We are pleased to provide this information packet as preparation for this year's annual Retreat with Town
Commissions. The Retreat is scheduled to run from 8:25 a.m. to approximately 12:10 p.m., on Saturday,
April 9, in the Town Council Chambers (110 East Main Street). Continental breakfast will be available at
8:00 a.m. Commissioners are asked to arrive at least 15 minutes prior to their scheduled start times. Below

Chair, or other representative from each Commission, will first present highlights from its Retreat
Questionnaire, allowing for the balance of the session to be used for discussion. All commissioners are
invited to attend.
Staff has worked to ensure that the Retreat has a consistent structure, in order to facilitate dialogue and to
focus on key issues between the Council and Commissions. We look forward to a productive Retreat for
the Council and Commissions.

Los Gatos Community Garden
Statement of Purpose: Many cities and towns nationwide recognize that community
gardening improves the quality of life for people by providing a catalyst for neighborhood
and community development, stimulating social interaction, encouraging self=reliance,
beautifying neighborhoods, producing nutritious food, reducing family food budgets,
conserving resources and creating opportunities for recreation, exercise, therapy and
education. These community gardens are a great way to get both children and adults
involved in beautifying the neighborhood community while working with nature
A Community Garden is an exciting opportunity for the Town of Los Gatos to continue in
its beautification efforts while promoting social cohesiveness across neighborhoods.
Proposed Location: Between Lynn and Blossom Valley Drive in Los Gatos, on the
PG &E easement (see attached map)
Program Ownership: The Community Garden Program proposed by Parks and
Public Works will be run by a group of community volunteers. PPW will continue to
oversee that rules and regulations are followed as specified (see attached document). A
qualified community garden master, an appointment volunteer position, will act as the
liaison between the public and PPW. The term of this position will be one year with
renewal possibility.

Community Garden Rules and Reeulations
1. Los Gatos residents who are interested in obtaining a plot,should contact Los Gatos'
Community Garden Coordinator at . Plots are issued on a year-to-year
and first-come-first-serve basis, with a limit of one plot per family. If there is no plot
immediately available, an individual. or family may add their name to the waiting list,
and they will be, contacted, in the order of the waiting list, when a plot becomes
available. Once a plot is assigned that family or individual will maintain the plot until
they choose to give it up or are dismissed from the program for non-compliance.
2. A fee of $.20* per sq. ft. will be collected prior to commencement of gardening. This fee
will cover expenses related to watering and upkeep of the garden and will average
approximately $35 per year. Any fee changes will be identified and gardeners will
receive notification at least 60 days prior to implementation. A new application and
water fee will be due each year by December 31, and will be accepted in the form of
check or money order only.* current fee subject to change based upon actual costs
3. The registered gardener is expected to actively garden and maintain their plot in a
manner acceptable to the community garden program standards. An acceptable manner
means that the gardener is actively gardening, digging, sowing, planting, weeding,
pruning, watering, harvesting, etc., once a week during the growing season. If no winter
gardenis planted, the plot must be kept free of weeds and debris. If the gardener is ill or
on short vacation, another gardener can be contacted to tend your plot during your short
absence. The surrounding pathways are to be kept free of weeds, hoses and debris.
4. If you must relinquish your plot for any reason, the Community Garden Coordinator
must be. notified immediately. Plots may not be turned over to friends or family. Hours
of operation will be from 8:00 am to sunset, daily.
5. Both gardeners and persons on the waiting list are responsible for providing the
Community Garden Coordinator with up-to-date information regarding changes in
address and telephone numbers.
6. Only fruits, vegetables, flowers and herbs may be grown in the community garden.
Cactus, trees of any kind, no stalks higher than 8 feet, no illegal or invasive plants,
alfalfa, rice, or any other similar plant that requires excessive amounts of water, or that
impedes the growth of your neighbor's garden, are prohibited.
7. Products grown in the community garden are for personal consumption only and may not
be grown for sale or profit.
8. Use of insecticides (eliminates insects), herbicides (weed eradicator) or poison grains
(kills rodents) is strictly prohibited. If you are encountering a pest or disease problem,
notify the Community Garden Coordinator. Tutorial sessions will be conducted on use of
organic chemicals, organic. composting, etc.

9. Water conservation is an important issue for community gardeners. The amount of water
used by every gardener will determine your future water charges. In order to conserve
water, it is required that you only water while you are overseeing your plot. No plot is to
be left unattended while watering. Make sure all faucets are turned off when you leave.
Except when watering seedlings, plots should not be watered more than once a week.
Water conservation is best accomplished when watering in the early morning hours or in
the evening. There will be one outlet for every two plots. These spigots will be installed
by a contractor.
10. It is illegal to harvest or take any crops, including flowers and herbs, from any plot other
than your own. Stealing is grounds for immediate removal from the program.
11. Composting of organic debris may be done on an individual basis, within the confines of
your individual plot. You may bring in a small composting bin that must remain inside
your plot's boundaries at all times. For those who choose not to compost their own
materials, there is a specific area designated for materials that are already composted and
may be purchased and deposited in this area only. No trash is allowed in the compost
piles. Any compost provided by the Town is for Community Garden use only. We will
use containers which confine smells and orders as best as possible.
12. The following are not allowed in the Community Garden: pets (unless a guide dog);
smoking; loud radios or music; consumption of alcoholic beverages; loud and offensive
behavior; unattended children; urination on the grounds; garbage or debris that is not
properly disposed of.
13. A roadway into the garden is provided for gardening deliveries and pickups only. There
is a fifteen-minute time limit for such transactions.
14. If a gardener is found to be in noncompliance with the Community Garden rules
(excluding rules #7, #8, #10 and #12) the following procedure will be initiated. A first
written warning will be mailed to the gardener's residence. The gardener will be given
10 days to remedy the situation. A second and final 10-day written warning will be sent
if after the initial 10 days has passed, the stated problem still exists. If after the second
10-day warning, which is a total of 20 days, the problem has not been corrected; the plot
will be reassigned to the first person on the waiting list. There will be no refund of fees
paid by the original plot holder.
15. For violation of rules #7 and 412, there will be only one written warning given. If the
violation occurs a second time, the gardener will be terminated and there will be no
refund of fees paid.
16. For violation of rules #8 and #10, a first violation will cause the gardener to be
terminated immediately with no refund of fees paid.
These rules are subject to revision at the discretion of the Town of Los Gatos. If you have any

