FIGONE, TOWN MANAGER -SUBJECT:- ADOPT A RESOLUTION SUPPORTING PROPOSITIONS-IA lB-TC-1D;- AND lE AND PROPOSITION 84, THE CLEAN WATER, PARKS, AND COASTAL PROTECTION BOND ON THE NOVEMBER 2006 BALLOT RECOMMENDATION: Adopt a resolution supporting Propositions 1A, 1B, 1C, 1D, and lE and Proposition 84, the Clean Water, Parks, and Coastal Protection Bond on the November 2006 ballot. PURPOSE- The purpose of this staff report is to provide summary information about Propositions 1A, 1B, 1C, 1D, and lE and Proposition 84 the Clean Water, Parks, and Coastal Protection Bond which are on the November 2006 ballot. BACKGROUND: The League of California Cities has requested that cities adopt a resolution supporting Propositions IA, 1B, 1C, 1D, and lE and Proposition 84, the Clean Water, Parks, and Coastal Protection Bond of 2006. The Silicon Valley Leadership Group also requested that the Town consider supporting Propositions IA- 1E, and 84. If adopted by Council, a copy of the resolution would be forwarded to the League and the Silicon Valley Leadership Group. DISCUSSION: Propositions 1A, 1B, 1C, 1D, and lE are part of the "Rebuild California Plan," a long term plan designed to improve the state's highways, schools, housing, and flood protection system. The "Rebuild California Plan" uses existing taxes and/or resources to build new infrastructure and includes strict accountability with respect to how funds are spent, including public reports and regular audits. Proposition 84, the Clean Water, Parks, and Coastal Protection Bond of 2006 is bond measure that funds improvements to the local water supply and flood control systems and California's natural landscapes. The following section summarizes Propositions 1A-lE and 84. Proposition lA In 2002, California voters passed Proposition 42, which used gas tax revenue for transportation projects to provide congestion relief and enhance public safety. It was later determined that a loophole existed in Proposition 42, which allowed the gas tax to be spent on projects other than transportation. Proposition IA closes the loophole, prevents gas tax revenue from being diverted from transportation projects and ensures appropriate funding levels for all California regions. It is anticipated that Los Gatos will receive approximately $215,262 in Proposition 42 funds for FY 2006/07. Proposition 1B Proposition 1B provides $20 billion to expand and make safety improvements to congested highways. Proposition 113 fast-tracks backlogged transportation projects and funds public transit improvements and air pollution reduction initiatives. Proposition 1C Proposition 1C provides $3 billion for emergency shelters for battered women and affordable housing for seniors, low-income families, and the disabled. Proposition 1D Proposition 1D provides $10 billion to implement seismic improvements to public schools, reduces overcrowding, conduct technological equipment upgrades, and build new facilities for vocational education and college engineering and science labs. Proposition lE Proposition lE provides $4 billion to strengthen river levees and flood control efforts, protect clean drinking water, prevent pollution, and safeguard the state from devastating floods. This proposition would expedite urgent levees and flood control facilities repairs and improvements, increase flood protection for urban areas, and evaluate and correct the current flood control system. Proposition 84 Proposition 84, the Clean Water, Parks, and Coastal Protection Bond of 2006 is a $5.4 billion bond measure that would ensure the availability of safe drinking water, improve local water supply reliability, strengthen flood protection, and preserve California's natural landscapes, including parks, lakes, rivers, beaches, bays, oceans, and coastline. The State of California has PAGE 3 MAYOR AND TOWN COUNCIL SUBJECT: ADOPT A RESOLUTION SUPPORTING PROPOSITIONS 1A, 1B, 1C, 1D, AND lE AND PROPOSITION 84, THE CLEAN WATER, PARKS, AND COASTAL PROTECTION BOND ON THE NOVEMBER 2006 BALLOT September 13, 2006 indicated that available balances from past bonds are very limited, creating a lack of funding to make necessary improvements to our drinking water supply, flood control system, parks, and coastlines. Proposition 84 also includes strict fiscal accountability provisions, such as annual independent audits and a citizen oversight committee. CONCLUSION: It is recommended that the Council support Propositions 1A,_1B,__1_C~_1D~ and lE and._Propositon_._ 84, the Clean Water, Parks, and Coastal Protection Bond on the November 2006 ballot. FISCAL IMPACT: There is no fiscal impact associated with taking action on this resolution. RESOLUTION OF THE TOWN OF LOS GATOS SUPPORTING PROPOSITIONS 1A, 1B, 1C, 1D, lE AND PROPOSITION 84 ON THE NOVEMBER 2006 BALLOT WHEREAS, the Town of Los Gatos is responsible for building and maintaining infrastructure that is essential to building and preserving the economic and social well-being of residents and businesses; and WHEREAS, this infrastructure includes streets and roadways, bike lanes, and other transportation systems, affordable housing, parks, and other amenities; and WHEREAS, the California State Legislature passed a $37.3 billion package of fiscal and -bond-measures-to-provide-funding-for housing,-transportation,-levee-repairs--and- flood-control-- projects and education facilities in May 2006; and WHEREAS, an additional bond measure to raise funds for clean water, parks and coastal protection has been placed on the ballot through the initiative process by a coalition of business, public health, local government and environmental organizations; and WHEREAS, these measures have been titled Propositions 1A, 1B, 1C, 1D, lE and 84 by the Secretary of State and will be placed on the November 2006 ballot for voter approval; and WHEREAS, Proposition IA will close a loophole and ensure that gas tax revenue from Proposition 42, passed by voters in 2002 is only spent on transportation improvement projects as originally intended; and WHEREAS, Proposition 1B will provide up to $20 billion on various transportation projects to rebuild California, of which $1 billion will go to cities and $1 billion to counties for local streets and roads improvement projects; and WHEREAS, Proposition 1 C will provide $2.8 billion for housing projects, including $1.35 billion that helps cities address housing-related infrastructure issues, consisting of $850 million in grants for development of public infrastructure projects that facilitate or support infill housing construction, $200 million for parks, and $300 million for development near public transportation; and WHEREAS, Proposition 1D will improve California's weakening school system by providing $10 billion for performing school building repairs and providing innovative learning facilities for Californian students, including seismic retrofitting and classroom repairs; and WHEREAS, Proposition lE will provide $4 billion for critical river levee repair and construction, as well as flood control projects and the updating and repair of old water mains and sewage systems; and WHEREAS, Proposition 84 will provide $5.4 billion for improving natural resources and water programs including state projects and grants for flood control, safe drinking water, improving water quality, integrated water management, water planning, and sustainable communities; and ATTACHMENT 1 WHEREAS, the League of California Cities is in strong support of Propositions lA - lE and 84, and views this package of measures as a means of providing critically needed resources for California cities. THEREFORE, BE IT RESOLVED that the Town of Los Gatos Town Council hereby expresses its strong support for Propositions 1A, 1B, 1C, 1D, lE and 84 which will be presented for voter approval on the November 2006 statewide ballot. RESOLVED FURTHER, that the Town Manager is hereby directed to send a copy to the Executive Director of the League of California Cities.
