RECOMMENDATION:
Discuss and provide direction on options for scheduling Town paving project and San Jose Water
Company project on N. Santa Cruz Ave.
BACKGROUND:
At the Town Council meeting on February 7, 2005, Council gave staff direction to solicit additional
public input on the options for sequencing the San Jose Water Company project and the "Town
paving project. Each of these options involved closing the street from Main Street to Highway 9 for
the entire project, working from 6:00 a. in. to 10:00 p. in. six days a week. The three options
discussed were:
1. SJWC Project in Summer 2005 and Town Project in Summer 2006 or 2007. Substitute
the SJWC project with the Town's street reconstruction project planned for the summer.
Allow SJWC to begin their work July 1 Its and complete it by August 12"'. The Town would
then schedule the street project for the summer of 2006 or for the summer of 2007 ( a 5-week
closure in 2005, and a 4-week closure in either 2006 or 2007). A consideration in this option
is the impact on the Main St. project and whether the N. Santa Cruz and Main St. projects
would be completed in reverse order or in the same year.
2. SJWC Project in Spring 2005 and Town Project in Summer 2005 (Revised). Allow San
Jose Water Company to begin their work on April 18th and complete it by May 20th. This
would result in a six-week water project. The Town would reconstruct North Santa Cruz
Avenue during the summer season as planned, from July I I to August 12"' (a total 10 weeks

DISCUSSION:
Following the Council discussion, staff held a community meeting on February 9 at the Los Gatos
Cinema. Notices were sent to 850 addresses from Massol to Edelen Avenues, between Main Street
and Highway 9, including the cross streets. Notices were also sent to the Transportation and Parking
Commission and the Parks Commission. The purpose of the meeting was to receive input on the
three options regarding the advantages and disadvantages of each, as well as any other input about
the projects and/or timing. Approximately 90 people attended. A summary of the participants'
comments received (Attachment 1) and the PowerPoint presentation given (Attachment 2) are
attached. Comments received by e-mail and phone are included as Attachment 3.
As Council is aware, staff has held a number of meetings, mailed notices to these same addresses,
and posted information the Town's web site and in the local media regarding the Town project over
the past year. At a Council meeting held October 4, 2004, the Council decided to proceed with the
reconstruction of N. Santa Cruz Ave. via a full closure of the street over a four-week period in the
summer. This decision was based on input from affected businesses and residents, and on technical
information provided by staff.
At the February 9`" community meeting, it appeared that many in the audience were not aware of the
previous discussions and decisions. Many of the questions and comments focused on the impacts
of construction (either the Town's or SJWC's) on business viability, traffic and parking. Concern
was expressed over the timing of either project with regard to the duration of the street closure, the
time of year (i.e., summer vs. other seasons) and to general economic conditions.
Following questions and comments from the audience, staff asked for a straw vote on the three
options. The results were:
Option 1 - 36 votes in support
Option 2 - 4 votes in support
Option 3 - 31 votes in support