Gardening courtesy and communication
One of the main goals in community gardening is to work together or next to each other.in
relative harmony, Please be courteous in all interactions, and work to resolve any
disagreements. Contact the Garden Coordinator for guideline clarifications or plot delineation.
Garden Coordinators will check plots regularly to encourage productive use by participants.
Gardeners should make arrangements for plot maintenance and notify the Garden Coordinator
if they will be away for more than a week.
What constitutes a "'working garden"
A.garden plot must be maintained, planted or mulched, and stay within its boundaries. Plots
may not be consistently weedy, untended or filled with debris. Gardeners are expected to
spend at least 2 hours per week, on average during the growing seasons, tending the plot.
Getting Started
The XXX date deadline exists to motivate our gardeners to show that they are going to use
the garden plot, and not waste it. The minimum requirements of "getting started" include:
• Weeding, planting
• Working some of the soil in preparation for planting
• Harvesting of crops, if appropriate
• Pathway clean-up
By XXX date, there should be marked progress towards a productive garden, which includes:
• At least 1/2 the plot(s) worked
• Removal of remaining weeds
• Establishing and caring for plants
• Continued pathway maintenance
By XXX date, there should be gardening activity, and weeding in the whole plot.
October Clean-ups
Annual crops should be harvested and the plants cleaned up and composted. Gardens should
be cover-cropped, and mulched around perennial plants by October 31.
Steps to Organizing a Work Marty
If you would like to see a garden work party at your garden start out by talking to your
garden coordinator about what need you would like to address. Then talk to other gardeners
to see their interest level in a work party. After getting some commitment to this idea, call up
the Parks and Public Works office.
Pathway Maintenance
Paths must be 21/7. to 3 feet wide, flat and level and either wood chip mulched or mowed. No
plastic or carpet should be used. Cardboard or paper must be covered by wood chips, and
leveled. Plants should not grow into the paths, or hang over the paths. Each garden site will
designate path maintenance responsibility.
Tool Care
Any soil that clings to the metal surface of your tools should be removed. You will probably
find It easier to wash off the larger soil patches with a strong stream of water from the hose.
Small soil particles and rust spots are easily removed with sandpaper. It pays to keep your
tools in good working order. To keep the handle from drying out and splitting, rub the handle
with linseed oil. Wipe off any excess so it won't get tacky. They will last much longer and will
operate more efficiently if you do.

RETREAT
RECOMMENDATIONS:
That Council meet with each Town Commission and Board, and discuss issues of interest to
Commission and Board members and to the Town Council.
BACKGROUND:
Each April, Council holds a Council/Commission Retreat, at which it meets, with Town
Commissions, Committees, and Boards (hereinafter referred to as "Commissions"). The goal of the
Retreat is to open the lines of communication between Council members, Commission members,
and staff. All members of each Commission are invited to attend; generally, the Commission Chair
and Vice-Chair take the lead for the Commission in discussion with Council.
At this Retreat, Council will be meeting the following six Commissions: Arts Commission,
Community Services Commission, Library Board, Parks Commission, Transportation and Parking
Commission, and the Youth Commission. The Council will be meeting with the Planning
Commission in a separate Retreat to be held April 27.
Retreat Format
First will be a discussion of topics common to all Commissions. The key issue this year will be a
review of the current process for interviewing potential Commissioners.

Next, Council will meet in turn with the Arts Commission, Community Services Commission,
Library Board, Parks Commission, Transportation and Parking Commission, and Youth
Commission. In preparation for the Retreat, each Commission completed a questionnaire, which
requested the Commission's assessment of major accomplishments, proposed future projects, ideas
for training, and any other issues that the Commission wishes to discuss with Council. Each
Commission's completed questionnaire, its enabling resolution, a matrix of action items from last
year's Retreat, and other relevant documents are included with this report. During each
Commission's time with Council, it will first present highlights from its questionnaire, and then use
the balance of the session for open discussion.
DISCUSSION:
Update on Common Issues
At the 2004 Council/Commission Retreat, the primary topic addressed during the discussion of
common issues was the proposed process to streamline terms of office, recruitment, and
appointment. Council also asked that the Downtown banners be replaced (completed November
2004) and that Commissions and staff network with the Youth Commission as appropriate
(ongoing). A matrix of these issues, and follow-up actions, is attached to this report (Attachment
1). Following is a brief update regarding changes to commissioner terms and commission training:
Terms of Office; Recruitment and Appointment:
In June of last year, the Town Council voted to standardize the expiration of Commission terms of
office so that all terms of office expire on December 31, rather than throughout the year. The length
of the terms of office, i.e., the number of years of the term, did not change, and neither did the
staggered terms of each Commission's members. Terms for Student commissioners did not change.
The standardized term has resulted in a more streamlined process of recruitment, appointment, and
training of commissioners.
Staff made a series of improvements to the commissioner recruitment process. A "Town of Los
Gatos Boards and Commissions" brochure was produced, which gives prospective applicants general
information about commissions, and directs them to sources for more information. A companion
series ofbrochure inserts, each with information specific to one commission, was also prepared. The
"Boards and Commissions" page ofthe Town's website was completely revamped; with clear, easy-
to-navigate information about each commission, current vacancies, the application and appointment
process, and printable versions of each commission's application.
Aligning term expiration dates allows for one concentrated period of recruitment and advertising
each year, and interviews and appointments are scheduled for the same month each year. Vacancies
that occur during the year have been filled through a process in which vacancies are advertised and
applicants are interviewed on the evening of a Council meeting, before the meeting begins.

