SUBJECT: ADOPT CORRECTED RESOLUTIONAPPROVINGTHEMEMORANDUM OF UNDERSTANDING (MOU) BETWEEN THE TOWN OF LOS GATOS AND THETOWNEMPLOYEES' ASSOCIATION (TEA) FORTHEPERIOD JUNE20, 2004 THROUGH NOVEMBER 1,2006 RECOMMENDATION: Adopt corrected resolution approving the Memorandum ofUnderstanding (MOU) betweenthe Town of Los Gatos and the Town Employees' Association (TEA) for the period June 20,2004 through November 1,2006. DISCUSSION: The November 15, 2004 Town Council agenda included an item recommending adoption of a resolution approving the MOU between the Town and TEA. Unfortunately, the report did not ,include the correct resolution. Attached is the form of resolution which Council should have received for that item. This action will reflect the adoption ofthe corrected resolution and will ratify the prior approval of the MOU, which is now in effect. PREPARED BY: DEBRA J. RESOLUTION OF THE TOWN OF LOS GATOS APPROVING THE MEMORANDUM OF UNDERSTANDING BETWEEN THE TOWN OF LOS GATOS AND THE TOWN EMPLOYEES ASSOCIATION FOR THE PERIOD JUNE 20,2004 THROUGH NOVEMBER 1,2006 WHEREAS, representatives ofthe Town and the Town Employees Association, in accordance with the Town's Employer-Employee Relations Resolution No. 1974-41, have met and conferred in good faith within the scope of representation, and WHEREAS, the members ofthe Town Employees Association bargaining team have indicated that they will recommend to their membership that' they ratify the proposed Memorandum of Understanding, RESOLVED, by the Town Council of the Town of Los Gatos, County of Santa Clara, State of California, that the Town Council approves the Memorandum of Understanding between the Town ofLos Gatos and the Town Employee Association (TEA) for the period June 20, 2004 through November 1, 2006 as presented in Exhibit A; and that the Town Manager is hereby authorized to sign the agreement on behalf behalf of the Town. FURTHERRESOLVED, that this resolution shall replace the resolution adopted by the Town Council on November 15,2004, regarding the Memorandum of Understanding between the Town and the Town Employees' Association and that the approval of the Memorandum of Understanding on that date is hereby ratified.