Option 2, which would require SJWC to complete their project this spring, followed by the Town's
project in the summer, was not a popular choice. In addition, it would be challenging for SJWC to
undertake the project at this time given the delays in making the decision to move forward. Staff
would also recommend against this option due to the greater levels of traffic in the spring when
school is in session. Due to these reasons, staff is recommending that this option not receive further
consideration. For purposes of discussion, "Option 3" now becomes "Option 2."
Toward the end of the meeting, questions were raised about the need to undertake the reconstruction
of N. Santa Cruz Ave. at all. A couple of participants asked if a less extreme approach to improving
the road could be taken, given that the street is drivable and not in danger of collapse, while the
economy is continuing to recover. The question was also raised whether a less intense road project
would negate the need for the water line replacement project.
Although many of the issues raised regarding the Town's street project had been considered over the
last two years, given the interest generated by these questions, staff has had further discussions with
the design engineers, the geotechnical engineers, and SJWC. Based on these discussions, staff is
presenting additional options for Council consideration. These options are built around information
on an alternative approach to the road project and on SJWC's response to the alternative approach.
Alternative Approach: As an alternative to reconstructing N. Santa Cruz Ave., the Town could
perform an overlay on the street, which was considered previously but rejected for reasons discussed
below. This would entail removing and replacing 4 to 6 inches of existing asphalt on the street and
repaving it with a 4 inch asphalt concrete (AC) pavement. Under this alternative, the concrete base
would not be removed, thus reducing the time required for the project from 4 weeks to 2 weeks or
less.
The overlay project would cost approximately $600,000, compared to the $1.2 million estimated
cost for reconstruction. The final product would be one of a lesser quality, however. Whereas the
original design would have provided an expected life expectancy of 20 years, the overlay project
would provide a more limited life expectancy of 5 to 10 years, due to the continued instability of the
concrete base. Even though this option would remove the existing surface, it would not address the
base problems that exist on the road. Deterioration of the base will continue, which will continue to
cause cracks in the new asphalt surface. Cracks and pot holes are more likely to appear within the
first 5 years, requiring ongoing maintenance of the street. Ongoing maintenance will cause
intermittent disruption of traffic and parking, and will result in additional maintenance costs. The
street will have signs of patching over time. The high crown issues also would not be addressed,
since only the asphalt surface would be replaced. In order to correct the cross-slope, sections of the
underlying concrete base would need to be removed. Nevertheless, the street will be in better

condition in 5 to 10 years than it is now, and with proper maintenance, it will continue to provide
acceptable service for the public.
In October 2004, staff had recommended to Council removal of the existing surface and concrete
base (reconstruction) rather than this alternative approach. Reconstruction of the road would ensure
that all failed roadway sections have been removed and that the new road will have design life of
20 years. The high crown of the road will be eliminated and the ride will be greatly improved.
Over time, with continued deterioration of the concrete base, the Town may decide to reconstruct the
street and would face similar issues regarding closure. From technical and cost perspectives, staff
believes the reconstruction of the street is the most prudent; however, staff also recognizes that there
are other considerations for slaking a decision to perform an overlay only.
SJWC Response: According to SJWC, if the Town were to perform an overlay only on the sheet, it
would not be necessary to replace the water main at this time. The chance of damaging the pipes is
significantly less if the excavation does not exceed 6 inches and if the pipes aren't subject to
reverberation from concrete removal equipment.
Although replacement would not be necessary under this alternative, SJWC believes it would be
prudent to replace the water system at this time. The age and material of the pipes and the condition
of the valves suggest that the system may need to be replaced at some point in the next 10 to 15 years.
Given the opportunity presented by the road repaving, SJWC has stated that replacement now would
avoid possible future disruption.
An important outcome of the most recent discussion with SJWC is that the company has stated that
replacement of the water main from the Main St. bridge 400 ft. to the cast is in the company's 5-year
capital improvement plan. They anticipate that the replacement would not require closure of the road
given the road's width. This new information will need to be incorporated into planning for the Main
St. repaving project.
Based on this information, staff is presenting three additional options. Beginning with the two
previous options still under consideration, the options are:
Option 1: SJWC Project in Summer 2005 and Town Project in Summer 2006 or 2007.
Substitute the SJWC project with the Town street reconstruction project planned for the summer.
Allow SJWC to begin their work July 11" and complete it by August 12`' . The Town would then
schedule the street project for the summer of 2006 or for the summer of 2007 ( a 5-week closure in
2005, and a 4-week closure in either 2006 or 2007). A consideration in this option is the impact on
the Main St. project and whether the N. Santa Cruz and Main St. projects would be completed in
reverse order or in the same year.

Option 2: SJWC Project and Town Project in Summer 2005. Allow San Jose Water Company