Commissioner Training:
A revised Commissioner Handbook was distributed to all commissioners after the 2003 Retreat.
Newly appointed commissioners receive a Handbook when they take the Oath of Office. The
Handbook maybe used by the Commission Chair and staffliaison to provide orientation and training
for newly appointed commissioners. Commissioners were briefed last by the Town Manager
concerning the fiscal challenges faced by the Town. Similar briefings are being scheduled with
Commissions this year. All Commissioners were also invited to send two Commissioners to the
Leadership Los Gatos session entitled, "Introduction to Town Government;" approximately twelve
Commissioners attended. This invitation will be extended annually. Council's ideas on
Commissioner training should be provided to staff at the meeting for subsequent review. Ideas for
training may also emerge from the Retreat discussions with Commissioners.

Arts Commission. The role of the Arts Commission is to encourage the development of art, drama,
music, and other creative activities in Town. Under this charge the Commission has produced a
number of successful projects, including Music in the Park (MIP), Art in the Council Chambers, and
a public art installation. At this Retreat, the Commission would like to update Council on its recent
accomplishments, and present its projects and goals for 2005/06. A focus of the conversation will
be around the Commission's desire to expand MIP and broaden program marketing. The
Commission proposes that MIP be marketed regionally. The program has traditionallybeen intended
as a community event and consequently, has been marketed locally.

Staff has begun to market the program to destination visitors who would likely stay in local hotels,
eat in local restaurants, and shop in Los Gatos stores.
Community Services Commission. The role of the Community Services Commission is to ensure
that the goals and objectives contained in the Human Services Element of the General Plan are
implemented. The Human Services Element addresses the social, health, cultural, and educational
needs of residents. Commission liaisons are actively involved in community programs focused on
these needs. The Commission administers a number of successful programs, including the
Community Grant program. At this Retreat, the Commission would like to update Council on its
recent accomplishments, and present its goals and projects for 2005/06.
Library Board. The Library Board works with Library staff in an advisory role, with the goal of
providing better Library services. At this Retreat, the Board would like to update Council on its
recent accomplishments, present its goals for 2005/06, and discuss its interest in the Civic
Center/Library Master Plan project and budget issues.
Parks Commission. The Parks Commission advises Council on issues related to public parks,
grounds, street trees, and beautification, and has completed many projects in these areas. The
Commission has fully integrated open space and trails issues as a part of its role. At this Retreat, the
Commission would like to update Council on its recent accomplishments, and discuss its goals and.
projects for 2005/06, including the proposed establishment of a community garden.
Transportation and Parking Commission. The Transportation and P arking Commission advises the
Council on matters relating to on-street and off-street activities and services. These include general
transportation issues, bikeways, traffic safety, the Town's Traffic Calming Policy, safe routes to
school, traffic studies, and Town-wide parking including the Downtown Parking Management Plan.
At this Retreat, the Commission would like to update Council on its recent accomplishments,
present its goals for 2005/06, and discuss the Downtown Parking Management Plan. Also, staff
would like to discuss the establishment of a BikewayAdvisory Committee, which is needed as a pre-
grant application review body. The staff's proposal is to establish the Committee with
representatives from three existing Commissions: Parks, Transportation and Parking, and Youth.
Youth Commission: In order to increase youth involvement in Town government and community
activities, Council adopted a resolution establishing a Youth Commission on April 5, 2004. At this
Retreat, the Commission would like to report on its accomplishments to date and present its goals
and projects for 2005/06.
CONCLUSION:
The annual Council/Commission Retreat is a valuable opportunity for Council and Commission
members to engage in meaningful dialog, address issues of interest to all parties, and set goals for
the coming year. The contributions made by members of Town Commissions, Committees, and
Boards are essential to the effectiveness of our municipal government organization.

Major accomplishments of the past year.
• Successfully staged ten Music in the Park (MIP) concerts. The Commission raised funds
to offset all direct costs and developed a fund balance.
• Expanded Commission participation in the July 4t' Community Event by supporting the
additional evening concert on the Civic Center lawn. The Commission identified the
performers and solicited sponsorships to cover concert costs. The concert was promoted
and staffed by the Commission as part of its MIP series.
• Worked with Rick Tharp in the design of a new MIP logo and promotional materials
which included a completely redesigned program, sponsor package, and street banners.
• A number of Arts Commissioners are active in other community art projects such as:
• The Chamber and Morning Rotary Club's Jazz on the Plazz concert series.
• The Los Gatos Art Association's Plein Air Project.
• The Museums of Los Gatos fundraiser, Touch My Heart.
• Coordinated six Art in the Council Chambers exhibits.
• Reviewed several possible locations for public art installation, selected final location in
Bachman Park; solicited input from other agencies on creation of Call for Entry to artists;
drafted, finalized, and distributed Call for Entries; narrowed field to three possible
candidates. The Art Selection Panel will recommend one of the proposals to be
considered at an Arts Commission public hearing. The selected proposal will be
forwarded to Council for approval.
hnplemented the Community Development Block Grant (CDBG) and Community Grant
funding process for art agencies serving Los Gatos residents.
Expanded local arts organization liaisons to include Festival Theater Ensemble and the
Theater Improvement Project.

