ADOPT RESOLUTION TO REJECT BIDS FOR THE PARKING LOT 5
REPAIR AND RESURFACING PROJECT AND AUTHORIZE STAFF TO
REBID THE PROJECT
RECOMMENDATION:
Adopt resolution (Attachment 1) to reject bids for the Parking Lot 5 Repair and Resurfacing Project
and authorize staff to rebid the project.
BACKGROUND:
The plans and specifications'for parking lot improvements were approved by Council and project
advertised in March 2006.
This project will repair and reconstruct Parking Lot 5 located between Elm Avenue and Main Street.
Upgrading this parking lot will complete the improvements for the parking lots located between
University and Santa Cruz Avenue.
Work on this project will include the removal of existing asphalt surfacing, repair of base failures,
and placement of an asphalt overlay on the surface of the lot. There will be repairs and replacement
of damaged sections of curbs in this lot prior to the paving work. The improved lot will have new
irrigation lines to the planters and will also have a new planter island to improve the appetence of
the lot without reducing any parking spaces.

On April 19, 2006, sealed bids were received from seven (7), contractors. For this project One (1)
addendum was issued and distributed to the contractors. Due to staff oversight, one contractor did
not receive this addendum and when this was acknowledged when they submitted their bid.
In order to comply with State bidding requirements, the Town/Agency should reject all the bids and
re-advertise the project.
If the Council rejects the bids and authorizes staff to re-advertise the project, staff believes that new
bids will be opened on May 10 and the construction contract can be awarded by the Council on May
15.
With this schedule, staff believes that work can begin on the parking lot on May 22 so that the
resurfacing can be completed and parking lot opened by May 28.
It might be necessary to construct some of the concrete work after the parking lot has been paved.
That will not require closure of the lot and only small sections where the concrete work will occur
will be temporarily closed. Vehicular traffic flow in the lot will not be adversely affected..
ENVIRONMENTAL ASSESSMENT:
This project is Categorically Exempt pursuant to Sections 15301(0) and 15304(b) of the State CEQA
guidelines.
FISCAL IMPACT:
None at this time.
CONCLUSION:
Staff recommends that the Council reject the bids for the Parking Lot 5 Repair and Resurfacing
Project and authorize re-advertising of the project.

RESOLUTION
RESOLUTION OF THE TOWN COUNCIL/REDEVELOPMENT AGENCY
OF THE TOWN OF LOS GATOS
TO REJECT BIDS FOR PROJECT 05-22
PARKING LOT 5 REPAIR AND RESURFACING
WHEREAS, bids were sought in conformance with State and Town law for Project 05-22
Parking Lot 5 Repair and Resurfacing; and
WHEREAS, seven contractors submitted bids to the Clerk Administrator/Secretary of the
Redevelopment Agency on April 19, 2006; and
WHEREAS, one bidder did not receive the addendum that was issued for this project, and in
order to meet State bidding requirements , all contractors must have received any addendums
from the Town;
NOW, THEREFORE, BE IT RESOLVED that the Town Council/Redevelopment
Agency of the Town of Los Gatos, County of Santa Clara, State of California, reject the bid and
authorize staff to rebid Project 05-22 - Parking Lot 5 Repair and Resurfacing.
PASSED AND ADOPTED, at a special joint meeting of the Town
Council/Redevelopment Agency of the Town of Los Gatos, California, held on the 22 day of
April, 2006 by the following vote:
