICENSE: The applicant shall have an ABC license issued as required by
that agency for alcohol service for all service features of the restaurant.

Main Street Burgers, located at 20 S. Santa Cruz Avenue, is requesting modification of
its existing C.U.P. to allow the sale of beer and wine. The premises total approximately
1500 square feet including the outdoor patio. Main Street Burgers is solely owned by Ed
Rathmann and Glenn Thompson, who are also the managing partners of Willow Street
Wood-Fired Pizza in Lyndon Plaza.
HISTORY OF MAIN STREET BURGERS
We opened Main Street Burgers almost two years ago, with the goal of providing Los
Gatos the finest gourmet hamburgers available (Creek Stone Black Angus freshly ground
chuck) along with a host of other fine food selections. In addition to a long list of
delicious hamburgers, Main Street offers grilled chicken sandwiches, wild salmon
burgers, veggie burgers, grilled portobello sandwiches, and fresh green salads. Main
Street is the only restaurant selling frozen custard in Los Gatos. We cook all of our fries,
both potato and sweet potato, with non-hydrogenated oil.
Main Street was proud to introduce the dining trend that brings gourmet ingredients and
meticulous preparation to an American classic - the simple hamburger. As Bon Appetit
writes in the September 2006 issue "we couldn't be more excited about the counter-chic
movement, top chefs opening honest to goodness burger joints". We have attached
menus and articles about some of these new and exciting hamburger restaurants. But
perhaps the recent review in the Mercury News sununarized Main Street best when it
called Main Street the "Burger and Shake Nirvana".... And noted later that "we'd drive
to Los Gatos just to eat the fries".
These innovative new hamburger restaurants have two things in common. First, they
have shown that hamburgers prepared with imaginative and high quality ingredients can
represent superb food. Second, they recognize that such entrees are worthy of a fine glass
of beer or wine. Indeed, all of these operations, from the Shake Shack in Central Park to
Taylor Refresher in San Francisco's Ferry Building, to the Counter in Palo Alto, offer
beer and wine. Like these other restaurants, Main Street is a high quality food
establishment that happens to specialize in gourmet hamburgers.

CUSTOMER REQUESTS
Since opening, we have received thousands of requests from our adult customers asking
for a beer or glass of wine to accompany their meal. Beer and hamburgers are a natural
combination and appeal to a large number of Los Gatos residents. We have attached a
petition of nearly 600 names whose signatures were gathered over a 60 day period.
Clearly there is a strong desire by Town residents to enjoy a small selection of beer and
wine by the glass at Main Street. We think it is appropriate under these circumstances to
give responsible Town residents the choice to enjoy a glass of beer or wine with their
meal.
FAIR COMPETITION
There can be little doubt that the restaurant business is extremely competitive with its thin
profit margins, ever rising costs, and myriad of dining alternatives. It is imperative for an
owner to take all reasonable steps to stay competitive. To that end, we have instituted
Curb-Side pick up at dinner, which allows customers to remain in their car when they
purchase take-out food. In addition, we will soon begin delivery for large parry dinners.
But the ability to offer beer and wine, perhaps more than anything else, will help Main
Street's effort to remain competitive, particularly with its dinner business. As noted
earlier, we receive regular requests for beer and wine and now have to disappoint our
customers. Our inability to meet our customers' needs can effect their future restaurant
choices. This is particularly true where someone in a group wants beer or wine. That
single individual will frequently exercise veto power over where the group will ultimately
dine. Additionally, many of our customers come from outside of Los Gatos on the
weekend and wish to enjoy a beer or glass of wine with their afternoon lunch while
sitting on our patio across from the beautiful park. In our immediate area, there are
several food restaurants with similar price points and style of service, including Andele's
Taqueria, Los Gatos Roasting Company, Round Table Pizza, and Great Bear. All of
these restaurants offer beer and wine to their customers.
TOWN GUIDELINES
From the prospective of how the Town classifies restaurants, and how it has historically
permitted the sale of alcohol, Main Street clearly qualifies for beer and wine. Main Street
is in the "High Turnover" (H-T) category. There are 34 such restaurants in the H-T
group, of which 24 have beer and wine licenses. Of the 10 that do not, the vast majority
are breakfast and lunch operations where the service of beer and wine would be
incompatible with their bill of fare. Additionally, there is abundant precedent for a
restaurant like Main Street to offer beer and wine to its customers. In the H-T group,
there are numerous restaurants similar in style, service, and price to Main Street: Round
Table Pizza, Mountain Mikes Pizza, Caf6 Rouge, Tandoori Oven, Sweat Pea's Caf6,
Andele's Taqueria, Los Gatos Roasting Company and Great Bear. All of these
restaurants offer beer and wine to their customers. (See Attached)