Option 3 (new): SJWC Project and Town Overlay Project in Summer 2005. This option would
allow SJWC to undertake saw cutting for the main line replacement from June 20`" though July P'
During this period, the road would be open with localized lane closures only, saw cutting would occur
from 6 a.m. to 11 a.m. five days a week. The road would then be closed from July 5"' though August
14`", with work occurring from 6 a.m. to 10 p.m., six days a week. The SJWC project would be
completed by August 5`", followed by the Town overlay project until August 14`"
Option 4 (new): Town Overlay Project in Summer 2005, No SJWC Project.. This option would
involve construction of an overlay occurring with street closure over approximately 2 weeks during
the July I I" though August 5th period already planned for street closure.
Option 5 (new): No Town or SJWC Project in 2005. Under this option, neither project would be
undertaken this summer. Either one or both projects could occur in later years, depending on fund
availability and other considerations.
The key advantages and disadvantages of each of these options are presented in Attachment 4
It is important to note that the Town's and SJWC's efforts to mitigate the impacts of the projects are
consistent for all of the options. Significant plaruling has been underway regarding traffic circulation,
traffic control, signage, parking, access to businesses, construction management, and marketing and
communication. Town and SJWC staff are prepared to undertake efforts to minimize the impacts on
the business, residential and general community.
With regard to marketing, staff has developed a campaign for "Summer in Los Gatos," targeting two
general audiences: shoppers, diners and other visitors in the greater Santa Clara County area and
destination travelers in the greater Bay Area. Preliminary concepts have been discussed with a focus
group, including the Chamber of Commerce. The complete plan will be discussed at a Chamber
"Down 2 Biz" seminar in March.
The day visitor campaign will involve co-operative advertising opportunities to promote local
businesses and community events, as well as web-based and print media opportunities to promote
community events. To promote shopping and dining among local residents, a direct mail brochure
highlighting all of the Town's commercial district will be developed. "Branding" of the Los Gatos
experience and tag lines promoting Los Gatos will be a part of all of these activities.

The destination campaign will involve a broader reach of advertising opportunities, as well as the
promotion of articles in key magazines reaching the target audience. Again, branding will be integral
to the destination campaign.
The decision about the scope of the construction projects will drive the extent of the campaign this
year. That is, if construction extends beyond 4 weeks, staff does not intend to implement the
destination marketing campaign this year. Rather, this campaign would wait until next spring so as
to not attract destination travelers to the area when extended construction is occurring.
A third element of the marketing effort is "event planning" surrounding the construction itself. Staff,
the Chamber and the merchants have generated a number of ideas about how to make the construction
experience interesting and enjoyable. Once the decision is made about the construction to occur this
summer, if any, staff will call together a group of merchants who have already volunteered to plan
this aspect of the project. Ideas to date include decorative construction fences, parking lot sales, fun
shuttle busses, construction mascot, coupons and special events.
In all of these marketing activities, Town staff will continue working with the Chamber to coordinate
the effort. This will maximize the funds that are available for advertising and other marketing tools.
Danielle Surdin, the Town's Economic Vitality Manager, has significant experience and training in
marketing, and will play a key role in this effort. The Town may need to obtain outside graphic
assistance for some of the activities.
CONCLUSION:
As discussed at the February 7`' Council meeting, the Town is faced with a challenging decision
regarding the occurrence and the timing of these projects. This staff reports presents five options for
scheduling these projects based on input from the affected businesses and residents, staff and SJWC.
Staff is seeking Council direction regarding which option to pursue.
ENVIRONMENTAL ASSESSMENTS:
Discussion of options regarding project scheduling is not a project defined under CEQA, and no
further action is required.
FISCAL IMPACT:
With any of the options, the Town will incur costs for marketing efforts. It is estimated that this
investment will be in the $30,000 range. There are some differences in the cost of one option versus
another, as depicted in the comparison table (Attachment 4), and the projected costs of' road
construction is expected to increase at least by the cost of inflation if the project is delayed.

