BACKGROUND: Transportation Development Act (TDA) Article 3 funds are a percentage of gas tax collected and were established to fund local pedestrian and bicycle projects. The Metropolitan Transportation Commission (MTC) is the regional transportation planning agency responsible for the allocation of these funds. The basic objectives of the TDA Article 3 Grant projects are to increase the safety, security, and efficiency of bicycle and pedestrian travel. Each community is "guaranteed" a specific amount based on its population. Bicycle projects require an established Bicycle Advisory Committee (BAC) and an adopted comprehensive bicycle plan, and this is part of the adopted General Plan. The Bicycle Advisory Committee was approved by Council on May 2, 2005. The amount of TDA Article 3 funding guaranteed to the Town of Los Gatos is approximately $21,000. The current year grant application deadline was April 15, 2005. MTC will need to receive the attached Council resolution by May 24, 2005. The HES grant requires local matching funds that could be could be supplemented with the TDA funds. The trail and pathway improvement project is an eligible project for the TDA funds. They are included in the proposed FY 2005-06 Capital Improvement Program which is being considered on this agenda. CONCLUSION: Staff recommends that the Council/Redevelopment Agency adopt Resolution to apply for TDA Grant funding. ENVIRONMENTAL ASSESSMENT: Is a project as defined under CEQA. A Notice of Exemption has been filed. FISCAL IMPACT: The TDA Article 3 grant funds total, approximately $20,000 ($10,000 for each proposed project). RESOLVED, that The Town Of Los Gatos declares it is eligible to request an allocation of TDA Article 3 funds pursuant to Section 99234 of the Public Utilities Code, and furthermore, be it. RESOLVED, that there is no pending or threatened litigation that might adversely affect the project or projects described in Attachment B to this resolution, or that might impair the ability of the Town of Los Gatos to carry out the project; and furthermore, be it. RESOLVED, that the Town of Los Gatos attests to the accuracy of and approves the statements in Attachment A to this resolution; and furthermore, be it. RESOLVED, that a certified copy of this resolution and its attachments, and any accompanying supporting materials shall be forwarded to the congestion management agency, countywide transportation planning agency, or county association of governments, as the case may be, of the Santa Clara County Valley Transportation Authority for submission to MTC as part of the countywide coordinated TDA Article 3 claim.