Moreover, there is nothing in the town Alcohol Beverage Policy, ABP, that would
provide a legal impediment to Main Street offering beer and wine. The clear intent of
this policy is to regulate late night bars and restaurants to prevent late night alcohol
incidents which both burden the police department and disturb the residents of Los Gatos.
It is hard to imagine that Main Street, which usually closes at 9 p.m. and always by 10
p.m., posing any sort of alcohol related problems to our community by offering the
occasional beer or wine to our adult customers with their meal.
Finally, it has been suggested that because we sell hamburgers Main Street is a "fast
food" restaurant. Nothing could be further from the truth. Unlike a fast food restaurant,
we have an extensive menu of over 50 items. In addition to hamburgers, we sell grilled
chicken, salmon burgers, turkey burgers, grilled portabella sandwiches, veggie burgers
and fresh green salads. All hot dishes are cooked to order and we use the highest quality
ingredients, all natural where possible. With our hamburgers, customers can "Create
Their Own" and combine nearly a dozen different toppings to suit their tastes. Main
Street's price points and guest check averages are 2 to 3 times the typical fast food outlet.
In short, Main Street is a high quality restaurant that happens to specialize in gourmet
hamburgers.
CONCLUSION
Main Street is the only downtown gourmet hamburger restaurant in Los Gatos and we
believe that its design, unique menu, and local ownership only add to the charm of Los
Gatos. Main Street in many respects is an adjunct or a sister restaurant of Willow Street
Pizza. The two restaurants share much of the same ownership, many of the same
managers, and to a large extent the same customers. We see many of the same people
dining at Main Street as we do as Willow Street. Indeed, the customer profile of the two
restaurants is remarkably similar.
Main Street falls squarely within the restaurant category that permits the service of
alcohol. Further, there is certainly precedent for Main Street to offer beer and wine to its
customers. We believe it is only equitable to allow Main Street to offer beer and wine as
the other similarly situated restaurants are permitted to do.
But most importantly, it is our lengthy track record as responsible operators of Willow
Street (which has hard liquor as well as beer and wine) that provides the best predictor of
how beer and wine service at Main Street would unfold. As owners of Willow Street
Pizza, we have worked hard at being good members of the Los Gatos community. We
have demonstrated over the last 15 years good business citizenship, as well as responsible
treatment of the privilege to sell alcohol beverages. Main Street is another venue in which
we will exercise the same responsible behavior. We ask for your support in gaining
approval to offer beer and wine at Main Street.

POLICY REGULATING THE CONSUMPTION AND
SERVICE OF ALCOHOLIC BEVERAGES
I. Purpose
The consumption or service of alcoholic beverages, if not regulated, can jeopardize public
safety, result in an increase of calls for police services and compromise the quality of life for
Town residents. This policy provides parameters for alcoholic beverage service, particularly
addressing late night service when alcohol related incidents are most likely to occur and
when the disturbances to Town residents is least tolerable.
The service of alcoholic beverages, with or without meals, past 10 PM is a discretionary
privilege to be determined on a case by case basis. The following provisions are intended to
balance the protection of residential neighborhoods in close proximity to commercial districts
and still maintain the viability of our commercial centers in which restaurants have an
essential role. Hours of operation maybe regulated based on an establishment's proximity to
residential neighborhoods or schools, the concentration of establishments in an area serving
alcoholic beverages or for other reasons that may arise at the public hearing.
The deciding body may approve a conditional use permit to serve alcoholic beverages based
on the merits of the application and subject to the following requirements:
IL General policy
The Town shall continue to strongly discourage new applications for stand alone
bars or restaurants with separate bars.
2. The Town shall continue to discourage applications for entertainment establishments
serving alcoholic beverages.
Entertainment in association with an eating or drinking establishment maybe allowed
if standards and a permit process are adopted.
4. Alcoholic beverage service for new conditional use permit applications or
applications for modification of a conditional use permit shall not be allowed:
A. After 11 PM Sunday through Thursday, except for holidays and evenings
before holidays.
B. After 1 AM Friday, Saturday, holidays or evenings before holidays.
An existing establishment with a conditional use permit in good standing allowed to serve
alcoholic beverages past the hours stated above may continue to operate under their existing
hours of operation.

