13 Staff Report - Grant Funds for Skateboard Park DATE: TO: COUNCIL AGENDA REPORT OCTOBER 25,2004 MAYOR AND TOWN COUNCIL MEETING DATE: 11/1/04 ITEM NO. 13 FROM: SUBJECT: TOWN MANAGER 􀀧􀁜􀀭􀀭􀀭􀀺􀀭􀁊􀁬􀁉􀀭􀀫􀀭􀁾􀀽􀀺􀀺􀀻􀁚􀀼􀀢 ADOPT RESOLUTION IN TH RM REQUIRED BY THE STATE APPROVINGTHEAPPLICATIONFORGRANT FUNDS FORTHE STATE URBAN PARKS AND HEALTHY COMMUNITIES PROGRAM UNDER THE CALIFORNIA CLEAN WATER, CLEAN AIR, SAFE NEIGHBORHOOD PARKS, AND COASTAL PROTECTION ACT OF 2002 FOR THE PROPOSED SKATEBOARD PARK RECOMMENDATION: Adopt Resolution in the form required by the State approving the application for grant funds for the State Urban Parks and Healthy Communities program under the California Clean Water, Clean Air, Safe Neighborhood Parks and Coastal Protection Act of2002 for the proposed skateboard park. BACKGROUND: At the October 4,2004 Town Council meeting, the Council directed staffto submit applications for State Park Bond .funds for the proposed skateboard park at the Town-owned parking lot on Miles Ave. The Council has previously committed $125,000 for the skateboard park, with funding to be sought from the per capita State Park Proposition 12 grant program or to be provided through the Town's General Fund Appropriated Reserve (GFAR) ifProposition 12 funds are not awarded. The FY 2004-05 Capital Improvement Program budget designates funds for this purpose. Staff will bring forward an application for these funds from the Proposition 12 grant program in the future. The estimated total construction costs for the skateboard park is $946,500, and Council has directed that the remaining balance must come from community fund raising. A community fund raising group has identified a competitive grant opportunity through the State Park Proposition 40 State Urban Parks and Healthy Communities program, and has requested that the Town submit an application for these funds. One ofthese competitive grant funds is the State Urban Parks and Healthy Communities Program. This program provides grants for acquisition or development ofproperties specifically for active recreational purposes, such as baseball, football, swimming and skateboard parks. The Skate Board Park Project is a development project that qualifies to apply for this funding source. The application for funding is due November 5, 2004, and a resolution from the Town is required as part of the application. Several criteria will be ranked and scored, including, but not limited to, whether there is a high unmet need in the community for this project, how the project involved the community in the planning process and how access to the facility will be provided. Based upon the Town's application scores relative to all other applications, the Town's application could be fully or partially awarded, or not rank high enough for funding. Notification of the outcome of the application review is anticipated by Summer, 2005. Ifawarded, the Town must complete the project within eight (8) years from the appropriation date. Grants up to $1 million are available from this program, and require a 25% local match. The requested grant amount is $709,875, with a $236,625 match required. The Town's $125,000 commitment will be part of the local match, and the remaining $111,625 will come from contributions of material and cash raised by the community fund raising group. CONCLUSION: Staffrecommends Council adopt the resolution to enable the Town to apply for competitive grant funding from the State for the skate board park. ENVIRONMENTAL ASSESSMENTS: Is a project defined under CEQA, and an environmental review is underway with an anticipated negative declaration. FISCAL IMPACT: As the grant is not yet awarded, there is no immediate fiscal impact. However, the intent is to obtain grant funding that will cover the costs ofdesign and construction for a skate board park in Los Gatos. A 25% match is required and will be met with the $125,000 already designated in the FY 2004-05 Capital Improvement Budget, and with additional contributions provided by the community. The State has indicated Proposition 12 funds may be used to provide a match for this competitive grant. RESOLUTION RESOLUTION OF THE TOWN COUNCIL OF THE TOWN OF LOS GATOS APPROVING THE APPLICATION FOR GRANT FUNDS FOR THE STATE URBAN PARKS AND HEALTHY COMMUNITIES PROGRAM UNDER THE CALIFORNIA CLEAN WATER, CLEAN AIR, SAFE NEIGHBORHOOD PARKS, AND COASTAL PROTECTION ACT OF 2002 FOR SKATE BOARD PARK PROJECT WHEREAS, The people ofthe State of California have enacted the CALIFORNIA CLEAN WATER, CLEANAIR, SAFENEIGHBORHOOD PARKS AND COASTALPROTECTIONACT OF 2002, which provides funds to the State of California for grants to eligible Applicants; and WHEREAS, the California Department of Parks and Recreation has been delegated the responsibility for the administration ofthe State Urban Parks and Healthy Communities Program and the grant Project shown above within the State, setting up necessary procedures; and WHEREAS, said procedures established by the California Depmiment of Parks and Recreation require the Applicant's Governing Body to certify by resolution the approval of the Application before submission of said Application to the State; and, WHEREAS, the Applicant will enter into a Contract with the State of California for the Project; NOW, THEREFORE, BE IT RESOLVED, that the Town Council of Los Gatos hereby: 1. Approves the filing of an Application for local assistance funds from the State Urban Parks and Healthy Communities Program under the California Clean Water, Clean Air, Safe Neighborhood Parks and Coastal Protection Act of2002; and 2. Certifies that the Applicant has or will have sufficient funds to operate and maintain the Proj ect; and 3. Certifies that the Applicant has reviewed, understands, and agrees to the General Provisions contained in the Contract shown in the Procedural Guide; and 4. Certifies that the Grantee has or will have available, prior to commencement of any work on the proj ect, the required Match; and ATTACHMENT 1 5. Certifies that the Project conforms to the recreation element of any applicable city or cOlmty general plan; and 6. Appoints the Town Manager as agent to conduct all negotiations, execute and submit all documents including, but not limited to, Applications, Agreements, payment requests, and so on, which may be necessary for the completion of the Proj ect.