PROPOSAL FOR EXTENSION OF MARKETING PROGRAM
2005 Music in the Park Series
The Music in the Park Committee would like to investigate the effect of
extending our marketing efforts to regional media. While the Town historically
has limited this marketing to exclusively Los Gatos-based print and broadcast
outlets, we believe it would be appropriate and beneficial to the Town to seek
out additional coverage for the following reasons:
• While we do not wish to "over-promote" our concert series (and thus, run
the risk that Town residents would not feel comfortable attending the
concerts, or be able to find comfortable seating), we would like to shift
away from what is a fairly "exclusivist" approach. Los Gatos is admittedly
a unique town, with a largely professional, affluent, Caucasian
population. We would like to present an image of a town that embraces a
higher level of diversity, and welcomes visitors from the surrounding
areas.
• Our grant through Silicon Valley Arts Fund requests that the Arts
Commission do limited outreach to the surrounding communities. Surely,
this would be in keeping with that charter.
• The MIP committee works extremely hard, volunteering countless person-
hours in identifying high-quality performers, soliciting sponsorships, and
staging, staffing, and tearing down after each concert. We have made a
concerted effort this year to improve the caliber of the performers, and
have a slate of terrific talent scheduled. Having well-attended concerts
will encourage other performers to seek us out, and possibly become part
of our schedule in years ahead.
• Los Gatos is a town that depends in large part on visitors to support the
livelihood of its downtown merchants. While we are fully aware that MIP
is not intended as an Economic Vitality initiative, the fact remains that
when visitors come to our town for a concert, they are much more likely
to stroll through the area before and afterwards, and possibly shop and
have a bite to eat (or, if they lack to time to do either, they will at least see
what we have to offer, and be more inclined to return at a later date). We
believe those incidental dollars are a crucial benefit to the Town. Given the
concerns voiced by the downtown merchants when MIP was moved from
the Plaza to the park, attracting a somewhat larger audience seems to be
something very positive that we could do (especially this summer, with
the reconstruction and repaving in downtown causing still more
concerns).
Each year, the Town welcomes visitors to its Open Studios event. We
actively encourage people from surrounding areas to come to Los Gatos,
stop in at multiple locations, peruse the art, and hopefully make a
purchase. As far as we're aware, this has not caused undue traffic or stress
to the Town. It would follow that if we hope to attract non-residents to
this event (or to the film festival, or Fiesta des Arts, or any similar event),
we should not be trying to restrict attendance at MIP to Town residents
only.
The MIP committee recognizes that this proposal represents a shift in the
thinking and policies with regard to our marketing. With that in mind, we
suggest the following:
In addition to sending our press to the Los Gatos Weekly-Times, the Los
Gatos Daily News, and KCAT, our regional marketing would be restricted
to those sections of The Guide, The Wave, The Eye, etc. that support the West
Valley areas - Los Gatos, Saratoga, Campbell, Cupertino, and West San
Jose - as well as the radio and TV stations that support the same areas.
Given that Joe Sharino, who will perform at our first concert (and who
drew the largest crowd last year) has his own website, and therefore
attracts his own following, we could consider scheduling our marketing
efforts to begin the week after he performs (i.e., no PSAs or calendar
listings would run until the week preceding the Fourth of July). This
might be somewhat problematic, but hopefully we could work it out in
some fashion.
We would like to take this approach for this summer's series on a trial
basis. If the Town agrees that we've been "too successful," and the Civic
Center cannot support the numbers of people who are attending the
concerts, we will certainly scale back our marketing efforts. But we believe
that this approach is well worth the time and effort it will require, and that
ultimately, all residents of the Town will benefit from the increased
visibility of the concert series.
One final thought: During a recent Art in the Council Chambers reception,
Mayor Mike Wasserman made a very insightful observation: "The only place
that doesn t have to worry about parking problems is a ghost-town."
We couldn't agree more: having traffic and bustling activity is the sign of an
extremely healthy economy in an area that depends on its non-resident trade.
The Music in the Park Committee hopes to do as much as possible to contribute
to the health and energy of our Town.

RESOLUTION OF THE TOWN COUNCIL
OF THE TOWN OF LOS GATOS
REVISING THE ARTS COMMSSION ENABLING RESOLUTION 1988-214
WHEREAS, The Town Council of the Town of Los Gatos wishes to assure conformance of this
enabling resolution with Council approved attendance requirements; and,
THEREFORE, BE IT RESOLVED: by the Town Council of the Town of Los,Gatos, County of
Santa.Clara, State. of California, that the Town of Los Gatos Arts Commission shall be governed as follows.
The Commission shall be advisory to the Town Council and shall operate in the manner herein after
prescribed:
1. Membership - Organization
(a) The Commission shall consist of nine (9) voting members, whose terms of office shall be
three (3) years and until their successors are appointed by the Town Council.
The terms of office of the respective members shall be staggered and over lapped in such
a manner that the terms of no more than one-third of the members expire each year.
The Town Council shall fill any vacancies occurring during.the term of the Commission.
The Commission shall annually designate a Chairperson and Vice-Chairperson.
(b) Five members of the Commission shall constitute a quorum of the Commission for the
purpose of transacting business. Any member shall have the right to present a minority view
to Council in reference to any report or recommendation the Commission may take.
(c) The members of the Commission shall serve without compensation, provided that with
advance budgetary approval ofthe Town Council, the actual and necessary expenses (if any)
incurred by the members in the conduct of Town business shall be reimbursable pursuant
to the provisions of Resolution 1987-16
d. The Commission shall establish a regular time and location for its meetings and shall
otherwise call and conduct its meetings in compliance with the.provisions of the Ralph M.
Brown Act (Government Code Sections 54950 and following.)
e. Minutes of the actions taken during its meetings shall be kept and filed with the Town Clerk.
f. Meeting attendance requirements will conform with current Town Resolution.
2. Duties and Functions
(a) The functions of the Commission shall be to encourage the development of art, drama,
music, and other creative activities in the Town of. Los Gatos. Specific activities would
include, but are not limited to:
1. Identify the nature and extent of all existing resources in the arts in the Los Gatos
community.
2. Generate community awareness and support for a full range of activities in the Arts
in the Town.
3. Make recommendations to Town Council and other Town Commission in the field
of art, aesthetics, and beautification.
4. Perform other duties as assigned by the Town Council.
IT IS HEREBY FURTHER RESOLVED that Resolution 1988-214 is hereby rescinded.

