ADOPT RESOLUTION APPROVING PLANS AND SPECIFICATIONS FOR THE BLOSSOM HILL ROAD SIDEWALK CONSTRUCTION AND AUTHORIZE STAFF TO ADVERTISE THE PROJECT FOR BID B. AUTHORIZE BUDGET ADJUSTMENT OF $22,000 TO INCREASE PROJECT BUDGET TO $117,000 C. AUTHORIZE USE OF $52,000 FROM RESERVE FOR CAPITAL PROJECTS FUNDS FOR PROJECT 400-0712 RECOMMENDATION: 1. Adopt Resolution approving plans and specifications for the Blossom Hill Road Sidewalk Construction and authorize staff to advertise the project for bid. 2. Authorize budget adjustment of $22,000 to increase project budget to $117,000. 3. Authorize use of $52,000 from Reserve for Capital Project funds for Project 400-0710. BACKGROUND: The adopted Capital Improvement Program designates funding for the Blossom Hill Road Sidewalk Construction and is consistent with the Town's goals to improve public safety. This project will install a sidewalk and curb and gutter on the south side of Blossom Hill Road, between University Avenue and West Roberts Road across from Oak Meadow Park. Although an existing sidewalk is located on the north side of Blossom Hill Road next to Oak Meadow Park, some pedestrians tend to use the opposite side of the road along curb line where there is no designated pedestrian walkway. Additionally, there are no designated bicycle lanes on either side of this short section of roadway; bicycle lanes end and begin at the West Roberts Road intersection on Blossom Hill Road. . LZV E. The recommended plan would reduce the number of travel lanes on eastbound Blossom Hill Road from two lanes to one lane. This transition will take place gradually between University Avenue and West Roberts Road. This alignment will provide room on the south side of Blossom Hill Road for installation of a sidewalk and bicycle lane, and a bicycle lane for the north side. A new curb and gutter will be installed to accommodate the new sidewalk. There will not be any impacts to the retaining wall that is located along the back of curb in front of an apartment building. The new sidewalk will be extended across the Los Gatos Creek Bridge and will end at the Blossom Hill Road intersection with West Roberts Road. Plans and Specifications for this project are complete and will be available for review in the Clerk Department on the Friday before the Council meeting. Construction is anticipated to start in January 2007 and will take approximately 4 weeks to complete, assuming no rain delays. CONCLUSION: It is recommended that the Council adopt the attached Resolution approving plans and specifications for the Blossom Hill Road Sidewalk Construction project and authorize staff to advertise the project for bids. If Council approves the Blossom Hill Road Sidewalk Construction project, it will be advertised and a construction contract will be presented for Council award on December 18, 2006. ENVIRONMENTAL ASSESSMENT: This is a project as defined under CEQA but is Categorically Exempt (Section 15301c). A Notice of Exemption will not be filed. FISCAL IMPACT: The current adopted budgeted funding for this project is $95,000, including $50,000 in GFAR and $45,000 in planned Community Benefit Assessment from two adjacent development projects. Community benefit assessments are required contributions attached as a condition of approval for a development project which are used to fund Town capital improvement projects to mitigate impacts in the vicinity of the development. Typically, assessments are contributed to the Town prior to the issuance of a development's building permit. The Blossom Hill Sidewalk project budget included two anticipated benefit assessments. A $15,000 assessment is scheduled to be received from an approved multiple unit subdivision PAGE 3 MAYOR AND TOWN COUNCIL SUBJECT: PPW JOB NO. 06-11 - BLOSSOM HILL ROAD SIDEWALK CONSTRUCTION (UNIVERSITY AVENUE TO WEST ROBERTS ROAD) PROJECT 400-0712 OCTOBER 24, 2006 development at the corner of Blossom Hill Road and Roberts Road in approximately four months, due at the time the parcel map is recorded. However, the remaining $30,000 assessment that was to come from an office building development located across the street from Oak Meadow Park is not viable at this time, as that development is indefinitely on hold with the property listed for sale. If this property is developed in the future under the same approved plans, the community benefit will be programmed for other infrastructure enhancements in the area. If the approved plans are not pursued, staff will revisit this assessment in line with future developments projects. To complete the improvement project this fiscal year, replacement funding is required. In addition, due to increased materials costs and need for contingency, the revised cost to complete this project has increased by $22,000. The combination of the $22,000 increase in cost and the contribution shortfall of $30,000 creates a total funding shortfall of $52,000. A $52,000 funding adjustment is requested. RESOLUTION RESOLUTION OF THE TOWN COUNCIL OF THE TOWN OF LOS GATOS APPROVING THE PLANS AND SPECIFICATIONS FOR PPW JOB NO. 06-11 BLOSSOM HILL ROAD SIDEWALK CONSTRUCTION (UNIVERSITY AVENUE TO WEST ROBERTS ROAD) AND AUTHORIZE STAFF TO ADVERTISE THE PROJECT FOR BIDS WHEREAS, plans and specifications for the Blossom Hill Road Sidewalk Construction project (University Avenue to West Roberts Road) have been prepared by the Town Engineer and duly filed with the Clerk Administrator; and WHEREAS, the Town Council of the Town of Los Gatos has reviewed said plans and specifications. NOW, THEREFORE, BE IT RESOLVED THAT the Town Council hereby approves the plans and specifications for the Blossom Hill Road Sidewalk Construction project. BE IT FURTHER RESOLVED THAT the Clerk Administrator is hereby authorized and directed to advertise the Blossom Hill Road Sidewalk Construction project for bids in the manner prescribed by the Town Municipal Code.