The Downtown Street Reconstruction Proj ect was originally budgeted for $2,810,000, funded entirely
through an allocation of the $10.7 million July 2002 RDA Certificates of Participation. If the project
start date is moved back or a different scope of project is proposed with lower project costs than the
current remaining budget of $1.5 million, the bond funds originally contemplated to be spent by the
summer of 2005 will remain invested by the Town. If the Town were to use a lower cost street
resurfacing option for this project, there could potentially be dollars remaining from this project that
could be "substituted or re-allocated" to another bond eligible project, which is allowable under the
Town's bond indenture. Substitute projects could be evaluated after all planned projects and final
accounting of funds have been completed.
Associated with the project timing or project scope changes and potential savings, one aspect that
must be monitored by the Town is the timing of the expenditure of the remaining bond proceeds
associated with this project. There is generally a three year rule to spend 85% of the net bond
proceeds to avoid paying "arbitrage" to the Federal Government to limit abuse of tax sheltered debt
issuances by municipalities. The Town's three year time limit will expire in July 2005. Upon
expiration of the temporary time limit in July 2005, federal arbitrage rules prevent the Town from
earning more on the investment of the bond proceeds than the bond issue yield. The effective bond
yield of the RDA 2002 issue was 5.125%. Any cumulative earnings on the current project balance
in excess of 4.791% must be paid back to the US Treasury. There appears to be limited exposure to
this risk of payment of "excess earnings" back to the US Treasury due to the low interest rate
environment . Though current rates are slowly rising, the current yield on the invested 2002 RDA
COP bond funds is approximately 2% as of last computation period from July 2002 to November
2004.

In the meeting on Feb. 9, 2005 at the Los Gatos
Theatre
we were informed that the Town Council's final meeting
to make a decision on the street improvements planned
for North Santa Cruz Avenue, will be held on Feb. 22,
2005.
Since I will not be able to be there to speak in
person at that meeting, I would like to cast my vote
in favor of completing light repair work on the
pavement for a couple of weeks this summer and
postpone both the resurfacing and pipe projects for
several years. This is my first choice.
My second choice is substituting the SJWC project for
the Town's project this summer and postponing the
Town's project until summer, 2006 or summer, 2007.
Estimated closure of 5 weeks this summer, and 4 weeks
either in 2006 or 2007.

These are my thoughts: it might not change anything but I feel better writting them.
First, from my put of view closing Santa Cruz in the middle of summer is crazy. I am positive that is the
bussiest time of year for most retail business. The argument that we can't do this work in the spring or fall
because it might slow a parents commute by ten minutes makes no sense. Let's prioritize here. What is
moe important a slow commute or putting a local merchant out of business? Willow Street will not go out
of business, but the summer is our busiiest time of year by far and it will hurt us and our employees.( do
you think our landlord is going to give us a rent break?) Some smaller businesses might close. This not
hyperbole.
Since you are probably going to close the street in the summer, doing it this year and next makes
sense Why? Customers get in habits. We don't want them to get in the habit say of going to Santana
Row.
Do away with all permit or restricted parking. What again is more important, inconveniecing a local
resident or putting a merchant out of busy?
The merchants are what helps make Los Gatos what it is. The merchants seem to pay a higher price
than local residents or landlords. That is simply not fair.

I am a long time resident of LG, and attended LG High School. I currently
live on Massol Avenue. I have 2 points to make.
The downtown project is badly needed. However, it makes zero sense to
complete it at the height of the season late spring-summer-early fall.
Why not complete it in the February-March time period next year and / or the
late September thru October period? I am not a merchant, but it seems crazy
not to schedule it in such a fashion. Each merchant has different
seasonality, but certainly this would keep the total economic impact in
check. Also, the Cats Hill Race should be considered, as I am certain it,
the farmers market, the jazz on the plaz etc will all be impacted during the
peak season being contemplated for the work.
My second point is that whenever the project is completed, the Almond Grove
section will bear the brunt of traffic end-arounds due to the North Santa
Cruz closure. Massol is a speed-based-traffic-death waiting to happen, as
it is. Regardles of the data that shows average speeds just under 30 MPH,
as you know, that means there are many people going excessively above that
speed. We already have a traffic calming effort underway this requests
however that during the closure period, some extreme measures be undertaken
to ensure speeds are kept to the North Santa Cruz equivalent target of 15
MPH on a 24 hour/7 day a week basis. Perhaps temporary speed bumps, or
posting a Police Officer at all times with a radar gun, or deputizing
volunteers to hand our traffic tickets or something can be done. Or certain
blocks be closed to thru traffic, requiring slower speeds as people are
force to make a circuitous route from one end of town to another. There is
nothing that can be done regarding increased volume effects, and the
neighborhood will get over that, but the Town will be faced with a real
problem if the inevitable traffic accident and /or related injuries are
suffered due to not keeping the speeding in check.
On a modestly related point, I am glad that the street will be re-paved - it
needs it badly and hopefully the Town will see its way clear to doing so on
Massol/Almond Grove as well for perspective, this section of town is held
to very strict, in fact onerous, standards regarding improving our
properties, however are not the beneficiaries of something the town could
kick in and do to preserve the beauty of the neighborhood which is to
re-pave.
I hope that since I am unable to attend, at least my first two points are
entered into the debate and the record. Thanks for the consideration.