Major accomplishments of the past year.
Commission liaisons actively worked with a number of regional and local committees. Regional
committees include the County HCD Citizen's Advisory Committee and the Homeless Task
Force. Town committees/programs include: General Plan Committee, Drug Free Community,
Alive and Loving Life, and Youth Commission, and the Senior Center. The liaisons regularly
communicated project status to the Commission.
The Commission completed it's follow-up on the Needs Survey in the areas of daycare for
children, after school programs for middle school students, senior transportation, and in-home
care services for seniors.
The Community Services Commission, with input from the General Plan Committee and staff,
conducted an extensive review of the BMP Guidelines, with the goal of improving the way in
which the BMP Program provides affordable housing to the Los Gatos community. The
Guidelines were approved by the Commission and presented to Council for approval in March.
Proposed projects for upcoming year.
During Fiscal Year 2005/2006 the Commission will:
• work with staff to inventory and photograph affordable housing units and post the
information on the web, as appropriate
• complete an inventory of services provided by local religious organizations to homeless
and low income person/families
• support the Community Unity project

The Commission is monitoring its calendar to identify meetings at which action is to be taken
and identify meetings which may be canceled in order to effectively use Commissioner's and

RESCINDING RESOLUTION 2003-133 AND AMENDING
THE COMMUNITY SERVICES COMMISSION ENABLING RESOLUTION
RESOLVED by the Town Council of the Town of Los Gatos, that the Town Council does
hereby establish the terms and conditions for appointment to and conduct of the Community Services
Commission. The Commission is advisory to the Town Council and operates in the manner hereinafter
prescribed.
(l.) Membership - Organization
a. The Community Services Commission consists of nine (9) voting members. Seven (7)
are members over eighteen (18) years of age. Their terms of office are three (3) years
and until their successors are appointed. Two (2) members of the Commission shall,,at
the time of their appointment, have completed the ninth (9th) grade, shall be students
enrolled in an accredited school, and shall be no more than eighteen (18) years old. Their
terms of office are one (1) year and until their successors are appointed. .
The Commission's membership shall, to the extent possible, reflect the social and
economic diversity of the Los Gatos community.
The members' terms of office are staggered and overlapped so that the teams of no more
than one-third of the members expire each year.
The Town Council shall fill any vacancies occurring during the term of the Commission.
The Community Services Commission shall appoint and prescribe the term of office for
its Chair and Vice-Chair.

new programs.
3. Periodically review the Human Services Element and recommend changes
needed to meet new conditions and to respond to the changing community
environment.
b. The Commission shall identify the housing and the human service needs of persons of
all ages in the Town and its sphere of influence, examine existing privately and
publicly supported programs in those fields, evaluate such programs, develop plans
for the creation of new programs, and make recommendations to the Town Council.
C. The Commission shall make recommendations to Town Council concerning projects
to be included in funding applications under the Housing and Community
Development Act of 1974 and perform the duties necessitated by the Act upon the
request of Town Council.
d. In developing recommendations to the Town Council, the Commission should:
1. Elicit the interest and support of various relevant community individuals and
groups.
2. Study and examine sources of public and private funding to meet housing
and community service needs.
3. Evaluate the effectiveness of existing programs and make constructive
suggestions for improvement.
4. Examine ways to minimize and/or eliminate overlapping and duplicative
services.
e. The Commission may send representatives, when appropriate, to other bodies or
commissions.
f. The Commission shall perform other duties as assigned by the Town Council.
BE IT FURTHER RESOLVED that Resolution 2003-133 is hereby rescinded.

18910. Appointment of board of trustees
The public library shall be managed by a board of library trustees, consisting of five members, to be
appointed by the mayor, president of the board of trustees, or other executive head of the munici-
pality, with the consent of the legislative body of the municipality.
18911. Term of office and compensation
The trustees shall hold office for three years. The members of the first board appointed shall so
classify themselves by lot that one of their number shall go out of office at the end of the current
fiscal year, two at the end of one year thereafter, and two at the end of two years thereafter. .
The legislative body of the municipality may, by ordinance, provide for the compensation of such
trustees; provided that the respective compensation for such trustees shall not exceed fifty dollars
_ ($50) per month.
18912. Eligibility of men and women
Men and women are equally eligible to appointment as trustees.
18913. Vacancies
Vacancies shall be filled by appointment for the unexpired term in the same manner as the original
appointments are made.
18914. Monthly metings
Boards of library trustees shall meet at least once a month at such times and places as they may fix
by resolution.
18915. Special meetings
Special meetings may be called at any time by three trustees, by written notice. served upon each
member at least three hours before the time specified for the proposed meeting.
LIBRARY BOARD CONTINUED
18916. Quorum
A majority of the board shall constitute a quorum for the transaction of business.
18917. President
The board shall appoint one of its number president, who shall serve for one year and until his
successor is appointed, and in his absence shall select a president pro tem.
18918. Record of proceedings
The board shall cause a proper record of its proceedings to be kept.
18919. Rules, regulations and by-laws
The board of library trustees may make and enforce all rules, regulations, and bylaws necessary for
the administration, government, and protection of the libraries under its management, and all
property belonging thereto.
18920. Administration of trusts; receipt, holdings and disposal of property
The board of library trustees may administer any trust declared or created for the library, and receive
by gift, devise, or bequest and hold in trust or otherwise, property situated in this state or elsewhere,
and where not otherwise provided, dispose of the property for the benefit of the library.
18921. Officers and employees
The board of library trustees may prescribe the duties and powers of the librarian, secretary, and
other officers and employees of the library; determine the number of and appoint all officers and
employees, and fix their compensation. The officers and employees shall hold their officers or
positions at the pleasure of the board.
18922. Purchase of personal property
The board of library trustees may purchase necessary books, journals, publications, and other
personal property.
18923. Purchase of real property, and erection of rental and equipment of buildings or rooms
The board of library trustees may purchase real property, and erect or rent and equip, such buildings
or rooms, as may be necessary, when in its judgment a, suitable building, or portion thereof, has not
been provided by the legislative body of the municipality for the library.
18924. State publications
The board of library trustees may request the- appropriate state officials to furnish the library with
copies of any and all reports, laws, and other publications of the state not otherwise disposed of by
law.
18925. Borrowing from, lending to, and exchanging with other libraries; nonresident borrowing
The board of library trustees may borrow books from, lend books to, and exchange books with other
libraries, and may allow nonresidents to borrow books upon such conditions as the board may pre-
scribe.
18926. Incidental powers of board
The board of library trustees may do and perform any and all other acts and things necessary or
proper to carry out the provisions of this chapter.
18927. Annual report to legislative body and to State Librarian
The board of library trustees, or if there is no board of trustees, then the administrative head of the
library shall, on or before August 31st, in each year, report to the legislative body of the municipality
and to the State Librarian on the condition of the library, for the year ending the 30th day of June
preceding. The reports shall, in addition to other matters deemed expedient by the board of trustees
or administrative head of the library, contain such statistical and other information as is deemed
desirable by the State Librarian. For this purpose the State Librarian may send to the several boards
of trustees or administrative heads of the library instructions or question blanks so as to obtain the
material for a comparative study of library conditions in the state.