5. Any establishment serving alcoholic beverages shall be subject to the following:
A. Uniformed privately provided security guards maybe required in or around
the premises by the Chief of Police if alcohol related problems recur that are
not resolved by the licensed owner.
B. At the discretion of the Chief of Police, periodic meetings will be conducted
with representatives from the Police Department for on-going employee
training on alcoholic beverage service to the general public.
C. All establishments shall use an employee training manual that addresses
alcoholic beverage service consistent with the standards of the Californian
restaurant Association.
D. All licensed operators shall have and shall actively promote a designated
driver program such as complimentary non-alcoholic beverages for
designated drivers.
E. Taxicab telephone numbers shall be posted in a visible location.
6. The deciding body shall make the following findings prior to approving an
. application for conditional use permit to serve alcoholic beverages past l OPM:
A. Late night service will not adversely impact adjacent residential
neighborhoods.
B. The applicant does not have a history of complaints and non-compliance with
local ordinances or the Alcoholic Beverage Policy.
C. The applicant has demonstrated a clear benefit to the community.
7. A meal is defined as a combination of food items selected from a menu (breakfast,
lunch or dinner). Appetizers such as popcom, nachos, pretzels, potato skins, relish
trays, etc. (hot or cold) are not meals.
Alcoholic beverage service in approved outdoor seating areas may be pennitted if
adequate separation from public areas is provided as detennined by the Town
Manager. The separation shall clearly suggest that alcohol is not allowed outside the
restaurant seating area.

III. Specific Policy
Restaurants:
Alcoholic beverages may only be served with meals.
2. Restaurants With Separate Bars:
Alcoholic beverage service is permitted in the dining area only in conjunction with
meal service. Meal service shall be available until closing or 11 PM Sunday through
Thursday and until 12 midnight Friday, Saturday, holidays and evenings before
holidays, whichever is earlier, if late night bar service is available. Specific hours of
operation for each establishment are determined upon issuance of a conditional use
permit.
IV. Review Process
1. Proposals for new bars or restaurants with bars and all requests for new alcohol
service or a change to existing service shall be reviewed by the Planning
Commission. The Commission will make a recommendation to the Town Council
and the Council shall have final review authority.
2. Changes in ownership for businesses involving service of alcoholic beverages shall
be reviewed by the Community Development Department. The following process
will be followed:
a. The Director of Community Development shall contact the new business
owner to make therm aware of the conditions of approval attached to the Use
Permit for the location.
b. One year following issuance of a business license, surrounding/impacted
property owners shall be notified and any comments regarding the operation
of the business shall be solicited.
c. If the Director of Community Development becomes aware of any alcohol
related impacts on the surrounding neighborhood, the Director shall review
the operation of the business to determine whether there is a violation of the
use permit.

d. If there are violations of the use permit that have not been voluntarily
corrected by the business owner the matter will be forwarded to the Planning
Commission for public hearing pursuant to Section 29.20.3 10 of the Zoning
Ordinance.
e. Pursuant to Section 29.20.315 of the Zoning Ordinance the Planning
Commission may revoke or modify the conditional use pen-nit if it finds that
sufficient grounds exist. -
IV. Enforcement
All conditional use permits issued to establishments for alcoholic beverage service on-site
shall be subject to Section 29.20.318(b) of the Town Code authorizing the Town Manager to
take enforcement action if it is determined that the sale of alcohol has become a nuisance to
the Town's public health, safety or welfare. Enforcement of section 29.20.318(b) of the
Town Code will be based on, but not limited to, the following factors:
1. The number and types of calls for service at or near the establishment that are a direct
result of patrons actions;
II. The number of complaints received from residents ad other citizens concerning the
operation of an establishment;
111. The number of arrests for alcohol, drug, disturbing the peace, fighting and public
nuisance violations associated with an establishment;
IV. The number and kinds of complaints received from the State Alcoholic Beverage
Control office and the County Health Department;
V. Violation of conditions of approval related to alcoholic beverage service.
The Alcoholic Beverage Policy is not to be construed to be a right of development. The Town
retains the right of review and approval (or denial) of each project based on its merits.