Due to the fact that I live out of the area; the notice of this morning's meeting came too late for me to
attend. I would, however, like to "vote" my choice of proposals for the water and paving projects.
As owner of the Los Gatos Village Inn, I'm deeply concerned about the effects of closing the downtown
streets for any length of time; especially in the summer. We normally receive quite a few "walk-in"
reservations and I anticipate the lack of downtown ambiance will greatly affect our occupancy. I would like
to see the water project done this spring and the paving project either this summer or next summer.
DEFINITELY not both projects this summer! I can only assume that most business owners would feel the
same way.
From a Town financial standpoint; it makes sense to get the paving project done this year rather than
postpone another year and incur increased costs in materials and labor.
Please keep me informed as to what direction we are headed and allow me to make one last plea that we
DO NOT run both projects together this summer; 9-10 weeks of our best season could send some people
packing for good!

My business relies, in part, on drop-in shoppers who see the shop while
driving by the store. As a merchant on N Santa Cruz (Interior Services
of Los Gatos, 12 N Santa Cruz), I have experienced blockages to the
convenient use of the street in the past. Even the low-impact
installation of the flower enclosures impacted my business negatively.
I strongly oppose tearing up the street for an extended period of time.
Some merchants are just beginning to recover from the disastrous
economy over the past two years and are at a tenuous point
survival-wise. I'm sure there is a way around the total closing of the
street and blocking convenient parking in front of the stores.

I am a new retail shop owner in the Los Gatos area. We just opened in December. I found out today that
N. Santa Cruz Ave. could potentially be closed for nine weeks. This would effectively shut down our infant
business for that period of time. As a small business owner, new to this area, we can't afford to be
effectively closed that long. I'm sure other shop owners have voiced their concerns, but I just wanted to
make sure you heard our voice here at Sports Gallery. We are brand new to the area and are counting
on people walking by and discovering our store. A nine week closure of Santa Cruz. Ave. would be a nine
week shut off of our only source of new business in the infancy stage of our development. Is there no
way this can be done in a time period of less than nine weeks? That seems long for a re-paving job.

My store is north of Highway 9. However, I still have concerns, and I would attend the meeting but I open
at 9:00 and I have no one to cover the store for me.
I would have preferred an after closing meeting. In this manner my input could have been interactive.
Know this: my feelings are that the utility companies have dropped the ball or they were not led to a
coordinated review of the situation.
No matter the businesses south of Highway 9 are going to suffer, and I would be almost willing to
guarantee some will seek a redress of grievances in civil system.
It is the job of the Town Council to exercise its muscle and seek the least disruption as possible while
assuring the continued delivery of utility service.
My concerns would be to determine that neither the town council or the utility companies nor their
respective administrative staff persons created this problem.
I can promise this. Some businesses will not survive the disruption. And someone or some organization
will be asked to assume financial responsibility, and that cost will always come back to us.

Thank you for setting up the meeting with John Curtis. I think he understands our concerns and has
personally witnessed a downtown public works project in San Carlos (where he lives) and saw a number
of the businesses go out of business. The Cameras went through the downtown San Jose transit mall
project in the early 80's and saw other business fall like flies as people stopped coming downtown. We
came very close to losing our business too.
I understand there was great attendance and wide interest expressed at the meeting this morning, and we
are glad to have been available to help the town of Los Gatos gather the response that was offered for its
future considerations. We have looked at the options presented by John in our meeting and we would
recommend Council to consider the following:
1) Stretch this project over two years. Do not try to do everything all at once. The impact will be too
negative on the fragile business system downtown.
2) Most importantly, we need the town to get behind a promotional campaign, designed and executed by
experts in this area, to balance the negatively this project will bring on the downtown (great project when
done but not during work period). This investment will go a long ways in keeping all of us open, letting our
clientele know we are still open for business, and maybe offering them something special for their efforts
to participate while the construction is taking place.
3) Consider the project at a different time of the year. Traditionally, our best months are during the
summer. This project, if it is spread over the summer months, will affect the Los Gatos Cinema
negatively.
4) Have an on-going mitigation program for the downtown business and weekly meetings with feedback
on how the construction activity is affecting the businesses
Considering the competition now being applied by upscale shopping Centers like Santana Row, downtown
Los Gatos business community has a great deal to lose if we lose our customer base. Anything the town
can do to assist its downtown businesses will also help the tax base (sales tax) and business tax base for
the town budget. Moreover, downtown Los Gatos has such a great mix of businesses and losing them to
a construction project is not "good business".