RESOLUTION 2004 - 3
RESOLUTION OF THE TOWN COUNCIL OF THE TOWN OF LOS GATOS
RESCINDING RESOLUTION 2002-103 AND ESTABLISHING
THE PARKS COIYMISSION
WHEREAS, Section 19.20.010 of the Los Gatos Town Code states that the Town
Council shall establish a Parks Commission; and
WHEREAS, Resolution 2002-103 established the Parks Commission; and
WHEREAS, the Town Council now desires to rescind Resolution 2002-103 and
establish a Parks Commission with advisory oversight for issues related to public parks, off-street
trails, open space, grounds, street trees, and Town beautification.
NOW, THEREFORE, THE TOWN COUNCIL OF THE T'OWN OF LOS
GATOS DOES HEREBY RESOLVE AS FOLLOWS:
1. There is hereby created a Parks Commission for the Town.
2. The Commission shall be advisory to the Town Council and shall operate in the manner
hereinafter prescribed.
3. Membership/Organization
a. The Parks Commission shall consist of nine (9) members, seven (7) adults, two
(2) students. All commissioners shall be appointed by the Town Council. "
b. Six (6) adult members of the Commission shall reside within the incorporated
municipal limits of the Town of Los Gatos, California; one (1) adult member may
reside within the incorporated municipal limits of the Town of Los Gatos or of the
City of Monte Sereno, California. Two (2) youth members shall reside within the
incorporated municipal limits of the Town of Los Gatos, California and attend any
accredited school; or reside in the unincorporated areas of the County of Santa
Clara, California, which have a Los Gatos mailing address, and attend a school
located within the Town of Los Gatos.
C. Two (2) youth members of the Commission shall, at the time of their
appointment, have completed the ninth grade, and shall be no more than eighteen
(18) years old.
d. The Commission shall develop a procedure regarding recruitment of youth
members for Council approval. The terms of office of the student members shall
be one (1) year, commencing October first and ending September thirtieth.
e. The terms of office of all other members of the Commission shall be four (4)
years and until their successors are appointed and qualify. The members' terms of
office are staggered and overlapped so that the terms of no more than one-third of
the members expire each year.
f. Commission members shall serve without compensation, provided that, with
advance budgetary approval of the Town Council, the actual and necessary
expenses (if any) incurred by the members in the conduct of Town business shall
be reimbursable pursuant to the current Council policy.
g. The Commission shall establish a regular time and location for its meetings and
shall otherwise call and conduct its meetings in compliance with the provisions of
the Ralph M. Brown Act (Government Code Sections 54950 and following.)
I The Parks Commission shall hold regular meetings at least once a month, and,. at
the discretion of the Commission, such other meetings as may be necessary or
expedient. A majority of the Parks Commission shall constitute a quorum for the
purpose of transacting the business of the Commission. The Parks Commission
shall elect a Chair and a Vice-Chair, both of whom shall serve at the pleasure of
the Commission. Terms of office shall be for one (1) year and shall begin on the
first meeting in March and end the following March.
i. Staff services as required shall be provided to the Parks Commission by the
Director of Parks and Public Works, who shall also serve as Secretary of the
Commission without vote.
Meeting attendance requirements will conform with current Town Resolution.
k. The Secretary of the Parks Commission shall. keep a record of all proceedings,
resolutions, findings, determinations, and transactions of the Commission, which
records shall be a public record, and a copy of which shall be filed with the Town
Clerk.
4. Powers and duties. The duties of the Parks Commission shall be to:
a. Act in an advisory capacity to the Town Council in matters pertaining to public
parks, off-street trails, open space, grounds, street trees, and Town beautification,
and to cooperate with other governmental agencies and civic groups in the
advancement of sound planning and programming for parks and street trees.
b. Review policies and procedures on park, trail, open space, street tree, and
beautification programs for approval by the Town Council.
C. Review periodic inventories of parks, street tree, trails, open.space, and .
beautification services that exist or maybe needed, and interpret the needs of the
public, within these areas, to the Town Council.
d. Aid in coordinating the park, open space, trail, street tree, and beautification
services with the programs of other governmental agencies and voluntary
organizations.'
e. Understand the policies and functions of the Town park, street tree, open space,
trails, and beautification programs.
f. Advise the Director of Parks and Public Works in the preparation of the annual
budget for the parks, street tree, trails, open space, and beautification programs,
and a long-range capital improvement program for these services.
g. Hold hearings on matters pertaining to park, open space, and trails sites, their
acquisition and development, capital expenditures, and municipal activities in
relation to parks.
5. Not to affect powers of Town Council. Nothing in this resolution shall be construed as
restricting or curtailing any of the powers of the Town Council, or as a delegation to the
Parks Commission of any of the authority or discretionary powers vested and imposed by
law in such Council. The Town Council declares that the public interest, convenience,
welfare and necessity require the appointment of a Parks Commission to act in a purely
advisory capacity to such Council for the purposes enumerated in this resolution.
BE IT FURTHER RESOLVED that Resolution 2002-103 is hereby rescinded.
PASSED AND ADOPTED at a regular meeting of the Town Council of the
Town of Los Gatos, California, held on the 5th day of January, 2003 by the following vote:

Completion of "Safe Routes to Schools Project;" added paved walkways (sidewalks were a
significant improvement for students).
Improved safety by completing pedestrian island at Massol and Highway 9; a major improvement
for the crosswalk crossing at Highway 9.
Existence of a Transportation and Parking Commission is a benefit to the Town.
Provided a forum for public participation on traffic related issues.
Acted as a filter and encouraged more thought regarding issues before presenting to the Town

Issues specific to Commission.
Commission thoughts on parking issues in the downtown:
Traffic calming will always be an important issue for this Commission, but pedestrians and cyclists
are finding themselves in harms way. Our community has narrow high speed corridors without
sidewalks or bike lanes. Not everyone in our community has convenient access to our protected
trails. We need to find solutions that may include alternate pedestrian and bike paths in adjacent
right-of-ways.
Solutions to parking problems will always be dynamic with no end in sight. It is frustrating to realize
that we may not solve all of our parking problems in the long term, therefore, we must find
gratification in creative short term solutions.
Implement Downtown Parking Management Plan as needs occur in each zone.
Plan a second parking structure.
Focus less on parking - other issues are important as well.
Improve crosswalks around Town.

Learn more about what goes into the road repairs that are made around Town, and what source of
funding is used.
With the implementation of the Small Bus Program, the Commission needs a better understanding
of what make VTA "tick" and what are the economics of a successful public transportation system.
Questions and comments for the Council.
The Chair of the Commission presents these comments to the Town Council on behalf of the
Commission:
The reduction in scope of the street repairs on North Santa Cruz Avenue has made it very clear that
the present economic situation in the downtown is less than good. The funds not utilized for the
North Santa Cruz Avenue project should be spent carefully on projects that we need now. We should
not expect any significant increase in revenue for the next few years. Unless we are successful in
obtaining grant money, we probably will not be able to fund large projects for five or more years.
Fortunately, we have a large volunteer base. I am not suggesting we burn out our volunteers, but
small projects could be put on a wish list and our volunteers would probably welcome the direction
of effort. Hopefully, this would not be used to replace Town employees, but would be used to good
works and free Town employees to perform tasks that require more than garden tools and brooms.
Has been less controversy in "parking" and more on the local economy.
More open discussion on safe routes to schools, traffic calming, and changes in VTA bus service.
Recent hearings on the North Santa Cruz Avenue project and subsequent policy changes have given
the Council more strength to consider "what is next:"
Commission is ready to discuss many of the issues that will need presentation to the Town as a
whole.

RESOLUTION 2004 -110
RESOLUTION OF THE TOWN COUNCIL OF THE TOWN OF LOS GATOS
DETERMINING THE NEED FOR A PARKING AUTHORITY;
DECLARING THE TOWN COUNCIL TO BE THE PARKING AUTHORITY;
ESTABLISHING THE TRANSPORTATION AND PARKING COMMISSION;
AND RESCINDING RESOLUTION NO. 2002-135
WHEREAS, transportation issues throughout the Town need to be carefully evaluated to
ensure that the quality of life in the Town is positively impacted by proper transportation
management;
WHEREAS, traffic congestion and speeding, particularly in the residential neighborhoods,
is also an ongoing problem within the Town of Los Gatos; and
WHEREAS, pursuant to Section 3650 of the Streets and Highways Code of the State of
California there has been created and now exists a public body corporate and politic known as the
Parking Authority of the Town of Los Gatos in accordance with the provisions of the Parking Law
of 1949; and
WHEREAS, the Parking Law of 1949 provides that the Parking Authority shall not transact
any business or exercise any powers unless and until the Council by resolution declares that there
is need for the Authority to function in the Town of Los Gatos; and
NOW THEREFORE BE IT RESOLVED BY THE TOWN COUNCIL OF THE TOWN
OF LOS GATOS:
There is a need for a Parking Authority to function in the Town of Los Gatos and this
Council hereby so declares and determines.
a. The Council hereby declares itself to be the Parking Authority, and all of the rights,
powers, duties, privileges, and immunities vested by the Parking Law of 1949 in the
members of the Parking Authority shall be vested in the Council of the Town of Los
Gatos as the Parking Authority of the Town of Los Gatos.
b. The purpose of the Parking Authority is to establish and manage parking
improvements in the Central Business District.
C. The Mayor of the Town of Los Gatos shall act as the chairperson and presiding
officer of the Parking Authority of the Town of Los Gatos; and the Town Clerk and
Town Treasurer, respectively, of the Town of Los Gatos shall act as Clerk and
Treasurer of the Parking Authority of the Town of Los Gatos.
2. There is a need for a Transportation and P arking Commission to function in the Town of Los
Gatos to review and recommend actions relating to traffic calming, bikeways, parking, and
related local traffic issues.
a. There is hereby established a Transportation and Parking Commission which shall
generallybe responsible for advising the Town Council regarding local transportation
and parking strategies and for advising the Parking Authority on matters pertaining
to parking in the Central Business District.
b. Membership / Organization
i. The Transportation and Parking Commission shall consist of seven (7)
members. Residency in Town is required for appointment and continued
membership on the Transportation and Parking Commission, for all
members.
(1) Persons initially appointed to the newly established Transportation
and Parking Commission, who were members of the former Parking
Commission at the time of its dissolution in July 2002, need not be
Town residents.
ii. Members shall serve a term of four (4) years and until their successors are
appointed and qualified, except any appointments to fill an unexpired term
shall be for such unexpired period.
iii. At its first meeting, or as soon as possible thereafter, the Commission shall
elect officers and adopt bylaws for the conduct ofbusiness. The Commission
shall appoint and prescribe the term of office for its Chair and Vice-Chair.
iv. Five voting members of the Commission shall constitute a quorum for the
purpose of transacting business.
V. Commission members shall serve without compensation, provided that, with
advance budgetary approval of the Town Council, the actual and necessary
expenses (if any) incurred by the members in the conduct of Town business
shall be reimbursable pursuant to the current Council policy.
vi. The Commission shall hold a regular meeting at least once each month. The
Commission shall establish a regular time and location for its meetings and
shall otherwise call and conduct its meetings in compliance with the
provisions of the Ralph M. Brown Act (Government Code Sections 54950
and following).
vii. Minutes of the actions taken during its meetings shall be kept and filed with
the Town Clerk.
viii. Meeting attendance requirements will conform with current Town
Resolution.
C. The duties of the Commission shall include the following:
i. Provide advice and reviews and recommendations to the Town Council on
all matters related to transportation and parking within the Town, excluding
matters related to parking management within the Central Business District,
which advice reviews and recommendations shall be forwarded to the
Parking Authority.
ii. Review, monitor, and make long-range recommendations concerning the
construction, operation, and maintenance ofpublicly owned off-street parking
lots and structures and on-street parking spaces within the Central Business
District.
iii. Review, monitor, and make recommendations regarding parking meter rates
and limits; parking meter replacement; directional sign placement, and
parking lot traffic patterns.
iv. Advise on fees and assessments for the parking improvement program.
V. Make recommendations regarding the allocation of funds derived from
revenues collected on behalf of the Parking Authority. The recommendations
shall be based on allowed uses of such proceeds consistent with state and
local law.
vi. Review and advise staff proposals to provide traffic calming measures in
accordance with the approved Traffic Calming Policy. Such proposals, if
implemented, would be temporary. Permanent installations oftraffic calming
measures would be made with a consensus of the affected neighborhood and
the approval of the Town Council.
vii. Advise the Town Council on policy matters relating to local transportation
issues, as requested by the Town Council.
viii. Advise the Town Council on policy matters relating to bikeways and bicycle
system planning, with such recommended policies and systems to be
approved by the Town Council.
ix. Perform other duties as may from time to time to be prescribed by the Parking
Authority or the Town Council.
3. This Resolution shall take effect immediately upon its adoption.
BE IT FURTHER RESOLVED that Resolution No. 2002-135 is hereby rescinded.