I would like to take this moment to discuss the roadwork scheduled for N. Santa Cruz Avenue and raise a
number of concerns that I have about the viability of our business in the face of extended compromises to
accessibility and customer experience at the Los Gatos Theater.
The Council of the Town of Los Gatos has not yet come to a decision as to whether the upcoming work on
the antiquated water pipes along N. Santa Cruz Ave, and the re-paving of the street will be undertaken in
two consecutive years starting with 2005, or whether it will schedule the entire two prong project for 2005.
There is still some question, per John Curtis, as to whether the two projects will be carried out with an
hiatus of 2 months between them, or concurrently. Best information tells us that 8-10 weeks will be
required for completion of all, no matter what the configuration of events.
The Council intends to take this scheduling decision on Feb 22nd. It is my feeling that consecutive

projects would be detrimental to the Los Gatos Theater's well-being and, given current tight competitive
markets in the Santa Clara Valley, could be irretrievably harmful. It occurs to me that the Town of Los
Gatos itself should take the impact of consecutive jobs into consideration as anticipated municipal
revenues from Business Licences and from Sales Tax will decline in the wake of business revenues being
off for such an extended period of time.
John Curtis has rightfully pointed out that customers are creatures of habit. It is my concern that 8 weeks
of automotive inconvenience, dust, odors, loud noise and water interruption could drive customers to the
relative tranquility of Cine Arts in Santana Row which, after all, is just a jaunt up the highway. This is a
habit we do not want our customers to develop!
If it were possible to move the product that we would normally book at Los Gatos at Camera 7, the
problem would be mitigated to a degree, but Cine Arts at Santana Row exercises clearance and control
over Camera 7. Los Gatos, is completely free of Century Theaters' impositions, and is the only outlet we
have west of downtown San Jose at which we can exhibit top-notch product unfettered by the bookings of
any other theater chain.
During the upcoming water-road project, we have been told to anticipate:
street closures
limited pedestrian crossings
water service interruptions which could impact both our food service and our fire monitoring
high decibel noise which could invade the exhibition of films
I feel that it will take a strong and extended promotional campaign before, during and after the work is
done in Los Gatos in order to endeavor to retain our regular customers and to pre-empt their acquiring
new movie-going habits at Santana Row, and finally to lure back those who might find a few months of
inconvenience off-putting .
There needs to be an investment of dollars in a very muscular promotional campaign to mitigate a
revenue decline at the Los Gatos Theater when the public work begins.
As we know healthy cinema attendance has a salutory effect on surrounding restaurants, cafes and
shops, as film-going is frequently the anchor of an night on the town. A concerted promotional strategy
should be a matter of interest and participation for all of our neighbors on Santa Cruz Avenue as well as
the Town.
The Town has deemed the summer months the optimum time for this project or projects, and I can
understand the logic driving this position, given that school traffic is down, and daylight hours are long.
For the Los Gatos Theater, however, July has historically been a very busy month. As a matter of fact,
July was our highest grossing month for 2004 (see attached chart).
I would very much like to see us implement a cohesive promotional plan of action to countermand the
business decline that we are undoubtedly to experience. I hope that the City Council can offer advise
and support that will serve to help us to retain our customer base through what promises to be some
difficult weeks.

cornerstone of democracy. If you wish to speak to an item on the agenda, please complete a "speaker's card"