RESOLUTION 2004 - 67
RESOLUTION OF THE TOWN COUNCIL OF THE TOWN OF LOS GATOS
RESCINDING RESOLUTION 2004 - 42 AND.
RE-ESTABLISHING A YOUTH COMMISSION
WHEREAS, it is recognized that a youth perspective on issues which pertain to the youth in the
community is an important part of decision making in Town; and
WHEREAS, there is value in increasing communication between adults and youth; and
WHEREAS, there is value in having a mechanism for youth to have a voice in Town affairs and
issues relating to youth; and
WHEREAS, the Town Council of the Town of Los Gatos found and determined that the purpose
of the Youth Commission is to foster and encourage civic and neighborhood pride and a. sense of
identity through the knowledge, understanding, and increased involvement of the Town's youth,
in the Town's present and future municipal affairs.
NOW THEREFORE BE IT RESOLVED BY THE TOWN COUNCIL OF THE TOWN
OF LOS GATOS:
1. There is a need-for a Youth Commission to function in the Town of Los Gatos, which would
establish a formal body by which the youth of Los Gatos would have a voice in the
community.
a. There is hereby established a Youth Commission which shall generally be
responsible for studying various problems, activities and other issues of concern to
the youth in general, and for advising Council on matters pertaining to issues
involving the youth of Los Gatos.
b. Membership/Organization
i. The Youth Commission shall consist of fifteen (15) members. The members
shall be students who are entering grades 8 through 12 during the
establishment of the initial Commission, and of students who are entering
grades 8 through 11 thereafter. Membership for the students requires either
residency in the incorporated limits ofthe Town of Los Gatos and enrollment.
in any accredited school, or residency in the unincorporated areas of the
County of Santa Clara, which have a Los Gatos mailing address, and
enrollment in a school located in the Town of Los Gatos.
ii. Up to five (5) Alternates may be appointed to the Youth Commission, with
one representing each grade level appointed to the Commission. The
alternates shall be students who are entering grades 8 through 12 during the
establishment of the initial Commission, and of students who are entering
grades 8 through 11 thereafter. Membership as an Alternate requires either
residency in the incorporated limits of the Town of Los Gatos and enrollment
in any accredited school, or residency in the unincorporated areas of the
County of Santa Clara, which have a Los Gatos mailing address, and
enrollment in a school located in the Town of Los Gatos. An Alternate shall
serve on the Youth Commission in the event a member from that grade is no
longer able to serve the remainder of his/her term.
Members and Alternates first appointed to the Commission shall so classify themselves so that the
terms of the first members shall end as follows: the term of seven (7) of the student members shall
expire on June 1, 2005, which group shall include any members who are entering grade 12 at the
time of appointment. The terms the other six (8) student members shall expire on June 1, 2006.
Succeeding members shall serve a term of two (2) years and until their successors are appointed and
qualified, except any appointments to fill an unexpired term shall be for such unexpired period.
iii. At its first meeting, or as soon as possible thereafter, the Commission shall
elect officers and adopt bylaws for the conduct of business. The Commission
shall appoint and prescribe the term ofthe office for its Chair and Vice-Chair.
iv. Eight (8) voting members of the Commission shall constitute a quorum for
the purpose of transacting business.

i. Foster greater involvement of youth in municipal government affairs.
ii. Study problems, activities, and concerns of youth, especially as they relate to
municipal programs or projects of the Town of Los Gatos.
iii. Hold forams on problems, activities and concerns of youth, either alone or in
conjunction with other governmental agencies and community organizations,
as the Commission deems desirable.
iv. Review municipal matters referred to the Commission by the Town Council
or other Town boards, committees, or commissions and, as appropriate, make
recommendations on those matters.
